EXECUTIVE SUMMARY
Recommendation to award Contract #08-5080 to BQ Concrete, LLC and Design -
Bnild Engineers & Contractors for the construction of hammerheads on dead-end
streets in Collier County.
OBJECTIVE: Award Contract #08-5080 to BQ Conerete, LLC and Design - Build
Engineers & Contraetors for the construction of hanlmerheads on the dead-end streets in
Collier County to be used as a turnaround for the trash collection vehicles.
CONSIDERATIONS: Currently the County is paying to construct reinforeed driveways
to be used as turnarounds by the trash collection vehicles on dead end streets in Collier
County. The proeess is as follows:
The Utility Billing and Customer Service Department researches the property, to
determine if the property meets requirements to be used as a designated turnaround. A
Representative from the Utility Billing and Customer Service Department meets with the
property owner, explains the eonstruetion process, and ultimately obtains the property
owner's approval to reinforce the property owner's driveway to be used as a designated
driveway by the trash collection contractor.
If the property owner approves, an agreement is signed by the property owner and
County Representatives, stating the driveway will be reinforeed at the County's expense.
The Operations Coordinator then request bids for the project through the use of the
Purchasing Department's E-Procurement System. The lowest qualified bidder is then
selected to eonstruct the designated driveway to be used as a turnaround by the collection
contractor.
When eonstruction 0 f the reinfareed driveway is completed, a green refleetor is placed in
front of the reinforced driveway to alert the driver of the colleetion vehicle the driveway
may be used as a designated turnaround.
Problems in the past regarding the process above are as follows:
. The agreement signed by the property owner is not a binding legal document. If
the customer decides at any time, he or she does not want the collection
contractor to use their driveway as a turnaround, the County has no legal
recourse, and the construction cost to reinforee the property owner's driveway
cannot be recovered.
. If the eurrent property owner signed the agreement, then at a later date sells the
property, the new owner is under no obligation to let the eollection contractor
continue to use the driveway as a turnaround.

A long term solution for the turnaround issue is to construet hammerheads at the end of
the dead end streets in Collier County. The hammerheads will be constructed in the

county right of way, meet Department of Transportation specifieations, and will be
owned by Collier County.
Representatives from the Utility Billing and Customer Serviee Department met with the
County's Transportation Department, South Florida Water Management District and
Waste Management Inc. of Florida to discuss the possibility of constructing
hammerheads on the dead end streets in Collier County. After a number of meetings, a
Memorandum of Understanding (See attaehment) was drafted and approved by all
parties.
The Memorandum of Understanding between Collier County Utility Billing and
Customer Service, Waste Management Inc. of Florida, and the Collier County
Transportation Department supplements and eonfirms the understandings that were
reaehed during a meeting held on January 8, 2008.
As of April 1, 2008, the Transportation Department has approximately 4,600 cubie yards
of fill material available for the hammerhead project at three locations throughout Collier
County. As a result of the eurrent and future Transportation Department projeets,
approximately 15 loads (300 cubic yards) per week will replenish the stock pile of fill
material as available for the hammerhead project.
The Transportation Department has agreed to allow the Utility Billing and CU8tomer
Serviee Department to use the fill material at no cost for this project. The stoekpiled fill
material is readily available for the hammerhead construetion project.
Representatives from the Utility Billing and Customer Service Department, Waste
Management Incorporated of Florida, and the contractors awarded Bid #08-5080, will
look at each job site individually to determine the size of the hammerhead needed, to
enable the collection contractor to turn around safely. The duration of the Memorandum
of Understanding will be for a period of five years from the date of execution.
The eost for loading and hauling the stockpiled fill material to the job site is included in
Bid #08-5080 under materials and equipment.
In a few situations, it may be necessary to eonstruet a reinforeed driveway due to
insufficient spaee to construet a hammerhead on a dead end street.
Bid #08-5080 was posted on April 23, 2008. 456 notices were sent out, 69 notiees were
downloaded, and 10 bids were received. Staff reviewed the bids and deemed BQ
Conerete, LLC and Design - Build Engineers & Contraetors as the two lowest responsive
bidders.

FISCAL IMPACT: $215,358.66 is available in the Solid Waste Capital Projeet Fund
(474) Project 59001. Upon approval, the available funds will be used to construct critical
hammerheads in Collier County.
LEGAL CONSIDERATIONS: There are no legal considerations at this time.-JAB
GROWTH MANAGEMENT IMPACT: This action is eonsistent with the Growth
Management Plan, by providing the public with eost effective solid waste collection
serviees and alternatives to provide services to our residents and visitors that exeeed
expectations.
RECOMMENDATIONS: That the Board of County Commissioners award Contract
#08-5080 to BQ Conerete, LLC and Design - Build Engineers & Contractors for the
construetion of hammerheads on the dead end streets in Collier County, and authorize the
Chairman to sign the standard agreements after approval by the Office of the County
Attorney for legal sufficiency.

MEMORANDUM OF UNDERSTANDING
Hammerhead Project
This Memorandum of Understanding (MOU) between Collier County Utility Billing &
Customer Service, Waste Management Inc. of Florida, and the Collier County
Transportation Department supplements and confirms the understandings that were
reached during a meeting held on January 8, 2008.

3. The Transportation Department has agreed to allow the Utility Billing and
Customer Service Department to use the fill material for the project, at no cost
for the construction of hammerheads on the dead end streets throughout
Collier County. The stockpiled fill materia! is available for immediate use to
construct the hammerheads.
4. The Transportation Department will continue to stock pile the fill material as
it becomes available from current and future projects, but will not be
responsible for hauling the material to the hammerhead project locations.
5. The Transportation Department will by no means be responsible for ensuring
the availability of fill material for the entire hammerhead project.
6. Representatives from the Utility Billing and Customer Service Department,
Waste Management Incorporated of Florida, and the contractor(s) that is
awarded the bid for this project, will look at each job site individually to
determine the size of the hammerhead needed, to enable the collection
contractor to turn around safely.
7. The duration of this Memorandum of Understanding will be for a period of
five year5 from the date of execution.
By executing this Memorandum of Understanding, the undersigned acknowledge that
they understand and agree with the general provisions set forth in paragraphs 1-7, above.
