EXECUTIVE SUMMARY
Recommendation to adopt an amendment to Ordinance No. 97-33 "Collier County Cross
Connection Control Ordinance" to address conditions that have changed since its adoption.
OBJECTIVE: That the Board of County Commissioners, Ex-Officio, the Governing Board of
the Collier County Water-Sewer District ("Board"), adopt an amendment to Ordinance No, 97-33
to monitor hazards to the County's Public Water System and to protect the public health, safety
and welfare
CONSIDERATIONS: On July 29, 1997, the Board adopted Ordinance No, 97-33, entitled "The
Collier County Cross-Connection ControllBackflow Prevention Ordinance" to establish a cross-
connection control program as required by:

1,) Florida Administrative Code (F,A,C.) Rule 62-555.360,
2,) F.A.C. Rule 62-610.470,
3,) Operating permits issued by the Florida Department of Environmental Protection to the
Collier County Water-Sewer District and Goodland Water District.
4,) The Board of County Commissioners of Collier County, Florida, finds it to be in the best
interest of the public to have a County operated and maintained cross-connection control
program to monitor hazards to the County's Public Water System and to protect the public
health, safety and welfare by providing for, among other things, the installation,
ownership, repair and testing of back flow prevention assemblies,
No updates to this Ordinance have been completed since its adoption, Staff has undertaken a
review of the Ordinance in light of new regulatory requircments and to address conditions that
have changed since its adoption,

On the April 8, 2008 Collier County Board of County Commissioners Regular Agenda, under
Agenda item 16CI, Public Utilities staff received Board direction to advertise this proposed
amendment to Ordinance No, 97-33,

FISCAL IMPACT: Funds in the amount of $500 for advertisement expenses are available in
the County Water/Sewer Fund (408), Water Administration Cost Center. The source of funding
is user fees,
LEGAL CONSIDERATIONS: The Office of the County Attorney has approved the proposed
Ordinance for form and legal sufficiency - JAB,
GROWTH MANAGEMENT IMPACT: There is no impact to the growth management plan
associated with these changes,
RECOMMENDATION: That the Board of County Commissioners, Ex-Officio, the Governing

WHEREAS, Collier County Ordinance 97-33, known as the Collier County Cross-
Connection ControllBackflow Prevention Ordinance was adopted to establish a cross-connection
control program as required by Florida Administrative Code Rules 62-555360, and 62-610.470;
and
WHEREAS, establishment and maintenance of a cross-connection control program is a
condition and requirement of operating permits issued by the Florida Department of
Environmental Protection to the Collier County Water-Sewer District and Goodland Water
District; and
WHEREAS, the Board of County Commissioners of Collier County, Florida, ("Board")
has previously found it to be in the best interest of the public to have a County operated and
maintained cross-connection control program to monitor hazards to the County's Public Water
System and to protect the public health, safety, and welfare by providing for, among other things,
the installation, ownership, repair and testing of back flow prevention assemblies.
WHEREAS, on April 8, 2008 at a regularly noticed meeting as Item 16 C I the Board
directed Public Utilities staff to develop this Ordinance to, among other things, amend certain
definitions, update references, delete program funding and clarify penalty provisions; and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTy, FLORIDA, that:

Reduced Pressure Zene Princivle Assembly (RPZ), Approved means an assembly
containing two independently acting approved check valves with replaceable seats together with
a hydraulically operating, mechanically independent pressure differential relief valve located
between the check valves and at the same time below the first check valve. The unit shall
include properly located and approved testcocks and tightly closing and approved shut-off valves
at each end of the assembly. Only those reduced pressure principle assemblics ~ approved
by thc Foundation for Cross-Connection Control and Hydraulic Research (FCCC) and !1y thc

3. An approved and appropriate backflow prevention assembly shall be installed
as part of each Service Connection wherever and whenever any of the following
conditions exist beyond the Service Connection:

b. Industrial Fluids or any other objectionable substances are handled in such
a fashion as to create an actual or potential hazard of any kind to the County's
Water System.

impracticable or impossible to ascertain whether or not Cross-Connections
exist.
d. A commercial facility and/or multi-family development exists.
4. The type of backflow prevention assembly required shall depend upon the
degree of hazard that may exist as follows:
a. In cases where there is a surface water auxiliary supply, the County's
Water System shall be protected by an approved Air Gap Separation or an
approved doable BReck valae assembly reduced oressure orinciple backllow
prevention assembly.
b. In cases where there is a ground water Auxiliary Water Supply, the
County's Public Water System shall be protected by an approved reduced
pressure principle backflow prevention assembly.
c. In cases where there are any substances that would be objectionable, but not
hazardous to health, the County's Water System shall be protected by an

d. In cases of a facility, where material is stored or handled so as to create an
actual Or potential hazard of any kind to the County's Public Water System,
the Public Water System shall be protected by an approved air-gap separation

e. In cases of any facility, where because of security requirements or other
prohibitions or restrictions, it is impossible or impractical 10 make a complete

Cross-Connection survey, the County's Public Water System shall be
protected against backflow by either an approved Air Gap Separation or an
approved redueed-pressure principle backflow prevention assembly.
f. In cases of any facility, where the Department determines an undue health
threat is posed because of the presence of extremely toxic substances, the
Department may require an air gap at the Service Connection to protect the
County's Public Water System.
5. Any required backflow prevention assembly and its configuration shall be as
specified by this Ordinance, the Collier County Utility Standards and Procedures
Ordinance, Ordinance No. 9+-1-+ 04-31, any amendments or successors thereto and
the Department's Administrative and Operational Procedures.

