Wolf Creek RPUD -
To whom it may concern,
We are writing on behalf of the Raffia Preserve Master Association, Inc., through its
Resident Board of Directors; alongside 363 homeowners. Please accept this as a
formal request for this letter become part of the record.
This notice was mailed only to a fraction of our homeowners requesting an insubstantial
change to the RPUD to eliminate a traffic Condition 5.7.G in the Wolfe Creek RPUD.
The intent of which is to remove the Developers' obligation to fund future traffic
improvements. Lennar provided approval of this change representing Raffia Preserve,
by submitting a signed Affidavit of Authorization.
We have an issue with this, because Lennar acquired Raffia Preserve around May of
2017 representing the largest subdivision in the Wolfe Creek RPUD. The basis for this
change, as we understand, was based on a traffic count survey - created by an
employee at Collier County in the traffic department in 2017. This report concluded
traffic improvements or lights are not warranted.
At that time Raffia had about 150 homes closed, which didn't represent the full capacity
of traffic volume at buildout. It also didn't factor in the future traffic that would be
generated in Vanderbilt Reserve or future commercial development at the corner of
Collier and Wolfe Road, or Vanderbilt Commons — still under construction. Collier
County had the developers sign an Affidavit of Authorization to waive their contribution.
This should have been included for the Raffia Preserve Association since as over 50%
of the deeded parcels had already been conveyed.
When a handful of perimeter owners received this notice in Raffia Preserve, we learned
Collier County initiated the removal of the requirement for the developers' obligation,
within the Wolfe Creek PUD, to fund future traffic improvements. This change was
apparently deemed insubstantial. We believe this to be substantial because this
removal will shift financial liability of future roadway improvements to the homeowners
through the taxing body of Collier County in the form of real estate tax increases.
This change will affect every homeowner. However, because it's deemed insubstantial,
it significantly reduces the notice requirements down to a small fraction of parcels within
our community, instead of all 363 homeowners. The fact is that every owner in the PUD
is affected as we will all share the cost, a substantial change..
The language being proposed will remove the responsibility for all developers in the
PUD for funding future traffic improvements. It leaves out language defining who would
pay in the future or for amending the cost share agreement. The issue here is the fact
that the residential units in this PUD are currently over 80% built out, affecting over 800
parcel/units. This change doesn't factor in the developers within the PUD that passed
projected future traffic improvement costs to the homeowners since they built the cost
into the base price of their homes.
This change will not only reverse the developer's obligation under the PUD, but result in
homeowners paying not once, but twice for future traffic improvements. What happens
to the funds that the developers collected when they built the costs into the homes sold?
This change doesn't make mention of this, or how the owners subjected to this would be
made whole.
Consider the ongoing traffic volume as it exists today and is projected to grow. Since
2017 homeowners have been complaining to Collier County about the lack of proper
traffic control, namely at the intersection of Collier and Wolfe. For some time now we've
been left under the impression that a traffic study was performed in 2017, which we
were told didn't warrant a light. The reality is, that turning right or left on to Collier from
Wolfe is nearly impossible, no matter what time of day it is. Most residents living in the
Wolfe Creek PUD avoid this intersection because of the danger. Most will turn right
(south) to turn right again at Vanderbilt Beach Road, thus increasing the traffic at the
Pristine intersection.
Even if someone from Collier County is sent to record traffic counts —this element isn't
even being factored in because they simply don't know about it. The other intersection
at Pristine/Vanderbilt Beach Rd during peak times are met with vehicles stacking
excessively with increased wait times to turn right. Often, turning right results in drivers
taking huge risks, because the oncoming traffic doesn't afford a window to turn.
