EXECUTIVE SUMMARY
Recommendation to adopt a superseding resolution authorizing the condemnation of fee
simple and /or those perpetual or temporary easement interests necessary for the construction
of roadway, drainage and utility improvements required for the extension of Tree Farm Road
from Davila Street to Massey Street, and Wooderest Drive from Immokalee Road to Tree
Farm Road. (Project No. 60171). Estimated fiscal impact: $1,200,000.00.
OBJECTIVE: To adopt a superseding resolution authorizing the acquisition by condemnation of
fee simple and/or those perpetual or temporary easement interests necessary to extend Tree Farm
Road from Davila Street to Massey Street, and Woodcrest Drive from Immokalee Road to Tree
Farm Road (Project No. 60171).
CONSIDERATIONS: On July 25, 2007, the Board of County Commissioners of Collier County,
Florida, adopted Resolution No. 2007 -212, finding public purpose and necessity and authorizing the
condemnation of fee simple and/or those perpetual or temporary easement interests necessary for the
construction of roadway, drainage and utility improvements necessary to extend Tree Farm Road
from Davila Street to Massey Street and Woodcrest Drive from Immokalee Road to Tree Farm
Road. Since then, the road alignment adjacent to these parcels has moved slightly to the north to
avoid conflicts with underground radial wires emanating from the base of various antennae located
on the parent tract of these parcels. The sketches and legal descriptions of Parcels 102FEE and
102SE have been revised, and new Parcels 104FEE2 and 104SE2 have been added to the project to
accommodate the new alignment of the road in this area.
Initial authorization for the purchase of right -of -way for the Tree Farm Road / Woodcrest Drive
project was given by the Board of County Commissioners on February 27, 2007, under Resolution
No. 2007 -50. Pursuant to obligations set forth in applicable Developer Contribution Agreements,
the county is required to construct this project, and developers along the corridor have agreed to
donate the property necessary to construct the road through Plat Book Dedications or Fee Simple
donations. While the County still plans to accept those dedications and donations when they are
submitted for Plat Book approval or conveyed, if for any reason the property is not submitted, the
County needs to be able to acquire the remaining property in order to construct the project. Hence,
the authority to acquire the right -of -way by condemnation, if necessary, is being sought from the
Board.
The Board of County Commissioners has been advised through numerous communications of the
need to extend Tree Farm Road and Woodcrest Drive, The Board is herewith being advised of the
various alternative routes and typical roadway sections considered by its professional engineering
staff and consultants, and of the environmental impacts and costs of each engineering alternative, of
the public health, safety and welfare considerations, and of the long -range planning implications
posed by each alternative. Reference is being made to the attached Technical Memorandum
prepared by CH2MHill. By its review, concurrence and approval of this executive summary, the
back -up documentation, and the proposed resolution, the Board will have determined that the legal
descriptions, and the interest in real property specified on each legal description, which are a part of

the attached Resolution, represent the most feasible location, and are necessary for the construction
of the proposed expansion to Tree Farm Road and Woodcrest Drive.
The Board of County Commissioners has been further advised that it is necessary and in the public's
best interest to acquire, by condemnation if necessary, those interests in real property specified on
each legal description attached to the Resolution.
FISCAL IMPACT: While much of the right -of -way has been committed to the County at no
charge through development agreements, it is estimated that the total cost of all right -of -way which
may be taken via condemnation will be $1,200,000.00. This amount includes the cost of all real
property rights required for construction of the proposed improvements, as well as all expenses for
title work, real estate appraisals, and those expenses, such as property owner attorney's fees and
expert witness fees, which the County is required to pay according to Sections 73.091 and 73.092,
F.S. All such payments will come from the Transportation Supported Gas Tax fund and the Road
Impact Fee funds. Source of funds are gas tax and road impact fees.
GROWTH MANAGEMENT IMPACT: The expansion of Tree Farm Road and Woodcrest Drive
(Project No. 6017 1) is an integral part of Collier County's Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office and
is legally sufficient for Board action.SRT.
RECOMMENDATION: That the Board of County Commissioners of Collier County:
1. Adopt the attached Resolution;
2. Authorize its Chairman to execute same on behalf of the Board; and
3. Authorize any budget amendments that may be necessary to implement the collective will of the
Board as evidenced by the adoption of the attached Resolution and the approval of this
Executive Summary.