C. The Department (privately owned assemblies).
(I) The Department shall review and approve the data submitted by Facility
Owners for the installation, repairs and overhauls of privately owned assemblies
required under this Ordinanee or that were existing as of the effective date of this
Ordinance.
(2) The Department shall have the authority to prohibit a Service Connection or
order the disconnection of service to any connection where:
a. Any kind of hazard exists to the County's Public Water System,
b. The Facility Owner fails to install, operate and maintain an approved and
appropriate backflow prevention assembly in accordance with this Ordinance.
c, The Department may inspect all new backflow assembly installations for
compliance with this Ordinance, the Collier County Utility Standards and
Procedures Ordinance, Ordinance No. 9+-1-+ 2004-31 and any amendments or

scheduled tests, overhauls, repairs, and replacement reports for any backflow

SECTION FIVE: Amendment to SECTION SEVEN, Subsections A and B of Collier
County Ordinance No. 97-33, codified as Sections 134-127 (a) and (b) of the Collier County
Code of Laws and Ordinances follows:
SECTION SEVEN: BACKFLOW PREVENTION SYSTEMS.
A Approved Backflow Prevention Assemblies. An approved backflow prevention
assembly under this Ordinance is one that meets those standards set forth by the American Water
Works Association (AWWA), the American Society of Sanitary Engineers (ASSE) and the
Foundation for Cross-Connection Control and Hydraulic Research (FCCC), and is published as
approved in the FCCC's list of Approved Backflow Prevention Assemblies. For assemblies
owned by the County, the County reserves the right to limit the number of modelEsj of approved
assemblies for purposes of standardization and conformity to system conditions. Approved
assemblies shall have the following features.
(1) Shall be testable in line.

(2) Shall be repairable in line.
(3) Shall have approved shut-off valves located at each end of the backflow prevcnter.
(4) Shall be supplied with ammonia resistant silicone disc~s or other material having
the same ammonia resistant properties and approved by the Department.
(5) Shall have:
a. Rcsilient seated (wedge), full-flow shut-off valves (or resilient seated, full-
flow ball valves} on sizes two (2) inches or smaller that shall be marked with:
1. The manufacturer's name or symbol;
2. Nominal size of valve;
3. Model number;
4. Working pressure.
b. Resilient seated testcocks with:
J. An operating stern, which must indicate if the testcock is open or closed;
2. The operating stem on a ball valve type of testcock must be blow-out
proof;
3. The materials specified as bronze or approved equal.
(6) The assembly (itself) shall contain the following minimum markings:
a. The manufacturer's name or symbol;
b. The type of assembly;
c. A.ssembly size;
d. Assembly model number;
e. Assembly serial number;
f. Rated working water pressure;
g, Direction orfJow.
(7) No backflow prcvention assembly shall be installed under this Ordinance unless
spare parts are represented by the manufacturer to be available for a minimum of
seVen (7) years from date of installation.
B. Hazard Classifications. Unless otherwise specified by this Ordinanee, the
Department shall use the American Watcr Works Association (AWWA) standards and
guidelines in determining all classifications of hazards (whether aetual or potential). Single
family facilities shall be evaluated on a case-by-case basis. To the extent such residential

facilities do not have auxiliary water sources or other types of systems or operations on-site
which would classify the system as hazardous, a backflow prevention assembly shall not be
required, Multifamily facilities with a single Service Connection or individual Service
Connections having lift auxiliary water or other types of systems or operations on-site that would
classify the system as hazardous shall have an RP;?, assembly installed as required by this
Ordinance.
SECTION SIX: Amendment to SECTION EIGHT of Collier County Ordinance No. 97-33,
codified as Sections 134-128 of the CoUier Connty Code of Laws and Ordinances follows:
SECTION EIGHT: BACKFLOW PREVENTION SYSTEM DESIGN.
^- All Facilities.
(I) The design shall be consistent with the standards and specifications found in
the Collier County Utility Standards and Procedures Ordinance, Ordinance No.
9+-+7 2004-31 and any amendments or successors thereto, and the Department's
operational and administrative procedures.
(2) The design shall utilize A WW A standards and guidelines and FCCC
approved backflow prevention assemblies (latest edition) unless otherwise
specified by this Ordinance or the Department's administrative and operational
procedures.
(3) Backflow prevention assemblies shall be designed as part of the County's
Service Connection, unless otherwise approved by the Department.
(4) The Facility Owner shall be responsible for determining if the Facility's
System requires an uninterrupted supply of water that would be adversely affected
by routine maintenance or other activities involving the backflow prevention
assembly. The Facility Owner shall be responsible for installing or requesting a
parallel backflow prcvention assembly. In such instances, two (2) approved
backflow prevention assemblies of the same manufacturer, size and model
numbers shall be installed.
(5) A minimum side distance of one and one-half (1.5) feet from anv and all.
fixed aperture. or landscaoine:. Backflow devices must be left accessible to
County emoloyees at all times. this may pose or Dresent a violation of health,
safetv. and welfare, An entry way of at least three (3) feet in width must be

maintained by property owner. Dangerous and/or dense underbrush will be
trimmed to a "margin of safety" by County employees and a charge determined
by the County will be billed to property owner.
B. Existingfacilities only.
(1) Residential (Single Family). If an actual hazard as defined in this Ordinance
poses a threat to the County Public Water System, an approved backfIow prevention
assembly shall be installed.
(2) Other facilities. These facilities include, but are not limited to commercial,
industrial, and multi-family residential facilities. Where actual or potentia! hazards
are identified, an approved backflow prevention assembly shall bc installed, In some
instances, it may be difficult or impossible to accurately determine such a facility's
Cross-Connection status because plumbing plans of the facility's potable water
system are non-existent, unreliable or unobtainable. In ~ instances where a
Cross-Connection survey is not feasible, an Air Gap Separation or reduced pressure
deviee assembly shall be installed based upon the degree of hazard ,

openings to the outside.

horizontal, unless the assembly has received approval for such installation by the
assembly's manufacturer and the FCCC.
~.Backnow prevention assemblies shall be installed in outside locations as part of
the Department's Service Connection and shall be protected from possible damage
caused by normal traffic.

