EXECUTIVE SUMMARY
Approval of a resolution to supersede Resolution 06-200, which directed the County
Manager to establish a Floodplain Management Planning Committee, to add two
additional positions for practicing civil engineers
OBJECTIVE: To amend the existing Resolution 06-200 to add two (2) additional membership
positions for currently practicing civil engineers and revise the names of the represented County
departments and sections to reflect changes in organizational structure,
CONSIDERATIONS: On July 25,2006, the Board of County CAlmmissioners (Board) adopted
Resolution 06-200 directing the County Manager to establish a Floodplain Management
Planning Committee (FMPC). He successfully accomplished that task by selecting staff
members from the requisite departments, placing advertisements requesting interested members
of the public to apply, and making appointments from the pool of applications received. The
FMPC beld its ftrst organizational meeting on November 15,2006, and proceeded to work under
the direction of the Community Development and Environmental Services (CDES) division to
produce a revised floodplain management plan.

The Development Services Advisol)' Committee (DSAC) is a IS member committee created
pursuant to Ordinance No. 95-60 to provide reports and recommendations to the Board of
County Commissioners, to assist in the enhancement of the operational efftciency and budgetary
accountability within the Community Development and Environmental Services and Public
Utilities divisions, and to serve as a primary communications link between the divisions, the
development industry and the citizens and residents of Collier County. In reviewing issues and
products coming from the FMPC, DSAC expressed concern that there were no currently
practicing civil engineers (other than County or State employees) on the FMPC. During the
January 9, 200S DSAC meeting, a motion was passed to recommend to the Board and the
County Manager that two (2) professional civil engineers (non-governmental) be included as
members of the FMPC. On March 6, 200S, Mr. William Varian, Chairman of the DSAC, wrote
a letter to the Board requesting that positions for at least two (2) currently practicing civil
engineers that may be involved in the local building and/or development industry be added to the
FMPC membership.

During the April S, 200S Board meeting, the County Manager presented a discussion on Mr.
Varian's letter as part of Agenda Item IS (Staff and Commission General Communications).
The brief discussion ended with direction given to write a letter back to Mr. Varian to let him
know that the FMPC founding resolution would be changed to include anywhere from one to
two members from DSAC, whichever DSAC decides, on the FMPC. The April 16, 200S letter
from Commissioner Henning, Chairman of the Board of County Commissioners, stated that the
Board considered the recommendation of the DSAC that County Resolution 06-200 (which
established the Floodplain Management Planning Committee) be revised to allow the
appointment of "at least two (2) currently practicing civil engineers... ", and that the Board
agreed with the recommendation of DSAC and gave direction to the County Manager to draft a
revised version of County Resolution 06-200 accordingly and to subsequently place the revised

drafted Resolution on an upcoming Board of County Commissiners meeting agenda for Board
approval.
County Ordinance 2001-55, as amended by Ordinance 2006-39 provides that no person shall
serve on more than two (2) county boards simultaneously. With that clarification, the resolution
has been revised to add two (2) public membership positions to the FMPC, with these two (2)
new positions being reserved for currently practicing registered professional civil engineers.
Given that the situation may occur that members of DSAC who are currently practicing
registered professional civil engineers may already be serving on two county boards
simultaneously, the revised resolution simply adds the two (2) positions, and it is left to the
discretion of the Board as to whether they choose to fill the positions with DSAC members or
publicly advertise the vacant positions, The resolution has also been revised to reflect a few
changes in the organizational structures of the Transportation Division and CDES.
LEGAL CONSIDERATIONS: This item has been reviewed for legal sufficiency and there are
no outstanding legal considerations. -JW

GROWTH MANAGEMENT IMPACT: None
RECOMMENDATION: That the Board approves the Resolution superseding Resolution 06-
200, adding two additional members, and authorizes the Chairman to sign the new resolution.

