EXECUTIVE SUMMARY
SV-2008-AR-12943, Glen Weldon of Glen Weldon & Associates, LLC, representing
Woolbright Development, Inc., requesting six variances. The first three variances are from
the Land Development Code (LDC) Section 5.06.04 c.!. which requires a minimum
separation of 1,000 lineal feet between signs to allow a sign separation of 70:!o feet, 705:!o
feet and 775:!o feet. The fourth variance is from LDC Section 5.06.04 C.!. which permits a
maximum of two pole signs per street frontage to permit a maximum of three signs along a
street frontage. The fifth variance is from LDC Section 5.06.04 C.16.b.i. which allows a
maximum sign area of 12 square feet for an off-premise directional sign to allow a 76:!o
square foot off-premise sign. The sixth variance is from LDC Section 5,06.04 C.16.b.ii.
which allows a maximum sign height of 8 feet for an off-premise directional sign to allow a
maximum sign height of 9-foot 4-inches. The subject property (Collection at Vanderbilt) is
located at the northwest corner of the intersection of Airport Road (CR 31) and Vanderbilt
Beach Road (CR 862), in Section 35, Township 48 South, Range 25 East, Collier County,
Florida.
OBJECTIVE:
-
To have the Board of Zoning Appeals (BZA) consider the above-referenced Sign Variance
petition and render a decision pursuant to Section 5.06.00 ofthe Land Development Code (LDC)
in order to ensure that the project is in harmony with all applicable codes and regulations and
that the community's interests are maintained.
CONSIDERATIONS:
The sign variances are for five (5) proposed wall monument signs for "The Collection at
Vanderbilt," a commercial shopping center. The applicant's request is to install residential style,
ground monument style signs with the name of the shopping center. It is important to note that
while these signs appear to be wall monument signs, the LDC considers signs such as this to be
by definition, pole signs. The LDC defmition for a pole sign is: "a sign, eight (8) or more feet in
height which is independent of support from any building, that is mounted on freestanding poles
or other supports, and shall include a pole cover that is between fifty (50) percent and one
hundred (100) percent of the overall sign width."

The petitioner is requesting six (6) variances from LDC Section 5.06.00 for the installation of
five (5) identical wall monument style signs at a commercial shopping center called the
"Collection at Vanderbilt." Four (4) of the signs will mark the street entrances to the shopping
center from Vanderbilt Beach Road and Airport-Pulling Road as shown in the Overall Site Plan
(Exhibit A) on the previous page. One of these street entrance signs, the Vanderbilt Beach Road
entrance sign, is located on an outparcel, and is therefore considered an otf-premise sign and is
subject to the reduced size standards of an off-premise sign. The fifth sign is located at the
southwest comer of the intersection of Airport-Pulling Road and Galleria Drive. Signs A-2 and
B-2 have sign permits. Sign A-2 has a sign permit and has been constructed.

The requested variances for each sign are as shown on the attached site plan (Exhibit A) and as
follows:
1. Sign A-I, for a proposed variance from LDC Section 5.06.04 C.16.b.ii. which requires each
off-premises sign to be no more than eight (8) feet in height to allow a sign that is 9'- 4" in
height.
2. Sign A-I, for a proposed variance from LDC Section 5.06.04 C.16.b.i. which requires an
off-premises sign to be no more than twelve (12) square feet in area to allow a sign that is 76'"'-
square feet in area.
3. Sign B-1 and B-2, for a proposed variance from LDC Section 5.06.04 c.!. which requires a
minimum separation of 1,000 linear feet to allow a separation of 70'"'- feet between sign B-1 and
B-2.
4. Sign C-I and B-1, for a proposed variance from LDC Section 5.06.04 C.!. which requires a
minimum separation of 1,000 linear feet to allow a separation of 705'"'- feet between sign C-I and
sign B-1 as shown on the Overall Site Plan.
5. Sign C-I and B-2, for a proposed variance from LDC Section 5.06.04 c.!. which requires a
minimum separation of 1,000 linear feet to allow a separation of 775'"'- feet between sign C-I and
B-2 as shown on the Overall Site Plan.
6. Signs B-1, B-2 and C-l, for a proposed variance from LDC Section 5.06.04 c.!. which
allows a maximum of two ground signs per street frontage to allow the three signs along Airport-
Pulling Road street frontage as shown on the Overall Site Plan.
The sign variances are for five (5) proposed wall monument (as depicted in Exhibit "A") signs
for "The Collection at Vanderbilt," a commercial shopping center that has recently opened this
past year. The commercial shopping center is part of the Pelican Marsh DRI and is located in
Activity Center # ] I. The applicant's request is to install residential style, ground monument
style signs (see Exhibit "B") with the nan1e of the shopping center.
FISCAL IMPACT:
Approval of this Sign Variance petition would have no fiscal impact on Collier County.
GROWTH MANAGEMENT PLAN (GMPl IMPACT:
Approval of this Sign Variance would not affect or change the requirements of the Growth
Management Plan.
AFFORDABLE HOUSING IMPACT:
Approval of this Sign Variance would have no affordable housing impact.