M.All backflow prevention assembly installations shall be preceded by a wye
strainer (518 3/4" to 2") or top access strainer (2 1/2" to 10") and an appropriate shut-
off valve to facilitate cleaning and inspection of the strainer. All assemblies and
strainers serving fire protection systems shall be approved for such service, In
addition, all assemblies shall be supplied with ammonia resistant silicone discs or a
Department approved equal.
&'7. Installers of backflow prevention assemblies may test and certify the backflow
prevention assembly they have installed. However, all such tests and certification
reports shall be completed only by a technician with the appropriate certification from
the County's approved list.

forms. Survey reports shall include the survey inspector's or engineer's recommended
backflow prevention asscmbly for the degree of hazard creatcd by the facility. Survey
reports for other than single-family residences shall be completed by a certified Cross-
Connection control survey inspector or engineer and shall contain that inspector's name
and ccrtification number on each page or the engineer's seal and number. Any such
reports submitted to the Department without this information shall be deemed
unacceptable and shall not be reviewed. For single-family residences, the survey report
may be filled out by the Facility Owner using the Department's approved self-evaluation
forms.

(4) Department acceptance of Cross-Connection survey report. Upon acceptance and
approval of the Cross-Connection survey report, the Department shall issue a notice of
aceeptance. Once a backflow prevention assembly has been approved by the Department,
no changes or alterations shall be made without the approval of the Department.

SECTION TEN: TECHNICAL IMPLEMENTATION.
In order to provide protection to the County's Public Water System from Contamination
and a high level of customer service and program quality at a reasonable and economical cost to
the customers or consumers of the Collier County Water-Sewer District and Goodland Water
District, all backflow prevention assemblies installed for the purposes of complying with this

identified as necessary at the time of service applieation, be installed by the

installation of the County's Service Connection.
2.. Backflow prevention assemblies for meters greater than 2" size shall be
installed as part or the Service Connection for new construction by a plumbing or
undcrground contractor retained by the Facility Owner. All such backflow
prevention assemblies shall be conveyed to the County for ownership in
accordance with the Collier County Utility Standards and Procedures Ordinance,

Enforcement Board. Special Magistrate, or Nuisance Abatement Bboard. in which event the

(and/or a contractor contracted by the County) was reQuired to correct. abate, cure or otherwise
serve any hazard and/or Contamination; make any repair. replacement and/or other improvement
to any privately owned assembly or part thereof. and/or any connection. physical arrangement or
facilitv (as such term is defined in this Ordinance), then pursuant to anv applicable Florida law,
including Section 153.67. Florida Statutes. and/or Soecial Act Chapter 2003-353, Laws of
Florida. including Section 10 and/or Section 22 therein, shall impose a lien (for such services)
upon anv parcel of property (land) affected thereby. including all costs, expenses, interests
thereon, and, as applicable. reasonable attorney's fces and all other costs of collection as
applicable.
Ig) All other enforcement provisions in Cha1lter 2003-353, Laws of Florida, also applv to
violations of this Ordinance.
SECTION ELEVEN: CONFLICT AND SEVERABILITY.
The provisions of this Ordinance shall be liberally construed to effectively carry out its
purposes in the interest of public health, safety, welfare, and convenience. If any section, phrase,
sentence or portion of this Ordinance is for any reason held invalid or unconstitutional by any

The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinance. of Collier County, Florida. The sections of the Ordinance may be renumbered or re-
lettered to accomplish such, and the word "ordinance may be changed to "section" "article", or any
other appropriate word.
SECTION THIRTEEN: EFFECTIVE DATE,

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY

SECTION ONE: TITLE AND CITA TlON.
This Ordinance shall be known as and cited as "The Collie~ County Cross-Connection
Control I Backnow Prevention Ordinance".

SECTION TWO: FINDINGS.
The Board of County Commissioners hereby makes the following Iindings:
A. That Florida Administrative Code Rule 62-555.360 and 62.610.470 requires all
community waler systems to establish a cross-connection control progrom to detcct and prevent
cross-connections that create or may create an imminent and substantial danger to public health

B. That the Collier County Water.Sewer District and the Goodland Waler Districl
are community waler systems as defined by Florida Administrative Code Rule 62-550.200 (9).
C. That the establishment and maintenance of a cross-connection control program is a
condition and requirement of County's water and wastewater operating permits issued by the
Florida Department of Environmenlal Protection to the Collier County Water-Sewer Districl and
the Goodland Water District.
D. That the health. safety and welfare of persom using and/or relying upon the Public
water system of the Collier County Water-Sewer District and the Goodland Water District is besr
served and protected by the establishment and maintenance of a cross-connection
controlibackflow prevention program. including provisions for installation of back now prevention
assemblies. to prevent the County's Public Waler System from becoming polluted or
contaminated by back now from actual or potential contaminants or pollutants.
E. That it is in the best interest of the users of the Collier County Water-Sewer
District and Goodland Water District and the public generally that ir. in accordance with this
Ordinance, a back now prevention assembly must be installed as part or any watcr service
connection within either the Collier County Water-Sewer District or Goodland Water District.