RESOLUTION NO. 08 -
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
DIRECTING THE COUNTY MANAGER TO ESTABLISH A
FLOODPLAIN MANAGEMENT PLANNING COMMITTEE,
AND SUPERSEDING RESOLUTION 06-200.
WHEREAS, Collier County is a voluntary participant in the Community Rating System
(CRS) of the National Flood Insurance Program. Because there are more than ten properties in
the County that have filed multiple flood insurance claims within any ten-year period, thus
establishing them as Repetitive Loss Properties, the County is required to develop and maintain a
Floodplain Management Plan, the purpose of which is to promote awareness of floodplain and
flooding issues, identifY known flood hazards, discuss past flooding events, assess the current
floodplain and flooding issues, and set goals along with a strategy to make the community more
resistant to flooding; and
WHEREAS, Collier County is currently rated as a Class 7 community in the CRS
Program, which provides up to a 15% discount on the premiwn rates charged to flood insurance
policy holders. As a Class 7 community, the County is required to annually provide a progress
report on the accomplishment of goals in the Floodplain Management Plan, which Plan must be
updated every five years; and
WHEREAS, on May 9, 2006, the Board of County Commissioners recommended the
establishment of a Floodplain Management Planning Committee; and
WHEREAS, on July 25, 2006, the Board of County Commissioners adopted Resolution
06-200 directing the County Manager to establish a Floodplain Management Planning
Committee; and
WHEREAS, on April 8, 2008, the Board of County Commissioners considered and
agreed with the recommendation of the Development Services Advisory Committee (DSAC) that
Collier County Resolution 06-200 be revised to allow the appointment of at least two (2)
currently practicing civil engineers.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:

SECTION ONE: Creation and Purpose of the Floodplain Management Planning
Committee.
The County Manager is hereby directed to forthwith establish the Collier County
Floodplain Management Planning Committee, with the responsibility to develop and at least
annually evaluate and update the Collier County Floodplain Management Plan. The Committee
shall adhere to the guidelines established in Section 510, et seq., of the CRS Coordinator's
Manual, Edition 2006, as amended from time to time, and all meetings shall be conducted and
governed by the Florida Sunshine Law.

SECTION TWO: Committee Membership.
The County Manager will ensure that membership of the Committee shall include
representatives from County Staff, the incorporated municipalities within Collier County (but
only to the extent they wish to participate), and members of the public (including at least two
currently practicing registered professional civil engineers). All members of the Committee shall
be voting members, unless otherwise noted in their appointment.
A. County Staff. County Staff shall include at least one employee from each the
following departments:
Building Review and Permitting Department
Department of Zoning and Land Use
Comprehensive Planning Department
Emergency Management/Public Safety
Engineering and Environmental Services Department (Engineering Review Section)
Engineering and Environmental Services Department (Watershed Planning Section)
Public Utilities Division
Public Information
Stormwater Management Section
Transportation Division
Staff members shall be appointed by, and serve at the pleasure of, the County Manager.
B. Incorporated Municipalities. To the extent that they wish to participate, the City of
Naples, the City of Marco Island, and Everglades City may appoint a representative to the
Committee, which representative shall serve at the pleasure oftheir respective municipality.

C. Members of the Public. The County Manager may appoint up to twelve (12) members
of the public, at least two (2) of which shall be currently practicing registered professional civil
engineers, to the Committee, including residents, business owners, property owners and tenants
from flood prone areas. To avoid any appearance of impropriety or conflict of interest, public
members, other than the currently practicing registered professional civil engineer members,
should not be involved in any way in the local building and development industry. Each public
member appointee shall serve at the pleasure of the County Manager.
SECTION THREE: Officers; Quorum; and Compensation
The County Manager shall appoint the Chair and Vice-Chair of the Committee from
County Staff. The presence of a majority of the voting members shall constitute a quorum. The
Committee shall adopt rules and procedures for the transaction of business and shall keep records
and minutes of meetings, findings and determinations. Public members shall not be required to
prepare any reports. The members of the Committee shall serve without compensation, but may
be reimbursed for travel, mileage and/or per diem expenses only if approved in advance by the
County Manager.
SECTION FOUR: Supersede Resolution 2006-200.
Collier County Resolution No. 2006-200 is hereby superseded.