At some point and time, very soon, a light will be needed at one of these intersections
and very quickly the taxpayers will be left to pay up. If the developers are taken off the
hook and the language isn't specific on how it's being
paid for, the homeownthe PUD will be burdened with the cost of it along with the rest of the county.ers within
Members of our Board and several owners in our community have talked with Collier
County Transportation several times and were informed there was a traffic study in
2017. We have been recently tolk the light at Collier and Wolfe was never designed to
become a traffic signal and likely would never be activated. Apparently, it was
planned/built exclusively for the fire department. It was also stated that the light at
Collier and Wolfe was too close to the light at Collier and Vanderbilt Beach Rd,
therefore, converting it would be safety issue. The light at Pristine and Vanderbilt was
never mentioned, although the ordinance for the PUD mentions it may be needed.
Our issue is that traffic in the area is only going to increase exponentially. Vanderbilt
Reserve just broke ground At full buildout there will be 215 units. These two-story units
will likely have a working family demographic, which will generate more vehicles per
parcel. With Collier and Wolfe intersection unusable 4 months out of the year and
turning north being impossible, the Pristine and Vanderbilt Beach intersection is now
headed for a similar fate, because all the intersection traffic at Collier and Wolfe is being
pooled there. We're landlocked, with one exit out of our community.
At a minimum, we're requesting that Collier County perform an independent traffic study
of the Wolf Creek PUD. We are also requesting that Growth Management postpone
recommending that the developer's obligation for traffic improvements be revoked. We
understand that this change is general housekeeping of the PUD, as there is no
umbrella developer. However, consideration needs to be made to the homeowners that
have an interest here. Typically, the PUD's are planned and approved prior to breaking
ground on any of the parcels within the PUD, but in this case, it's being done after the
fact. No developer, after the fact, should have a say so in canceling their financial
obligations under the ordinance/deed restrictions after most of the deeded parcels are
conveyed.
In closing, there are multiple owners with interests in the PUD. Raffia Preserve and its
owners make up the largest part of that. Since this isn't a typical change, the owners
within the PUD need to have a say-so in what any changes to the Wolf Creek RPUD will
look like. We need to have reasonable assurance and language to remove any
ambiguity to pay for any future transportation improvements we may be on the hook for
sharing the costs of.

We are writing on behalf of the Raffia Preserve Master Association, Inc., through its
Resident Board of Directors; alongside 363 homeowners. Please accept this as a
formal request for this letter become part of the record.
This notice was mailed only to a fraction of our homeowners requesting an insubstantial
change to the RPUD to eliminate a traffic Condition 5.7.G in the Wolfe Creek RPUD.
The intent of which is to remove the Developers' obligation to fund future traffic
improvements. Lennar provided approval of this change representing Raffia Preserve,
by submitting a signed Affidavit of Authorization.
We have an issue with this, because Lennar acquired Raffia Preserve around May of
2017 representing the largest subdivision in the Wolfe Creek RPUD. The basis for this
change, as we understand, was based on a traffic count survey - created by an
employee at Collier County in the traffic department in 2017. This report concluded
traffic improvements or lights are not warranted.
At that time Raffia had about 150 homes closed, which didn't represent the full capacity
of traffic volume at buildout. It also didn't factor in the future traffic that would be
generated in Vanderbilt Reserve or future commercial development at the corner of
Collier and Wolfe Road, or Vanderbilt Commons — still under construction. Collier
County had the developers sign an Affidavit of Authorization to waive their contribution.
This should have been included for the Raffia Preserve Association since as over 50%
of the deeded parcels had already been conveyed.
When a handful of perimeter owners received this notice in Raffia Preserve, we learned
Collier County initiated the removal of the requirement for the developers' obligation,
within the Wolfe Creek PUD, to fund future traffic improvements. This change was
apparently deemed insubstantial. We believe this to be substantial because this
removal will shift financial liability of future roadway improvements to the homeowners
through the taxing body of Collier County in the form of real estate tax increases.
This change will affect every homeowner. However, because it's deemed insubstantial,
it significantly reduces the notice requirements down to a small fraction of parcels within
our community, instead of all 363 homeowners. The fact is that every owner in the PUD
is affected as we will all share the cost, a substantial change..
The language being proposed will remove the responsibility for all developers in the
