EXECUTIVE SUMMARY
CUE-2008-AR-13066, Dieudonne Brutus, of the Tabernacle of Bethlehem, represented by
David Sneed, Kuhlman Engineering, Inc" is requesting a one-year extension of a
Conditional Use approval for a church granted in Resolution No, 05-134 in the Village
Residential (VR) Zoning District, pursuant to Subsection 10.08.E.3 of the Land
Development Code. The 0.69 acre subject property is located at 305 3rd Street South
(Immokalee), in Section 4, Township 47 South, Range 29 East, Collier County, Florida.
OBJECTIVE:
To have the Board of Zoning Appeals (BZA) approve a Conditional Use Extension (CUE) for a
Conditional Use to allow a church in the Village Residential (VR) Zoning District.
CONSIDERATIONS:
The Tabernacle of Bethlehem Conditional Use was originally approved by the Board of County
Commissioners acting as the BZA on March 23. 2005; by Resolution No, 05-134 (see Exhibit A
to the attached Resolution), The approval permitted the petitioner to use the existing structure for
a house of worship, Expansion or enlargement of the existing structure was prohibited, In
conjunction with this Conditional Use, the petitioner also received approval of variances from
the I-acre minimum lot area requirement to allow the existing O,69-acre site to be used for a
church, and a reduction of the 35-foot required front yard setback to allow a 20-foot setback, a
reduction in the nunlber of parking spaces by 14 spaces from the required 33 parking spaces to
19 spaces, and a reduction in the landscape buffer by 5 feet on the north and south property lines
from a 15-foot wide type "B" to allow a 10-foot wide type "B" buffer in Resolution No, 05-135,
Those variances are still in full force and effect and do not require additional action to extend
them,
Per Section IO,08,E,1. of the Collier County Land Development Code (LDC), Conditional Uses
automatically expire three years from their date of approval if activity on the project has not
commenced, The petitioner has not stated a reason why the use has not yet commenced, In any
case, Section 10,08,E,3, of the LDC pennits the BZA to grant a maximum one year extension of
a Conditional Use upon written request of the petitioner; no reason is required to be provided,

The original Conditional Use was approved by the BZA in conjunction with favorable findings
made based on the following criteria, pursuant to LDC Section IO,08,02,D:
· Granting of the Conditional Use would not adversely affect the public interest;
· The specific requirements governing the individual Conditional Use, if any, will be met
by the petitioner or variances have been granted to address the requirement;
· The proposed change was deemed consistent with the Growth Management Plan (GMP)
and the LDC;
· Ingress and egress to the property, with particular reference to automotive and pedestrian
safety, convenience, traffic flow, and access in case of fire or catastrophe was addressed;
· The potential effects of noise, glare, economic or odor effects were mitigated; and

. The proposed land use was compatible with the existing land use pattern,
As the area surrounding the subject site has remained unchanged since the original approval, the
subject Conditional Use remains consistent with the GMP and the LDC, Furthermore, all issues
relative to access, impacts and compatibility that were addressed at the time of the original
approval and made subject to various stipulations that will be carried fOlward with approval of
this CUE,
FISCAL IMPACT:
The Conditional Use Extension approval by and of itself will have no fiscal impact on Collier
County, There is no guarantee that the project, at build out, will maximize its authorized level of
development, however, if the Conditional Use Extension is approved, and the church use is
established in the existing vacant building. the new use could have an impact on Collier County
public facilities,
The County collects all applicable impact fees before the issuance of building permits to help
offset the impacts of each new development on public facilities, These impact fees are used to
fund identified projects in the Growth Management Plan Capital Improvement Element as
needed to maintain adopted Levels of Service (LOS) for public facilities, Additionally, in order
to meet the requirements of Section 1O,02,07(C) of the Land Development Code, fifty percent
(50%) of the estimated Transportation Impact Fees associated with the project are required to be
paid simultaneously with the approval of each final local development order. Other fees collected
before the issuance of a building permit include building permit review fees and the remainder of
all applicable impact fees, Finally, additional revenue is generated by application of ad valorem
tax rates, and that revenue is directly related to the value of the improvements, Please note that
impact fees and taxes collected were not included in the criteria uscd by Staff and the Planning
Commission to analyze this petition,
GROWTH MANAGEMENT PLAN (GMP) IMPACT:
The subject property is designated Urban Residential. High Residential District, on the
Immokalee Area Master Plan Future Land Use Map of the Growth Management Plan, Relevant
to this petition, this Subdistrict permits non-residcntial uses such as community facilities, which
includes churches, Therefore. staff concludes the proposed use for the subject site can be
deemed consistent with the Future Land Use Element.
TRANSPORTATION IMPACT:
No outstanding transportation issues are associated with this petition, The applicant would be
required to comply with all applicable developmental regulations when development approvals
are sought. The Traffic Impact Statement associated with the original Conditional Use
application did not reveal any potential transportation issues, To alleviate concerns about
parking congestion, the original Conditional Use approval contained several conditions to either
limit the scope of the use or reiterate that all parking must be contained on site; parking within
the right of way would not be allowed,