SECTION THREE:
DEFINITIONS.
For the purposes of this Ordinance, the definitions contained in this Section shall apply
unless otherwise specifically stated. Words used in the present tens~ include the future, words in
the plural number include the singular. and words in the singular include, the plural. The word
"shall" is always mandatory and nol merely discretionary.
Air Gan ScoaratiQ.ll: A physical separation between the free~nowing dischnrge end of a
potable water supply pipeline nod an open or non-pressure receiving vessel. An approved air-gap
separation shall be at least double the diameter of the supply pipe as measured vertically above the
lOp of the rim of the receiving vessel. In no ease, shall the air-gap be less than 'loe inch.
Aonroved List: The list or certified backnow prevention assembly technicians and
cross~coMectian survey technicians who have submitted their certification and in the case of
assembly technicians, the most recent calibration results on their testing equipment, to Ihe
Department for review and approval. AIJ applicants meeting these requirements shalJ be
approved 10 perfonn work on private and County owned backOow assemblies. To remain on the
approved list, appticants must comply with aU the requirements listed within this Ordinance and
the requirements under which they were certified.

Backnow Prevention Assembly. Aooroved: A mechanical assembly lhat meets those
standards as set forth by the American Water Works Association (A WWA), the American Society
of Sanitary Engineers (ASSEl, and the Foundation ror Cross-Connection Control and Hydraulic
Research (FCCC), that has been approved for the prevention of backnow. as back-pressure and
back-siphonage, by the Foundation for Cross.Connection Control and Hydraulic Research, and is
published in the FCCes List of Approved Backflow Prevention Assemblies.
BackOow Prevention Assemblv Test Eouipment. ADProycd: Equipmenl recommended by
the assembly manufacturer and approved by the Department.

County: For purposes afthis Ordinance, the term "County" shall mean Collier Counly,
a political subdivision of the stale and, where the context rcquires or warrants. shall also be
deemed to include the Collier County Waler.Sewer District and the Goodland Water District.
County's Public Water System: For purposes of this Ordinance. the tcrm "County Public
Waler System" shall mean any or all components of either or both the Collier County Waler-
Sewer District and Goodland Water District's watcr systems.

System is connected. directly or indirectly. with any other water supply, sewer, drain. conduit,

Facility: A residence, building, structure, property, business, operation or premises afnny
kind that is connccted or seeks to connect to the County Public Water System.
Facility O\lmer: The owner. and to the extenl the purposes and requirements of lhis
Ordinance warrant, a lessee or sublessee of a residence, building, structure. propcny, business,
operation or premises of any kind that is connected or seeks to connect to the County Public
Water System to receive water through tbe service connection. The term "facility owner" shall
also include any agent or representative of a facility owner acting for or on behalf of the facility
owner.
Facilitv's System: The facility's system shall begin beyond the Counly's service
connection. Thc facility's system may include a potable water system,. an industrial piping system
or both and may be supplied by the County Public waler system or an auxiliary water system or
both.

SECTION FOUR: OPERATION POLICY AND REQUIREMENTS.
A. Operation Policy.
I. No service connection that creates an actual or verified potenti31 ha7.ard to
the County's Public Water System shall be installed or maintained by Ihe County unless
the County's Public Water System is protected as required by this Ordinance. Service of
water to any premises shall be discontinued by the County jf a backnow prevention
assembly requlred by this Ordinance is not installed. tested and mainlained or if it is found
that a backflow prevention assembly has been removed or tampered with. Service shnll
not be restored un[i! such conditions or defects are corrected.

d. In cases of a facility, where material is slored or handled so as 10
create an actual or potential hazard of any kind to the Counly's Public Water Syste~ the
Public waler system shaH be protected by an approved air.gap separation or an approved
n::duced.pressure principle backf10w prevention assembly.
e. In cases of any facility, where because of security requirements or
other prohibitions or restrictions, it is impossible or impractical 10 make a complete
cross.connection survey, the County's Public Water Sysl~m shall be protected llgainst
backf10w by either an approved air-gap separation or an approved reduccd-f'lressurc
principle backnow prevention assembly.
f. In cases of any facility. where the Department determines an undue
health threat is posed because of the presence of c:ttrcmcly toxic substances. the
Department may require an air liap at the service connection 10 prolect the County's

2. The facility owner shall be responsible for monitoring the changes in use of ...,

a. An auxiliary water supply exists that is not maintained or permitted
by the Department of Environmental Protection.
b. Industrial nuids or any other objectionable substances are handled
in such a fashion as to erente an actual or potential ha7..ard of any kind to the County's
Public Water System.
c. Internal plumbing or piping arrangements are not known, making il
impraclicable or impossible 10 ascertain whether or not cross-connections e:tj:r;l.

this Ordinance shall be grounds for removal from the Department's approved list or
termination of any County contracts for the provision of services under this Ordinance.
8. All installed backnow prevention assemblies ex.isting as or the effective
date or this Ordinance thai do not meet Ihe requirements or this Ordinance. bUI that were
approved assemblies for the purposes of this Ordinance a.t the time of installation and that
have been properly maintained, shall be exempt from the construction standards of ~his
Ordinance and the Department's related administrative and operational procedures
provided that any such back now prc...ention assembly will satisfactorily protect the
Count)'s Public Water System. Whenever any such existing assembly is moved from its
present localion or requires replacement. the assembly shall be replaced by an approved
backflow prevention assembly meeting all oflhe requirements or this Ordin:mce.