A RESOLUTION SUPERSEDING RESOLUTION NO. 2007 -212 AUTHORIZING
CONDEMNATION OF FEE SIMPLE AND /OR THOSE PERPETUAL OR
TEMPORARY EASEMENT INTERESTS NECESSARY FOR THE
CONSTRUCTION OF ROADWAY, DRAINAGE AND UTILITY IMPROVEMENTS
REQUIRED FOR THE EXTENSION OF TREE FARM ROAD FROM DAVILA
STREET TO MASSEY STREET, AND WOODCREST DRIVE FROM IMMOKALEE
ROAD TO TREE FARM ROAD. (PROJECT NO. 6017 1)
WHEREAS, roadway improvements consisting of the 2 -laning of Wooderest Drive
extending south from Immokalee Road to Tree Farm Road for approximately one mile and the 2-
laning of Tree Farm Road extending cast from Davila Street to Massey Street for approximately
one -half mile (hereinafter referred to as the "Project ") are necessary in order to provide adequate
and local access to existing and proposed residences and developments on Tree Farm Road,
Woodcrest Drive and Massey Street, thereby meeting certain concurrency requirements
consistent with Objective 8 and pursuant to Policy 9.3 of the Transportation Element of the
Growth Management Plan for Collier County and Chapter 163, Florida Statutes; and
WHEREAS, the Project is part of Collier County's official Road Network, and is a part
of the long range plan for transportation infrastructure as adopted January 12, 2006 in the 2030
Long Range Transportation Plan; and
WHEREAS, on July 25, 2007, the Board adopted Resolution No. 2007 -212 authorizing
the condemnation of property for the construction of the Project; and
WHEREAS, the sketches and descriptions of Parcels 102FEE and 102SE have been
revised, and new Parcels 104FEE2 and 104SE2 have been added to correctly reflect the property
required for construction of the Project and

WHEREAS, the location for the construction of the proposed irriproV&hents has been
fixed by survey and is collectively represented by the legal descriptions comprising Exhibit "A"
attached hereto and incorporated herein; and
WHEREAS, after consideration of the availability of alternate routes and locations, the
comparative costs of the project alternatives, various impacts upon the environment, long range
planning options, and public safety considerations, the Board desires to exercise its right to
condemn property for public purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the
Board that the roadway improvements to Woodcrest Drive from hnmokalee Road to Tree Farm
Road and the roadway improvements to Tree Farm Road from Davila Street to Massey Street are
necessary and in the public's best interest in order to protect the health, safety and welfare of the
citizens of Collier County.
AND IT IS FURTHER RESOLVED that construction of the Project is an integral part of
the County's long range planning effort.
AND IT IS FURTHER RESOLVED that the County Staff has reviewed alternative
locations for the Project, and the costs associated with the design, property rights acquisition, and
construction of the project, as well as public safety and welfare considerations associated with
the design and construction of the Project, and various impacts to the environment, and the
Board finds that after consideration of these issues, the most feasible locations for construction
of the proposed improvements is collectively represented by the legal descriptions comprising
Exhibit "A" attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that in order to construct the Project as designed, it
is necessary for the Board to acquire various real property interests described in Exhibit "A."

AND IT IS FURTHER RESOLVED that all property shall be put to7pab 5d purposes.
AND IT 1S FURTHER RESOLVED that the County staff is hereby authorized to
immediately acquire by gift, purchase or condemnation in accordance with the provisions of
Chapters 73, 74 and 127, Florida Statutes, the above referenced real property interests more
particularly described in Exhibit "A," attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the property
sought to be acquired and therefore it will not be necessary to remove any mobile homes from
the property to be acquired.
This Resolution, adopted on this __ day of
second and majority vote, supersedes and replaces Resolution No. 2007 -212.

