Recommendation to approve an amendment of Contract No. 05-3831 "FEMA
Acceptable Monitoring Disaster Debris Management" with R.W. Beck Inc, Post,
Buckley, Schuh, Jernigan Inc. and Solid Resources, Inc to delete language under
Section 19, to comply with FEMA 325 Debris Management Guide (July 2007).
OBJECTIVE: To obtain approval to amend Contract 05-3831 "FEMA Aceeptable Monitoring
Disaster Debris Management" by deleting language that allows Collier County to receive
compensation for each governmental entity reeeiving written permission to utilize this contraet.
CONSIDERATIONS: On June 28, 2005, the Board approved Agenda item No.16.C.18, ,05-3831

Buckley, Schuh, Jernigan Inc. and Solid Resources, Inc.,. to provide disaster recovery expertise and
services to insure eompliance with regulatory agencies for managing and carrying out the removal
and reduction of disaster debris.
Currently, these contracts allow for a 3% fee to be charged by the County to any governmental
agency that utilizes this contract for services. This provision does not comply with FEMA 325 Debris
Management Guidelines.
Staff recommends that the language in paragraph two in Section 19, "Offer Extended To Other
Governmental Entities" be deleted so the County will be in compliance with FEMA guidelines and
regulations. Strikethrough indicates recommended language for deletion.

19. OFFER EXTENDED TO OTHER GOVERNMENTAL ENTITIES. Collier County encourages
and agrees to the suecessful proposer extending the pricing, terms and eonditions of this
solicitation or resultant eontract to other governmental entities at the discretion of the
successful proposer.

The Purchasing and Solid Waste Management Departments remain proaetive in the development
and updating of the County's Debris Removal Plans and eontraets. By pre-establishing protocols
necessary to expedite the recovery from a severe weather event, the County reduees it potential for
increased eost or loss of reimbursements from the Federal and State Governments. Additionally, by
making this contract language change the County will be in complianee with FEMA guidelines to
reeeive the additional 5% Federal cost share under the FEMA's Public Assistance Pilot Program.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impaet assoeiated with this
Executive Summary.
FISCAL IMPACT: Modifieation of our Debris Management contracts will help to ensure maximum
reimbursements from FEMA and State ageneies in the event of a major disaster.
.---- RECOMMENDATION: That the Board of County Commissioners approves eontraet amendment to
remove language in Section 19 as eited above, and authorizes the Chairman to sign the
amendment.

The following change to the above referenced Agreement has been mutually agreed to by the
Conlractor and the County:
The deletion of the existing language in Seclion 19 of the Agreement is shown herein by