back now prevention assembly, that water from an un$uitable source or any olher harmful

any part of that liystem is malfunctioning in a manner thai poses a hazard of any kind to
the County's Public Water System.
9. The facility owner shall immediately report to the Department any
malfunction or damage which could aneel the assembly's ability \0 protect the County's
Public Waler System.

owners for the installation, repairs and overhauls of privately owned assemblies required
under this Ordinance or that ',"ere existing as of the errective date of this Ordinance.
2. The Department shall have the authority to prohibil a service connection or
order the disconnection of service 10 any connection where:
(a). Any kind ofhazard exists to the Countys Public Water System:
(b). The facility owner fails to install, operate and maintain an approved
and appropriate backnow prevention assembly in accordance wilh trus Ordinance.
(c). The Department may inspect all nl;w backnow assembly
instaUations fur compliance with this Ordinance. the Coliier County Utility
Standards and Procedures Ordinance, Ordinance No. 97.17, any amendments or
successors thereto, A V/W A Manual M.14 Second Edition and other applicable
Department administrative and operational procedures.
(d). The Department shall accept for review only those
cross~connection survey reports as performed by the filcility owner on the Department's
sclf.evaluation forms or performed by a certified cross-connection control survey
inspector or professional engineer.
(c). The Department shall accept for review only those initial
certilication tests, scheduled lests. overhauls, repairs. and replacement reports for any
backOow prevention assembly performed by a certilied technician from the Department"s
approved list.
(C). The Department shall establish a schedule acceplablc to the Florida
Department of Environmental Protection under which all e;dsting facilities will be brought
into compliance with the terms of this Ordinance.
(g). The Department shall compile and maintain all significant data
resulting from reports submitted under this Ordinance.

standards are utilized in their preparation of any facility's cross-connection survey report
and that the information provided in any such report is reliable and accurate.
2. Certified m..<;pector5 and engine~r5 shall submit any and nil infonna.tion as
requested or directed by the Department.
3. Certified inspectors and engineers shall maintain copies or all
cro5s~connection !iurvey reports, blueprints, drawings, reports, inspectiol15 and any related
correspondence or documentation for a miJ;llmum or ten (J 0) years.
4. Failure 10 provide accurate information in a timely manner as prcscnbed in
this Ordinance shat! be grounds for lennination of any Counly contracts for service
provided in accordance with this Ordinance.
F. Certified I3ad:now Prevention Technicians.
L Certified technicians shall ensure that ClII tests, ,repairs and overhauls
completed on any back now prevention assembly protecting the County's water system
are performed in compliance with manufacturer's recommendations, A WW A guidelincs
and standards. and this Ordinance.
2. Certified technicians shall submit to the Departmenl all information relating
to tests, repairs and overlmuls on any baeknow prevention assembly protecting the
County's Public Water System as requested by the Department.
3. Certified technicians shaU ensure that all information submitted to the
Department is n:liable and accurate.
4. Certified technicians shall maintain copies or all documentation relating in
any way to tests, test results, repairs, overhauls on backnow prevention assemblies
protecting the County Public Water System and any related correspondence or
documentation for a minimum often (10) years.
5. Certified technicians shall only perform those activities for which their
certification is valid and approved as outlined in this Ordinance. Repons submitted by
non-certified or !lon-approved personnel shall not be accepted by the Department.

Society of Sanitary Engineers (ASSE) and the Foundation for Cross.CoMection Control and
Hydrau"e Research (FCCC), and L. published as approved in the FCCC. List of Approved
Backf10w Prevention Assemblies. For assemblies owned by the County. the County reserves the
right 10 limit the number of model(s) of approved assemblies for purposes of standtlJ'di7..ation and
conformity to system condi'.ions. Approved assemblie! shall have the following features.

7. No backJlow prevention assembly shall be installed under this Ordinance
unless spare parts are represented by the manufacturer to be available for a minimum
period of seven (7) years from date orinsta!!ation.

8. Whenever a back now prevention assembly ;s tested, repaired or overhauled
by a ccnjfied backJlow prevention assembly technician, the assembly shall be "resealed"
following such service to identify the technician.
B. Ha7Md Classifications.
Unless olherwise specified by Ihis Ordinance, the DepBltmenl shall use Ihe American
Water Work5 Association (A WW A) standards and guidelines in determining all classifications of
hazards (whether actual or potential). Single family facilities shall be evnlWlted on a case.by-case
basis. To the extent such residential Cacilities do not have auxiliary water sources or other types
of s~tems or operations on~site which would classify the system as hazardous.. a backOow
prevention assembly shaU not be required. Multifamily facilities with a single service connection
or individual service connections having an auxiliary water or other types of systems or operalion:;
on-site that would classify the system M hazardous shall have an RPZ assembly installed ~s
required by this Ordinance.
SECTION EIGIIT: BACKFLOW PREVENTION SYSTEM DESIGN.