1.0 Introduction
' Collier Comity has initiated a roadway improvement project to construct approximately
0.5 miles of Tree Fann Road (extend from Davilla Stre t to Massey Street) and improve 1.0
mile of existing Woodcrest Drive (from biaswv Strut to hnnwkalee• Road), in Collier
County, Florida (Figure 1 -1).
The specific purposes of thv project is to enhance mobility and develop a traffic circulation
plan for the local system connection to the primary facilities of Collier Boulevard (CR951)
and Immokalee Road that promotes safe local traffic, bicycle and pedestrian movements.
' The intent of the project is to provide adeeivaloe transportation capacity to meet future traffic
development and planned growth as approved in the Collier Couroty Growth Management
flan.
This report addresses cost, environmental impacts, permutability, current and future
development patterns. In addition, this project k part of an overall corridor improvement
program Collier Comity has undertaken to alleviate rapacity C011COT11S along Collier
Boulevard and Immokalee Road. There at -(' manv other roadway improvement projecks in
the area which are at various stapes of cumpic,tiun (Figure 1_2). 'fhe improvements to
Collier Boulevard (951), (from Golden (;aty Boulevard to Irnmokalee Road). located to the

3.0 Need for Transportation Improvements
This project is being developed as a vital component Ito the regional transportation network
to accommodate existing and future residential growth in the area and suet future traffic
demands in Collier County, Collier County has seen significant development and growth in
recent years. All vacant land adjacent hn this project have secured development orders from
Collier County or planned development activities within the next few years. This growth
presents major challenges to the existing Collier County network of arterials and collators,
and pra;npted the n tiuirc -d improvements to this vital roadway connection to Inmrokalee
Road and Collier Boulevard (C,R 9.71) to improve traffic conditions at the Collier Boulevard -
Immokalee Road Intersection and Collier Raulrvard- Vanderbilt Beach Road Intersection.
Figures 3 1 and.1-2 show current and future land use for the property adjac eat to the
project.
Improvements to Woodcrest Drive, nlcluding the connection to Massey Street, will provide
acontinuous cotuiection between lunnokaler> Road (ill tiro north) and Vanderbilt Beach
Road (to the south), removing trills from Collier Boulevard In twi en the same roads. This
will alleviate traffic conditions at the Collier F3uulevard- Imnrokalee Road intersection, This

4.0 Existing Conditions
4.1 Woodcrest Drive
Hie existing Woodcrest Drive madwav consists of two 12 -ft. (approx.) unpaved travel lanes.
The lime -rock road lxgins at lmmokalce Road (on the north) and continues south to
Ackermaker Road providing access to the single family residences along Ackermaker Road.
I he roadway continues south and intersects With Massey street. The intersection with
Immokalee Road is a frill median opening not Currently signalized. An eastbound right turn
lane onto Woodcrest Drive and a wesilxrund left turn lace were buih as part of the
Immokalee ROad siz -lane project (Project No. 60018), currently under construction. The
existing right -of -way width varies bohveen ?5 feet and 70 feet.
4.2 Tree Farm Road
The existing. free Farm Road (built as part of the Collier Boulevard Project No. 655061) is a 2-
lane, undivided, urban roadway (two 12 -11 lanes, hike lanes, sidewalk). 'Ihe roadway goes
from Collier Boulevard to Davila Street (approx. 05 miles). The roadway continues east as
an unpaved access road. The existing roadway provides access to single family residences
and the Meridian Broadcasting communications tOWCr Incited al the southwest corner of
Massey Street and Calusa Pines Drive The existing, roadway right of wav width along the
Proposed extension k 10 feet.