REQUESTING CONDITIONAL USE APPROVAL IN THE
VILLAGE RESIDENTIAL (VR) ZONING DISTRICT FOR A
CHURCH OR HOUSE OF WORSHIP PURSUANT TO
SECTION 2.04.03, TABLE 2 OF THE COLLIER COUNTY
LAND DEVELOPMENT CODE FOR PROPERTY
LOCATED IN SECTION 4, TOWNSHIP 47 SOUTH,
RANGE 29 EAST, COLLIER COUNTY, FLORIDA,
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes,
has conferred on all counties in Florida the power to establish, coordinate and enforce zoning
and such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance Number 2004.41, as amended) which establishes regulations for the zoning of
particular geographic divisions of the County, among which is the granting of conditional
uses; and
WHEREAS, the Board of Zoning Appeals, being tbe duly elected constituted Board of
the area hereby affected, has held a public hearing after notice as in said regulations made and
provided, and has considered the advisability of Conditional Use approval under Subsection
2.03.04.Table 2, in the Village Residential Zoning District for a church or house of worship on
the property hereinafter described, and has found as a matter of fact, Exhibit "A", that
satisfactory provision and arrangement have been made concerning all applicable matters
required by said regulations and in accordance with Subsection 10.08.00; and
WHEREAS, all interested parties have been given opportunity to be heard by this
Board in a public meeting assembled, and the Board having considered all matters presented;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA that:
The petition, CU.2003-AR-4326, filed by Ronald F, Nino, AICP of Vanasse Daylor,
representing Dieudonne and Lunic Brutus, with respect to the property hereinafter described
in Exhibit "B" attached hereto and incorporated by reference herein, be and the same hereby is
approved for a Conditional Use pursuant to Subsection 2.04.03, Table 2 in the Village
Residential (VR) Zoning District to allow for a church or house of worship in accordance with
the attached Conceptual Site Plan, Exhibit "e", and subject to the conditions found in Exhibit
"0" which is attached hereto and incorporated by reference herein.

1. The variances granted are limited to the use of the existing structure for a house of
worship, as depicted and more particularly described in the applicant's site plan entitled.
"Tabernacle of Bethlehem Conceptual Site Plan." prepared by Vanasse Daylor, last
revised December 7, 2004,
2, The yard variance being granted is limited to allowing the encroachments of the existing
building solely for use as a church, Any other conditional use is subject to re-review of
the variance issues,
3, Parking within 3rd Street South right-of-way IS prohibited, All parking must be
contained on-site,
4, No variances have been granted to reduce any buffer requirements except for width or to
provide relief from the requirement to provide a wall along any project boundary,
Buffering materials for the church use must be provided in compliance with the LDC
requirements unless separate administrative variance relief is sought and approved in
compliance with the LDC.