l. The design shall be consistent with the standards and specifications found
in the CoUier County Utility ::>Iandards and Procedures Ordinance. Ordinance No. 97.17,
any amendments or successors lhereto, and the Department's operational and
administrative procedures.
2. The design shall utilize A WW A standards and guidelines and FCCC
approved backnow prevention assemblies (latest edition) unless otherwise specilicd by this
Ordinance or the Department's administrative and operational procedures.
3. Back-now prevention assemblies shall be designed a$ part of the Counly's
service connection. unless other wise approved by the Departmcl,t:
4. The facility owner shall be responsible for determining if the facility's
system requires an uninterrupted supply of waler that would be adven;ely alTccted by
routine maintenance or other activities involving the backt10w prevention assembly. The
facility owner shall be responsible for installing or requesting a parallel backOow
prevention assembly. In such instances. two (2) approvcd backnow prevention assemblies
of the same manufacturer, size and model numbers shall he instatled.
B. Existin2 Facilities Only.
J. Residential (Sin~le Family), If an sclual hazard as defined in this
Ordinance poses a threat to the CO'.lnty Public Water System. an approved backnow
prevention assembly shall be installed.
2. Other Facilities. These facilities include. f1ul :1rc nnl limiled to
commercial. industrial. and multi-family residential facilities. %ere actual or potential
hazards are identified, an approved backflow prevention assembly shall be installed. ro
some instances, it may be difficult or impossible \0 accurately determine such a Cacilitys

4. Backflow prevention assemblies shall not be installed in any position other
than horizontal, unless the assembly has received approval for such installation by the
assembly's manufacturer and the FeCe.
5. Backflow prevention assemblies shall be installed in outside IDeations as
part of the Department's service connection and shall be protected from possible damage
caused by normal tramc.
6, AJI backflow prevention assemblies shall be a minimum of twelve (12)
inches above final fInished grade (or pad) to a maximum of thirty (30) inches. as measured
from the lowest point of the assembly; and a minimum side distance ofthteeJ3) feet from
any wall. flXed aperture or landscaping.
7, AU backflow prevention assembly installations shall be preceded by I wyc
strainer (5/8" to 2") or lOp access strainer (2Ya" to 10") and appropriate shut-ofT valve to
facilitate cleaning and inspection of the strainer. A1J assemblies and strainers serving nrc
protection systems shall be approved for such service. In addition, aU assemblies shall be
supplied with ammonia resistant silicone discs or a Department approved equal.
8, Installers of backnow prcvcntion assemb(ies may tcst and certify the
backflow prevention assembly they have installed. However, all such lests and
certification reports shalJ be completed only by a technician with the appropriate
certilicalion from the County's approved list.
SECTION NINE: SERVICE AND REPORTING.

frequently fail regularly scheduled tests. as necessary to protect the public health
and safety.
Overhaul Schedule~.
I. All back now prevention assemblies shall:
(a) Be overhauled as necessary or as recommended by the
manufacturer, unless other wise specilicd by the Department of En...ironmental Protection:
(b) Ovcrhalllcd only by a certified backflow prevention assembly
technician;
(c) Be o...erhauled using acceptable procedures as recommended by the
assembly's manufacturer.
C. .Reoairs and Reolacemenls.
1. Backflow Pre...ention Assemblies.
(a) Backflow prevention assemblies that repealedly fail a required test
shall be reported 10 the Department immediately and before any repairs are undertaken.
Required repairs shall be penonned by a certified technician as outlined by this Ordinance.
(b) Any assembly that is unable to be repaired or o...erhauled (scheduled
or nonscheduled) shall be replaced immediately. At the completion of the repairs or
replacement. the assembly shall be tested by a certified lechnician as outlined by this
Ordinance.
2. Until such repairs or replacements arc completed. the service conneclion
shall be deacti...ated. if deemed necessary by the Department. 10 protect the public health.
safety and welfare.
D. Testim! Eauiomenr and Methods.
I. Test Eauioment.
Certified backflow prevention assembly lechnicians shall test such
assemblies using that equipment as recommended by the a.ssembly's manufacturer and
approved by the Department.
2. Test Methods.
Only AWWA and FCCC melhods shall be used when tesling backflow
pre...enlion assemblies.
3. Certified backfiow prevention assembly technicians shaH have their testing
instruments certified at least once every year for accuracy. or as onen as the equipment

manufacturer recommenw. whichever is more frequent. The technician shall forward a
copy of the instrument's caubration report to the Department. The Department shall not
accepted testing reports prepared by technicians if such annual calibration reports are not
received by the Deparcment. Calibration reports shaJJ only be accepted from sources
approved by the Dcpanmenl. The Department shall develop procedures to approve testing
sources besed on manufacturing and industry standards.
E. Rcrortinl!.
Facility owners are directly responsible for aU reports and reporting procedures
regarding privately owned backflow assemblies protecting the County's water system.
The facility O'WTlCT may designate an agent to act on his behaIf, but in no way docs such
action alleviate the facility owner's responsibility.
I. Reoortimr: Scheduled Tests And Overhauls (Privatelv Owned ASS.m.b.1im
Reports for initial certification tests, regular BMual tests and o\'erhauls or a facility's
privately owned back now assembly must be completed by a certilied technician as
required by this Ordinance. Such reports 5hall be rorwardcd to the Department by the
facility owner on the Departmenr's approved forms. It shall be the responsibility of the
facility owner to mail or dcliv.'" the completed reports to the Department as outlined in
this Ordinance and the Department's administrative and operational procedures.
2. ReOOrling or Nonscheduled Reoairs or Renlacemenls (Privatelv Owned
Assemblies).
Any backflow prevention assembly which has been damaged. is discharging
abnormally or fails any lest, shall be reported immediately by the facility owner as rollows:
Step I: Notify the Department. If the Department's oQices are closed. notify
the after-hours on. call personnel.
Step 2: Contact a certified back now prevention assembly technician from the
Department's approved list for immediate repairs.
3. Any time a replacement is required for a privatcJy owned assembly, such new
assembly shall comply with all sections oftrus Ordinance.
F. Cross~Connection Survev Reoorts.
I. New Facilities.
The owner or a new facility shall submit a cross.connection survey report
for the facility [0 the Department prior to occupancy and service conneclion activation.
The report shall be submitted for the facility using the Department's approved fonns.
Survey reports shall include the survey inspector's or engineer's recommended backflaw
prevention assembly for the degree of hazard created by the facility. Survey reports for
other than single family residences shall be completed by a ccrtilicd cross-connection
control survey inspector or engineer and shall contain root inspector's name and
certification number (.on each page or the engineer's seal and number. Any such reports
submitted to the Department without this information shaH be deemed unacceptable and