5.0 Evaluation Factors
The following factors were considered prior to recommending the propose d improvernents:
5.1 Alternate Alignments
Woodcrest Drive is an existing roadway whose centerline alig rra oviih the. section line.
Collier County acquired 75 feet of right of way from Calusa Pines Golf Club 11C in 2004.
Design requirements were to follow die existing alignment as it severed the adjoining{
properties equitably and keep any improvenionts within the existing right of wav to the
greatest extent possible.
Two Farm Road is an existing roadway whose centerline aligns with the section line. The
improvernenLs to the roadway segment between Collier Boolevard and Davila Stmet were
designed and completed by Collier County as part of project No 65061- Aligrunent design
considerations for the extension considerations were similar to the Woodcrest Drive and
consider the location of the existing tilassey Stree1- CA1U9a Pines inters x tion. Therefore the
proposed 0.5 mule extension of free Farm iloacf will In continue along the section line to its
terminus at the hlasey /Calusa Pines intersection. A slight shift in the roadway alignment
will be, incorporated to avoid impacts to the M(n -idiao Broadcast Site. this is explained in
Section 5.1.3 below.
6.1.1 Right of Way Evaluation
A Traffic Analysis was performed by the Developers adjacent to tho corridor as part of their
Commmnity Developnunt & Environmental Se rvices Division permitting process. The
results of the traffic studies indicated that l lane is required along Woodcrest Drive and free
Farm Road to provide adequale capacity tar traffic operation; therefore a two - lane typical
section is the controlling roadway itam to determine the required ROW width. 1'he typical
sections evaluated included.

As a result, the Frye Farm Road alignment was shifted slightly to the north to avoid all

In the areas where turn lanes were required, the alignment was shifted to minimize ROW

The intersection of Woodcrest Drive/ Massey Street and l roe Farm Road was evaluated
based on traffic data and it was determined that due to traffic: volumes, a 4-way intersection

with stop signs would not provide an acceptable level of service for the roadway. A
"RoundabouC configuration for the intersection was considered and it was concluded a
Roundabout would provide the best level of services for the intersection.
5.2 Safety Factors
Construction of the Tree Fat m Road Woodcrest Drive will increase the safeIV of the adjacent
roadway collectors by removing residential traffic from Collier Boulevard, Imoutkalee Road

and Vanderbilt Beach Road as early as possible in the trip movements. Signing and marking
and turn lane length decisions were based on JDOT and Collier County guidelines to safely

The Collier County Transportation Department (Cotarvty) proposes to improve 1.0 voile of
Woodcrest Drive, an existing 2 -lane unpaved rural north -south roadway, to a 2 -lane
undivided local minor urban section and extend Frce Farm Road, an existing east -west
roadway (built with the Collier Boulevard Project (Project No. 65061), from its current

3.0 Need for Transportation Improvements
This project is being developed as a vital c mtponont to the region,( transportation network
to accommodate existing and future residential growth in the area and meet future traffic
demands in Collier County. Collier County has seam significant development and growth in
recent }ears. All vacant land adjacent to this project have secured development orders from
CrdlicrCounty or platuicd development activities within the next few years. "this growth
presents major challenges to the existing Collier County network of arterials and collet: tars,
and prompted the required improvemt•rdn to this vital roadway ay connection to Immokalee
Road and Collier Boulevard (CR 951) to improve traffic conditions at the Collier Boulevard -
Immokalee Road Intersection and Collier Boulevard- Vanderbilt Beach Road Intersection.
Figures 3 -'1 and 1 -1 show current and future land use for the property adjacent to the
project.

4.1 Woodcrest Drive
The existing; Woodcrest Drive roadway consists of two 12 -ft (approx.) unpaved travel lanes.
the lime -rock road begins at Immokalee Road (on the north) and continues south to
Ackermaker Road providing access to the single family residences along Ackermaker Road_
Hie roadway continues south and intersects with Masse} Sti -NA. I'he intersection with
Inunokalee Road is a full median opening not currently signalized. An eastbound right turn
lane unto Woodcrest Drive and a westtxmnd left turn lane were built as part of the
I nmokalee Road six -lane project (Project No. 60018), currently under construction. The
existing right -of -way width varies bet-ween 35 feet and 70 fret.
4.2 Tree Farm Road
I'he existing'Free harm Road (built as part of ter Collier Boulevard Pruje.ct No 65061) is a 2-
Iane, undivided, urban roadway (two 12 -ft lanes, bike lanes, sidewalk). The roadway goes
from Collier Roulevard to Davila Street (approx. 25 miles). The roadway continues east as
