EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners (BCC) approve the offsite removal of
up to 700,000 cubic yards of excess fill from the Lely Resort. The excess fill is a result of
previously approved development and lake excavation within Lely Resort and the material is
also tied to current and proposed excavations that are in substantial conformance with the
approved PUD Master Plan.
OBJECTIVE: To approve the removal of excess fill from the last phases of the Lely PUD.
CONSIDERATIONS: The Lely Resort PUD is an older PUD without the current standard provision
allowing for removal of excess fill from the site. The Lely Resort DRI (84 -3C) was approved as a
PUD on 09 Dec. 86. It covers 2,892.5 acres. The latest PUD Amendment was Ordinance 07 -72
approved on 10 March 92.
There are approximately 24 separate excavation permits, many with modifications, for projects within
the 2,892.5 acres of Lely Resort and many of them are for multiple lakes. Several millions of cubic
yards of fill have been excavated within Lely Resort and spread for roads and building pads. There was
one request to allow the removal of 75,000 cubic yards of stockpiled fill that was previously approved
by the BCC because Lely Resort is running out of places to stockpile fill in the middle of residential
neighborhoods.
The petitioner estimates that he needs permission to remove at least 150,000 cubic yards of excavated
material and possibly as much as 700,000 cubic yards depending on the design of the remaining sites.
During the earlier phases of construction, the developers were able to stockpile fill on cleared sites for
later use, but that is becoming less of an option as the project nears completion.
For reference, a ten -wheel dump holds the equivalent of roughly about 14 cubic yards of compacted
fill, so 700,000 cubic yards represents about 50,000 truckloads. At 250 work days per year, it would
take roughly 20 trucks per hour (one every three minutes) working ten -hour days to haul 700,000 cubic
yards of fill offsite.
The petitioner has requested a maximum allowable excavation depth of 30 ft. instead of the usual 20 ft.
From the soil borings, this will not breach any confining layers. If the petitioner is limited to 20 ft. of
depth, the amount of excess fill will not decrease proportionately because of how the excavation
narrows down as it gets deeper due to sideslope considerations. The only item staff cannot vouch for
is the reason for the tremendous spread between the proposed minimum and maximum amounts of fill
to be hauled offsite, but the petitioner's engineer wants to insure that there's enough fill from the lakes
so that none has to be hauled in, and they're not sure exactly how much more will be needed on site.
The attached drawings and aerial show bow close the proposed plans are to the presently approved
PUD Master Plan.

FISCAL IMPACT: The petitioner has agreed to pay $1.00 per truckload to the Transportation
Department for maintenance of the road network to offset any possible damage caused by the hauling.
GROWTH MANAGEMENT PLAN (GMP) IMPACT: None. The northwest section of Lely
Resort accesses Rattlesnake Hammock Road and Collier Blvd. (Rt. 951) from Grand Lely Drive, so
there is minimal traffic through local neighborhoods.
ENVIRONMENTAL ISSUES: Offsite hauling of excess fill, if done properly, will have no
Environmental impact.
LEGAL CONSIDERATIONS: This item has been reviewed for legal sufficiency and is legally
sufficient for Board action. -JW
RECOMMENDATIONS: That the BCC approve a maximum allowable excavation depth of 30 ft. for
the remainder of the lakes at the Lely Resort P.U.D. and the offsite hauling of excess fill from this
construction site up to a limit of 700,000 cubic yards.