shall not be reviewed. For single family residences, the survey report may be filled oul by
the facility owner using the Department's approved self-evaluation forms.
2. Ex..istin~ Facilities.
The Department shall send notification 10 the owner! of ex.isting facilities
where cross-connection! are suspected. Facility owners shall. upon notification and within
90 days submit a cross-connection survey report for the facility to the Department. The
CToss--connection survey report shaJI have been compleled by a certified cross-connection
control survey inspector From the Department's approved list or an engineer and shaU
contain the inspector's name and certirication number or engineer's seal on each page. Any
survey report submitted to the Department for review without this inform3lion shall be
deemed unacceptable and shall not be reviewed. For single family residences. the survey
report may be lilled out by toe owner using Ihe Department's approved self-evaluation
form'i.
3. ~imcd Wat~r Connections
All properties served by reclaimed waler shall be surveyed at intervals.
acceptable to the Department of Environmental Protection. but no less then every three years as
to changes, additions or deletions in the customer plumbing system. All property surveys [ound
to have the potential to create a cross-coMection shaU undergo further revicw up to and including
sile visits by thc County to investigate potential hD.znrds.
4. Survey Reoort Review and ADOToval
Aficr the Department has received and reviewed the cross-connection
survey report for 8 proposed facility or use, the Department may take the following
action:
(a) The Department may accept the cross~connectjon survey report as
written.
(b) The Department may reject the cross-connection SUL'>'ey report as
written.
(c) The Dcpanment may request additional information before
accepting or rejecting the report.
(d) The Department may require a meeting with the facility owner's
designated agent, certified cross-connection conlrol survey inspector, engineer or all such
enlities or individuals involved before aCling upon the Report as submilted.
4. Deoartment Acceptance of Cross. Connection Survey Reoor1.
Upon acceptance and approval of the cross-connection survey report. lhe
Department shall issue a notice of acceptance. Once a back flow prevention assembly has
been approved by the Department. no changes or alterations shall be made without the
approval of the Department.
5. Final AoorovaJ of Backflow Prevention Assemblies (Privalelv Owned).
Afier II facility's backflow prevention assembly has been initially tested,
certified and approved. the facility owner shall notify the Department that the new facility
is ready fOi f;.n.al lr.spection. The Department or its agent shall make ii. site inspection of

(he new facility. Until the facility's back now prevention assembly pa.sscs this linal
inspection, the service connection shall not be activated.
6. Testin~ and Ovcrhaul Schedule (Privatelv Owned Assembliesl
Within 'hirty (30) days an", fll1lll approval has been issued for a new
facility's back now prevention assembly, the Department shall send a Jeller 10 the owner
outlining lhc testing and overhaul schedule. This letter shall rise each component of the
facility's cross-connection contro! system and how frequently each mechanism including
the backflow prevention assembly shall be tested and overhauled (where applicable) and
testing results 8IId completion of overhauls shaU be reponed to the Depanmcnt
SECTION TEN: TECHNICAL IMPLEMENTATION.
In order to provide protection to the Countfs Public Water System from contamination
l1Ild a high level of customer service and program quality at a reasonable and economical cost to
the cuslomers or consumers of the Collier County Waler-Sewer Dislrict and Goodland Water
District, all backnow prevention assembties installed for the purposes of complying with this
Ordinance shall be owned by the County. All facility owners that also own exisling backflow
prevention assemblies, lhat are subject to this Ordinance. may dedicate and convey those
assemblies to the County for owners";? and maintenance within 120 days from adoption of this
Ordinance. Any assemblies not dedicated and conveyed 10 the County within lhal 120 day period
shall remain in private ownership unless approved by the County. In cases where ownership of a
backOow prevention assembly remains with the faciUty O'WTler. the facililY owner shall be
responsible for complying with all maintenance and other requirements of this Ordinance. The
lechnical and administrative requirements of this Ordinance shall be implemented as folJows.
A. Prol.!rarn Administration
II shall be the responsibility of rhe Department to administer, coordinale, monitor
and trock the lechnical implementation and ongoing requirements of this Ordinance for
compliance.
B. New Installations.
I. Backflow prevention assemblies for 5/8" lhrough 2" meters shall, if
identified as necessary at (he time of service application. be installed by the Department or the
County's contract agent as part of and at the time of the installation of the County's service
connection.
2. Backf10w prevention assemblies for meters greater than 2" size shall be
in.stalJed as part of the service connection for new construction by a plumbing or underground
contractor retained by the facility owner. All such backJlow prevenlion assemblies shall be
conveyed (0 the County for ownership in accordance with the Collier County Utility Standards
and Procedures Ordinance, Ordinance No. 97-17. any amendments or successors Iherelo. and the
Department's administrative and operational procedures.

C. Retrofits.
1. BackOow prevention assemblies where the meter is between 5/8" through
2" shall be owned by the Counly and installed by the DepW1menl or the County's contract agent
as a part of the Department's meter change out program or when the degree of hazard so
warrants, the Department's maintenance staffor County's contract agent.
2. Backfiow prevention assemblies where the meter is greater than 2" shall be owned
by the County and installed by the Department or the County's contract !l:genl.