Attached is the original Trip Generation Opinion for the subject project, As directed in the
rejection letter dated April 7, 2008, 5-year growth projections were estimated on the nearby
arterial links identified in the AUlR, Table 1 shows the information derived from the 2007
AUIR for the two arterial links nearest the project. Table 2 shows the derivation of the 5-year
projections based on Collier County AADT volumes for the links being studied,

the arterial network, Since the site is estimated to generate slightly over I trip end in each
direction, a single vehicle value was used to estimate was conducted for the subject project. The

Street South in lmmokalee, Collier County, Florida, This trip generation will determine the
amount of trips generated by the church,
TRIP GENERATION
The proposed project traffic generation was determined using rates from the Institute of
Transportation Eneineers' TriD Generation Manual (Sixth Edition), The trip generation
equations are shown below,

A RESOLUTION OF THE COLLIER COUNTY BOARD OF ZONING
APPEALS RELATING TO PETmON NUMBER CUE-2008-AR-13066,
TO PROVIDE FOR A ONE-YEAR EXTENSION OF A CONDITIONAL
USE IN THE VILLAGE RESIDENTIAL (VR) ZONING DISTRICT
FOR A CHURCH. PURSUANT TO SUBSECTION IO,08,E,3 OF THE
COLLIER COUNTY LAND DEVELOPMENT CODE (WC), FOR
PROPERTY LOCATED IN SECTION 4, TOWNSHIP 47 SOUTH,
RANGE 29 EAST, COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida
Statutes, has conferred on all counties in Florida the power to establish, coordinate and
enforce zoning and such business regulations as are necessary for the protection of the
public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 2004-41, as amended) which establishes comprehensive zoning
regulations for the zoning of particular divisions of the County, among which is the
granting and extending the time period of Conditional Uses; and
WHEREAS. on March 23, 2005, the Board of Zoning Appeals enacted Resolution
No. 05-134, attached hereto and incorporated by reference herein, as Exhibit l'A,"
which granted a conditional use for a church on property described in Exhibit B of
Resolution No. 05-134; and
WHEREAS, Subsection IO,08,E,3 of the Land Development Code provides that
the Board of Zoning Appeals may grant a one~year extension for a conditional use
which has not been commenced.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING
APPEALS OF COLLIER COUNTY, FLORIDA, that:
Good cause being shown. the petition, filed by David Sneed of Kuhlman
Engineering, Inc., representing DieudOIme Brutus, of the Tabernacle of Bethlehem
Church, requesting a one-year extension of the Conditional Use: approval granted in
Resolution No. 05-134, is hereby approved. and the expiration date for Resolution No.
05-134. attached hereto as Exhibit "A," and all conditions applicable thereto. is hereby
extended for one additional year until March 23, 2009.
BE IT FURTIlER RESOLVED that this Resolution be recorded in the minutes of

required by said regulations and in accordance with Subsection 10.08.00; and
WHEREAS. all interested parties have been given opportunity to be heard by this
Board in a public meeting assembled, and the Board having considered all matters presented;
NOW, TIlEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA that:
The petition, CU-2003-AR-4326, filed by Ronald F, Nino, AICP of Vanasse Daylor,
representing Dieudonne and Lunie Brutus, with respect to the property hereinafter described
in Exhibit "B" attached hereto Bnd incorporated by reference herein, be and the same hereby is
approved for a Conditional Use pursuant to Subsection 2.04.03, Table 2 in the Village

1. The Conditional Use is limited to what is shown on the conceptual site plan,
identified as "Tabernacle of Bethlehem Conceptual Site Plan," prepared by
Vanasse Daylor, last revised December 7, 2004, The site plan noted is conceptual
in nature for conditional use approval. The final design must be in compliance
with all applicable federal. state, and county laws and regulations,
2, The Conditional Use is limited to the use of the existing building for a house of
worship, No expansion or enlargement of the existing building is permitted,
3, Parking within 3'" Street right-of-way is prohibited, All parking must be
contained on-site,
4, The Conditional Use approval is subject to compliance with any conditions or
stipulations placed upon the companion request petition, V A-2003-AR-4327,
5, The petitioner must seek development approval, i.e" SOP or SIP, for this
conditional use, The SDP/SIP plans must reflect all improvements depicted on
the site plan and the conditions noted above, A final local developer order (SDP
or SIP and building permits) must be issued before the building's use as a
church/house of worship,