ENVIRONMENTAL ISSUES:
There are no environmental issues associated with this Sign Variance.
ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION:
The EAC did not review this petition as they do not normally hear Sign Variance petitions.
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION:
The CCPC heard petition SV-2008-AR-12943 on May 15, 2008, and by a vote of 8-0
recommended to forward this petition to the Board of Zoning Appeals (BZA) with a
recommendation of approval and is in agreement with staff conditions listed below.
Because the CCPC approval recommendation was unanimous and no letters of objection have
been received, this petition has been placed on the Summary Agenda.
LEGAL CONSIDERATIONS:
The Petitioner is requesting six sign variances. The granting of such variances is permitted
under LDC S9.04.02.
The attached staff report and recommendations of the Planning Commission are advisory only
and are not binding on you. Decisions regarding variances are quasi-judicial, and all testimony
given must be under oath. The Petitioner has the burden to prove that the proposed variance is
consistent with all the criteria set forth below, and you may question Petitioner, or staff, to
satisfy yourself that the necessary critelia have been satisfied. LDC Section 9.04.02.A requires
that "based upon the evidence given in public hcaring; and the tindings of the planning
commission" you "should determine to the maximum extent possible if the granting of the
variance will diminish or otherwise have a detrimental effect on the public interest, safety or
welfare." Should you consider denying the variance, to assure that that your decision is not later
found to be arbitrary, discriminatory or unreasonable, the denial must be based upon competent,
substantial evidence that the proposal does not meet one or more of the listed criteria below.
Approval of this request requires three aftirmative votes of the Board.
In granting a sign variance, the Board of Zoning Appeals may prescribe the following:
]. Appropriate conditions and safeguards in conformity with this Code or other applicable
county ordinances. Violation of such conditions and safeguards, when made a part of the terms
under which the variance is granted, shall be deemed a violation of this Code.
2. A reasonable time limit within which the action for which the variance required shall be
begun or completed or both. (MMSS for JW)

Criteria for Sil!n Variances
I. There are special conditions and circumstances existing which are peculiar to the location,
size, and characteristics ofthe land, structure, or building involved.
2. There are special conditions and circumstances which do not result from the action of the
applicant, such as pre-existing conditions relative to the property which is the subject of the
variance request.
3. A literal interpretation of the provisions of the LDC work unnecessary and undue hardship on
the applicant or create practical difficulties on the applicant.
4. The variance, if granted, wi]] be the minimum variance that wi]] make possible the
reasonable use of the land, building, or structure and which promote standards of health, safety,
or welfare.
5. Granting the variance requested will not confer on the petitioner any special privilege that is
denied by these zoning regulations to other lands, buildings, or structures in the same zoning
district.
6. Granting the variance wi]] be in harmony with the intent and purpose of the LDC, and not be
injurious to the neighborhood, or otherwise detrimental to the public welfare.
7. There are natural conditions or physica]]y induced conditions that ameliorate the goals and
objectives of the regulation, such as natural preserves, lakes, golf course, etc.
RECOMMENDATION:
Staff recommends that the Board of Zoning Appeals (BZA) approve petition SV-2008-AR-
12943 subject to the fo]]owing conditions:
1. The sign copy for Signs A-I, A-2, B-1, B-2 and C-l as shown on Exhibits A and B sha]] be
limited to 76ctc square feet.
2. Signs A-I, A-2, B-1, B-2 and C-I as shown on Exhibits A and B sha]] be limited to the name
of the shopping center and sha]] not contain the names of individual tenants.

