EXECUTIVE SUMMARY
Recommendation to adopt an Ordinance amending Ordinance No. 2006-60, which created
the Haldeman Creek Maintenance Dredging Municipal Service Taxing Unit, to increase the
boundaries of the unit to add 5 parcels and canal section adjacent.
OBJECTIVE: That the Board of County Commissioners adopt an amendment to Ordinance
No. 2006-60, which created the Haldeman Creek Maintenance Dredging Municipal Service
Taxing Unit (the "MSTU"), to increase the boundaries of the unit to add 5 parcels and canal
section adjacent.
CONSIDERATIONS: On March 25, 2008 (Item 16B3 moved to IOK), the Board of County
Commissioners directed staff to amend the MSTU to add five additional parcels. As part of this
Ordinance Amendment, staff is proposing to add an additional canal and contiguous property.
The proposed Ordinance is attached to this Executive Summary and has been advertised in
accordance with Section 125.66 FS. A map ofthe five parcels, the canal and contiguous property
is attached and a legal description is contained in the proposed Ordinance.
Staff estimates that the new area will generate approximately $52.08 in revenues for this MSTU
for all 5 parcels. It is determined that the canal area will not result in revenue increase as the
canal area has a zero dollar taxable value.
FISCAL IMPACT: Based upon figures from the Property Appraisers Office, expansion of the
MSTU as proposed would increase the District's taxable value by $520,771. The June 1st
preliminary 2008 taxable value for the current District as provided by the Property Appraisers
Office totals $129,074,149. The increase in taxable value due to this expansion would not be
realized until the 2009 property assessment cycle (fiscal year 2009-2010).
GROWTH MANAGEMENT IMPACT: Consistent with the Public Facilities Element of the
Growth Management Plan.
LEGAL CONSIDERATIONS: The proposed changes to the Ordinance are legally
sufficient for Board consideration and approval. The increased revenue through the expansion of
this existing MSTU will not affect the revenue limitation of the County. - HFAC
RECOMMENDATION: That the Board of County Commissioners adopt the Ordinance
Amendment.

WHEREAS, the Board of County Commissioners, on December 12, 2006, adopted
Collier County Ordinance No. 2006-60. creating the Haldeman Creek Maintenance Dredging
Municipal Service Taxing Unit (the "MSTU") for the purpose of addressing dredging needs
within the unit; and
WHEREAS, the Board of County Commissioners desires to expand the boundaries of the
MSTU.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE:
AMENDMENTS TO COLLIER COUNTY ORDINANCE NO, 2006-60,
TO EXPAND BOUNDARIES
Exhibit "A" of Section Two of Collier County Ordinance No, 2006-60 is hereby amended
to increase the geographic boundary of the MSTU: See attached amended Exhibit "A" which is
incorporated herein by reference.
SECTION TWO:
INCLUSION IN THE CODE OF LA WS AND ORDINANCES
The provisions of tWs Ordinance shall become and be made a part of the Code of Laws
and Ordinances of CoIlier County, Florida. The sections of this Ordinance may be renumbered
or relettered to accomplish such, and the word "ordinance" may be changed to '''section'',
"article", or any other appropriate word.
SECTION THREE: CONFLICT AND SEVERAB~ITY
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any court of competent jurisdiction holds any
phrase or portion of the Ordinance invalid or unconstitutional, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion,

SECTION FOUR: EFFECTIVE DATE
This Ordinance shall take effect upon filing with the Secretary of State,