The Department or the COlUny's contract agent shaU perfonn al! annual
and miscellaneous testing on all County owned backflow assemblies. This
subsection of this Ordinance does not apply 10 the as.coembly's initial certification
when installed by a private sector contractor for a facility owner.
2. Privatelv Owned Assemblies.
All testing of privalely owned assemblies shall. be perfomed by an
independent certified back now assembly technician as outlined within this
Ordinance and meeting all legal, regulatory and code requirements for the service
classification.
SECTION ELEVEN:
A. New InstalJations.
Within 120 d.1ys from the adoption of this Ordinancc, the County shall adopt by
ordinance a fee, charge or ratc to cover the County's anticipated cost to provide for Department
services under this Ordinance. New customers of the Collier County Water-Sewer District and
Goodland Water District, i.e., facility owners, shall be responsible for pa}ment of this fee. charge
or rate, if applicable. at the time and in conjunction with the payment of applic<1ble impact and
meter tapping fees or within 30 days after service is rendered.
B. Retrofit!: (Existinll\.
All active service connections that have existing hazards as of 120 days from the
adoption of this Ordinance shall be considered existing retrolits for rurposes of program funding
under this Ordinance. The County's retrofit program for existing service connections shaU be
funded through existing and future water user fees.

SECTION TWELVE: TERMtNATION OF SERVICE.
A. Any facility with Il privately owned backflow prevention assembly receiving waler
service from the County's Public Water system that fails to perform. the required testing or make
required repairs to the backflow assemblies ItS directed by this Ordinance. the Department or 8
certified backllow assembly technician. shall be subject to termination of service. Such
termination mny continue untiJ aU violations of this Ordinance are corrected.
B. Arty facility with 8 County owned and maintained backnoY' prevention assembly
shall not be subject to this provision as the Department shall be responsible for the tC5ting and
maintenance of the assembly.

SECTION THIRTEEN:
PENALTIES.
Any person who violates any provision of this Ordinance, or amendmenu thereto, shaJl
be subject to the penalties provided in Section 125.69. Florida Statutes. In addition., the COW1ty
may bring suit for damages for nny violation of this Ordinance and amendment! thereto, and to
restrain, enjoin or otherwise prevent a violation of or mandate compliance with this Ordinance
and amendments thereto.

SECTION FOURTEEN: COLLECTION OF FEES, CHARGES OR RATES.
The County or its egenl shall be responsible for collecting any fees, charges or rates
established by the Board of County COrn.rrUssioners connected with the establishment and
ongoing maintenance of the cross-connection control program authorized by this Ordinance.
SECTION FIFTEEN:
CONFLICT AND SEVERABILI1Y.
The provisions of this Ordinance shall be liberalJy construed to effectively carry out il3
purposes in the interest of public heaJth, safety, welfare, and convenience. J( any section,
phrllSC, sentence or portion of this Ordinance is for any reason held invalid or unconstitutional by
any court of competent jurisdiction, such portion shall be deemed a separate. dislinct, and
independent provision, and such hol~lng shall nol affect the validjty oflhe remairung portions of
this Ordinance.
SECTION SIXTEEN:
ORDINANCES.
INCLUSION IN THE CODE OF LAWS AND
The provisions of this Ordinance shall become and be made a part of the Code of La'NS
and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or
re-Iettered to accomplish such, and the word "ordinance" may be changed to "section", "article",
or any other appropriate word,
SECTION SEVENTEEN: EFFECTIVE DATE.
This Ordinance shaH become effective upon filing with the Department of Stale and
adoption of an ordinance si:tting forth the rate. fee or charge for Department services in
cOMection wilh new installations and the filing oflliat ordinance with the Departmenf of State.

EXECUTIVE SUMMARY
Recommendation that staff be directed to advertise an amendment to Ordinance 97-33
"Collier County Cross Connection Control Ordinance".
OBJECTIVE: The objective is to obtain approval from the Board of County Commissioners,
Ex-Officio, the Governing Board of the Collier County Water-Sewer District to provide direction
for staff to advertise an amendment to Ordinance 97-33.
CONSIDERATIONS: On July 29, 1997, the Board of County Commissioners adopted
Ordinance No. 97-33, entitled "The Collier County Cross-Connection ControllBackflow
Prevention Ordinance" to establish a cross-connection control program as required by:
I.) Florida Administrative Code (F.A.c.) Rule 62-555.360.
2.) F.A.C. Rule 62-610.470.
3.) Operating permits issued by the Florida Department of Environmental Protection to the
Collier County Water-Sewer District and Goodland Water District.
4.) The Board of County Commissioners of Collier County, Florida, finds it to be in the best
interest of the public to have a County operated and maintained cross-connection control
program to monitor hazards to the County's Public Water System and to protect the public
health, safety and welfare by providing for, among other things, the installation,
ownership, repair and testing of backflow prevention assemblies.
No updates to this Ordinance have been completed since its adoption. Staff has undertaken a
review of the Ordinance in light of new regulatory requirements and to address conditions that
have changed since its adoption.
The following sections of the Ordinance are proposed to be amended:

. Updating operation policy and requirements
. Updating program responsibilities
. Updating backflow prevention systems
. Updating backflow system design
. Updating service and reporting
. Updating technical implementation
. Deleting program funding
. Clarifying penalties
FISCAL IMPACT: Funds in the amount of $250 are available in the County Water/Sewer
Fund (408), Water Distribution Cost Center. The source of funding is user fees.
GROWTH MANAGEMENT IMPACT: There is no impact to the growth management plan
associated with these changes.