PURPOSEIDESCRIPTION OF PROJECT:

GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY:
The subject property is located in the Urban Designation, Mixed Use Activity Center Subdistrict
of the Future Land Use Map of the Growth Management Plan (GMP). The GMP does not
address individual Variance requests but focuses on the larger issue of the actual use. The
Pelican Marsh DR! is consistent with the Future Land Use Map.
Based upon the above analysis, staff concludes that the proposed use for the subject site is
consistent with the Future Land Use Element, although the Variance request is not specifically
addressed.
ANALYSIS:
Section 9.04.00 of the LDC gives the Board of Zoning Appeals (BZA) the authority to grant
Variances. The Collier County Planning Commission (CCPC) is advisory to the BZA and
utilizes the provisions of Section 9.04.03.A through 9.04.03.H as general guidelines to assist in
making a recommendation. Staff has analyzed this petition relative to the evaluative criteria and
offers the following responses:
a. Are there special conditions and circumstances existing which are peculiar to the
location, size and characteristics of the land, structure or building iuvolvcd?
Yes. The shopping center is setback approximately 750 fcct from Vanderbilt Beach Road
and Airport-Pulling Road. The entire Airport-Pulling Road and Vanderbilt Beach Road
frontage is occupicd by outparccl style development. (Note: two (2) sites are subdivided
outparcel sites, the other five (5) sitcs appear to be outparcels but are not because they have
not been subdivided from the main parccl). The outparcel sites currently developed along
Vanderbilt Beach Road create a partial visual batTier, making it difficult to see the
shopping center from Vanderbilt Beach Road. The outparcel sitcs along Airport-Pulling
Road are cUlTently undcveloped. As theses are developed, it can be anticipated tllat that
shopping center frontage along Airport-Pulling Road will be obscured as well.
b. Are there special conditions and circumstances which do not result from the action of
the applicant, such as pre-existing conditions relative to the property, which is the
subject of the variance request?
No. The applicant wishes to install a sign that is different from that which is typically
crected at commercial shopping centers. The type of sign that is typically erected at a
commercial shopping center is a 15-foot high directory pole sign with the names of up to
eight (8) tenants. The applicant wishes to install a 9'-4" sign that is a residential style
monument wall sign. The proposed monument wall sign will not have the names of any
tenants; it will only have the name of the shopping center.

c. Will a literal interpretation of the provIsIOns of the LDC work unnecessary and
undue hal'dship on the applicant or create practical difficulties for the applicant?
No. The shopping center would not suffer undue hardship since a literal interpretation of
the LDC would allow the applicant to construct one pole sign for each set of monument
style signs proposed in the same strcet cntrance locations along Vanderbilt Beach Road
and Airport-Pulling Road.
d, Will the variance, if granted, be the minimum variance that will make possible the
reasonable use of the land, building or structure and which promote standards of
hcalth, safety and welfare?
No. The purpose of the requested sign variances are to allow monument style wall signs to
anchor either side of the shopping center street entrancc at the comers of the public streets
that are uscd to access the site. However, Staff is of the opinion that the size of the wall is
an appropriate size and is in proportion to the size of the shopping center it is representing.
The residential character of the sign is in keeping with the aesthetic quality of the
residential neighborhood, thereby promoting standards of health, safety and welfare.
e. Will granting the variance confer on the applicant any special privilege that is denied
by these zoning regulations to other lands, buildings, or structures in the same zoning
district?
Yes. A Variance by definition confers some dimensional relief from the zoning regulations
specific to a site. The granting of this Variance request would allow the proposed signs to
have Icss than the code required 1,000 lineal feet between signs to allow a sign separation
70:f: feet, 705:f: feet, and 775:f: feet. It would also allow three (3) signs along Vandcrbilt
Beach Road street frontage, which is one more than the code allows. The off-premise sign,
which is subject to smaller size standards, would havc an additional 64 square feet of sign
area and 16 inches more height than what is prescribcd by the LDC, thereby confen'ing on
the applicant a special privilege.
f. Will granting the variance be in harmony with the general intent and purpose of this
Land Development Code, and not be injurious to the neighborhood, or otherwise
detrimental to the public welfare?
Yes. Section 5.06.01.A. of the LDC states that the purpose and intent of the LDC relative to
signage is to ensure that all signs are:
I, Compatible with their surroundings;
2. Designed, constructed, installed and maintained in a manncr that docs not
endanger public safety or unduly distract motorists;
3. Appropriate to the type of activity to which they pertain;
4. Large enough to convey sufficient information about the owner or occupants
of a particular property, the products or services available on the property, or
the activitics conducted on the property, and small enough to satisfy the needs
for regulation;
5. Reflective of the identity and creativity of the individual occupants.

