EXECUTIVE SUMMARY
To approve and execute Site Improvement Grant Agreement(s) between the Collier County
Community Redevelopment Agency and a Grant Applicant(s) within the Bayshore Gateway
Triangle Community Redevelopment area. (2737 Shoreview Drive)
OBJECTIVE: To approve and execute a Site Improvement Grant Agreement(s) between the
Collier County Community Redevelopment Agency (CRA) and a Grant Applicant(s) within the
Bayshore Gateway Triangle Community Redevelopment area (2737 Shoreview Drive).
CONSIDERATIONS: Annually, the Community Redevelopment Agency's Site Improvement
Grant Program is funded at a level that satisfies existing grant obligations from prior fiscal years
and future grant opportunities. The purpose of the grant program is to provide an incentive to
revitalize the area by providing a matching grant to encourage the private sector to
upgrade /rehabilitate, their property. The residential property grant requires applicants to provide a
project cost -match of at least 67% with the remaining project dollars supported by Tax Increment
dollars generated from the CRA District. For FY 09, a total of $320,000 is budgeted for all grant
programs. From this allocation, $302,00 is available for new projects and $17,500 is committed
and due to previously approved applicants upon satisfaction of all grant stipulations.
The site improvement grant application submitted by Bruce and Sherilyn D. Jackmack of 2737
Shoreview Drive, Naples Florida, 34112 was recommended for approval by the
Bayshore/Gateway Triangle Community Redevelopment Local Advisory Board.
LEGAL CONSIDERATIONS: The grant application and agreement have been reviewed and
approved by the County Attorney Office which has determined that the agreement complies with
CRA requirements. (MMSS)
FISCAL IMPACT: Sufficient budget exists within the FY 09 Bayshore Gateway Triangle Fund
(187) to satisfy this new grant application. A Site Improvement Grant may fund up to 33% of the
applicants project cost up to a ceiling of $8,000. This site improvement project totals $23,028 and
the grant request is $7,676 which is 33% of the estimated project cost.
GROWTH MANAGEMENT IMPACT: Policy 4.7 of the Future Land Use Element of the
Growth Management Plan states that redevelopment plans may be developed for specific areas
within the County, including the Bayshore Gateway Triangle CRA that may consider alternative
land use plans, modifications to development standards, improvements to infrastructure and
incentives to encourage redevelopment.
RECOMMENDATION: That the CRA Board approves and authorizes for execution the Site
Improvement Grant Agreement between the Community Redevelopment Agency and Bruce and
Sherilyn D. Jackinack of 2737 Shoreview Drive, Naples Florida, 34112 ill the amount of
$7,676.00.

4. THE SITE IMPROVEMENT GRANT AGREEMENT BETWEEN CRA
AND OWNER
This agreement is to he signed and witnessed AFTER CRA staff have found the Application to be complete.
THIS AGREEMENT ENTERED this 14 day of October. 2008 by and between the
Collier County Community Redevelopment Agency (hereinafter referred to as "CRA ") and
Bruce and Sheri}vn D. Jackmack (hereinafter referred to as "Owner ").
WITNESSETH:
'WHEREAS, in Collier County Ordinance No. 2002 -38, the Board of County
Commissioners delegated authority to the CRA to award and administer CRA grants including
contracts with owners for CRA grates; and
WHEREAS. Owner has applied for a site improvement grant in the amount of 7.676.00
dollars: and
WHEREAS, the CRA has determined that Owner meets the eligibility requirements and
was approved for a grant award in the amount of 7.676.00 dollars on October 14. 2008, ("CRA
Approval "), which is 33'" of the costs to construct the site improvements.
NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other valuable consideration. the parties agree as follows:
1. Owner acknowledges to the CRA that Owner has received a copy of the Collier
County, Community Site Improvement Grant Program (hereinafter referred to as "Grant
Program "'), that Owner has read the Grant Program, and that Owner has had ample opportunity
to discuss the Grant Program with Owner's counsel or advisor. Owner further ac1noN%1cdQcs to
the CRA that Owner understands and agrees to abide by all of the terms and conditions of the
Grant Program. Owner agrees to the terms and conditions of the Grant Program.
2. Owner is the record owner of property described as 2_737 Shoreview Drive Naples. 1:
341 1'.
3. Owner has agreed to make certain improvements to the property pursuant to the
grant application submitted to the CRA dated September 24. 2008 attached hereto as Exhibit A
and incorporated herein by reference.
4. Owner agrees to complete the constntction of the Site Improvements within one (1) year
of CRA Approval. O•wcncr also aLrees to fund at least 33 "6 of the costs of the Site Improvements.

Owner is prohibited from paying contractors and/or vendors with cash; all payments for
approved projects must be in the form of a personal check or credit card.
5. CRA has approved a grant to Owner in the amount of $7,676.00 to be
administered pursuant to the terms of this Agreement based on an estimated cost of $23,028.00.
If the actual costs are less than the estimated costs to construct the Site Improvements and less
than $7.676.0 0, the grant arnount shall be reduced dollar for dollar in matching CRA funds as
determined by ratio of matching private funds required.
6. Unless prior disclosure is included in the grant application, no Owner, or any
immediate relative of Owner, shall serve as a contractor or subcontractor for the construction of
the Site Improvements and no Owner, or any immediate relative of Owner, shall receive
compensation for labor for the construction of the Site Improvements. An immediate relative of
Owner shall include mother, father, brother, sister, aunt, uncle and cousin or fancily member by
marriage to include mother -in -law. father -in -law, brother -in -law and sister -in -law. Owner has
verified that all contractors who have provided bids for the approved work are actively licensed
by Collier County and owner agrees that all labor will be performed only by the lowest bidding
contractor.
7. Owner agrees to )btain all necessary permits and submit any required plans to the
County's Community Development and Lnvironmental Services Division. Upon completion of
the work, Owncr shall submit to the CRA staff a project sun nary report, two (2) 8 x 10 after
photos, a list of materials and construction techniques used, a list of architects and /or contractors,
and any other information specific to the projector requested by the CRA staff. ThC CRA,
through its stag shall cant-inn that the Site Improvements were constructed pursuant to the terms
of the application approved by the CRA.
8. Within forty -five (45) days alter confirmation that the Site Improvements were
constructed pursuant to the terms of the approved application. Owner shall be issued a check in
the arnount of the urant. However, if Owncr fails to make the improvements pursuant to the
terns of the approved application, or if the project is not completed within on,: (1) year of CRA
approval, or if Owner tails to fund at least 3396 of the cost of the Site Improvements, the grant
shall be deemed revoked and Owner shall be entitled to no funding.
This Agreement shall be eoverned and construed pursuant to the laws of the State
of Florida.
10. This Agreement contains the entire agreement of the parties and their
representatives and agents, and incorporates all prior understandings, whether oral or written.
No change, modification or amendment, or arty representation, promise or condition, or any
Nvaiver, to this Agreement shall be binding unless in writing and signed by a duly authorized
officer of the party to be charged.