In staffs opmIOn, the requested off-premises sign advances all of these objectives.
Therefore, approval of the Variance would be consistent with the purpose and intent of the
LDC.
g. Are there natural conditions or physically induced conditions that ameliorate the
goals and objectives of the regulation such as natural preserves, lakes, golf courses,
etc.?
Yes. The signs are a residential style monument wall sign that are less obtrusive than the
typical shopping centcr pole sign.
h. Will granting the variance be consistent with the Growth Management Plan?
Yes. Approval o[this Variance petition would be consistent with the GMP since it would
not affect or change any ofthe GMP's requirements.
EAC RECOMMENDATION:
The Environmental Advisory Council does not normally hear Variance petitions and did not hear
this one.
RECOMMENDATION:
Staff recommends that the Collier County Planning Commission (CCPC) forward Petition SV-
2008-AR-12943 to thc Board of Zoning Appeals (BZA) with a recommendation of approval
subject to the [ol1owing conditions of approval:
1. The sign copy for Sib'll A-I, A-2, B-1, B-2 and C-l as depicted on Exhibit "A" Overall
Site Plan shaH be limited to 76", square feet.
2. The signs for A-I, A-2, B-I, B-2 and C-I as depictcd on Exhibit "A" Overall Site Plan
shall be limited to the name of the shopping center and shall not contain the names of
individual tenants.

PETITION NUMBER SV.2008-AR-12943, GRANTING
SIX VARIANCES FROM SECTION 5,06,04, OF THE
LAND DEVELOPMENT CODE, CONCERNING THE
SEPARATION OF SIGNS, THE NUMBER OF SIGNS
ALONG A STREET FRONTAGE, THE NUMBER OF
SIGNS ON A PARCEL, AND THE SIZE OF AN OFF-SITE
PREMISES DIRECTIONAL SIGN ON PROPERTY
HEREINAFTER DESCRIBED IN SECTION 35,
TOWNSHIP 48 sourn, RANGE 25 EAST, COLLIER
COUNTY, FLORIDA,
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on an counties in Florida the power to establish, coordinate and enforce zoning and
.
such business regulations as are necessary fDr the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC)
(Ordinance No, 04-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County, among which is the granting of variances; and
WHEREAS, Petitioner wishes to ereet five identical pole signs as depicted in Exhibit A.
Two ofthe signs will be located at the Vanderbilt Beach Road (CR 862) development entrance,
one of which will be an off-premises directional sign, Two of the signs will be located at the
Airport Road (CR 3]) development entrance. One sign will be located at the southwest comer
of Galleria Drive and Airport Road; and
WHEREAS, Petitioner wishes to seek three (3) variances from LDC Section 5,06,04
C.l., which requires a minimum separation of 1,000 lineal feet between signs to allow Jess
separation between signs as fonows: 70:1: feet between sign B-] and B-2, 705::1:: feet between
sign C-l and B-1. and 775::1: feet benvcen sign C-l and B-2, as s.hown in Exhibit A; and
WHEREAS, Petitioner wishes to seek a fourth variance from Collier County LDC
Section 5.06.04 C.l.. which allows a maxitnum of two pole signs per street frontage to allow
three signs along a street frolltage alo~g Airport Road (CR 31); and
VlHEREAS, Petitioner wishes to seek a fifth variance from LDC Section
5.06.04.C.l6.b.i., which requires an off-premise directional sign to be no more than twelve (12)
square feet in area to allow a sign that is 76::1: square feet in area; and
\VHEREAS, Petitioner wishes to seek a sixth variance from LDe Section
5.06.04.C.16.b.ii., which requires an off-premise directional sign to be. no more than eight (8)
feet in height to allow a sign that is 9'-4" in height; and

WHEREAS, the Board of Zoning Appeals has held a public hearing with due notice
'Uade, and ha.s con~idered the advisability of granting these v~lIiances; and
"WHEREAS I the Board has found as a matter of fact that satisfactory provision and
arrangement have been made concerning all applicable matters required by the Land
Development Code; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board
in public meeting assembled and the Board having considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING AJ>PEALS
OF COLLIER COUNTY, FLORIDA, that the Board herehy approves a variance fi'om LDC
5,06,04,C,1, 5,06,04,C,l6,b,i, and 5,06,04.C,16,b.ii., including a distance of 70", feet between
sign B-1 and B-2, 705:1: feet between sign C~I and B-I, and 775f: feet between sign eMl and B-2
as shown in Exhibit A. The Board also approves three signs along Airport Road as shown in
Exhibit A, an approximately 76" square foot, 9'-4" height off-premises sign (sign A-I) as
depicted in Exhibit B, as requested in Petition SV-2008-AR-12943, filed by Glen Weldon of
Glen Weldon and Associates, LLC, of Anderson South Carolina concerning the suhject property
described in Exhib~t C. All signs sball be subject to the conditions set forth in Exhibit D,
BE IT FURTHER RESOLVED that this Resolution relating to Petition Numher SV-
2008~1\R-12943 be recorded in the minutes of this Board.
