RESOLUTION FOR PETITION AVESMT 2001-AR424 TO DISCLAIM, RENOUNCE AND
VACATE mE COUNTY'S AND mE PUBLIC'S INTEREST IN THE IS' WIDE DRAINAGE
EASEMENT LOCATED ALONG THE LOT LINE COMMON TO LOTS 5 AND 6, ACCORDING TO
mE PLAT OF "WILLOW PARK" AS RECORDED IN PLAT BOOK 31, PAGES 73 THROUGH 74,
PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA. LOCATED IN SECTION I, TOWNSHIP 49
SOUTH, RANGE 25 EAST.
WHEREAS, pursuant to Section 177.101, Florida Statutes, Jeff Davidson of Davidson
Engineering, Inc., as agent for the petitioner, Deangelis Diamond Construction, Inc., docs hereby request
the vacation of the 15' wide Drainage Easement along the lot line common to Lots 5 and 6, as depicted on
the plat of "Willow Park" as recorded in Plat Book 3 l, Pages 73 through 74, Public Records of Collier
County, Florida, located in Section l, Township 49 South, Range 25 East; and
WHEREAS, the Board has this day held a public hearing to consider vacating said IS' wide
Drainage Easement along the lot line common to Lots 5 and 6, as more fully described below. and notice of
said public hearing to vacate was given as required by law; and
WHEREAS, the granting of the vacation will not adversely affect the ownership or right of
convenient access of other property owners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, that the following be and is hereby vacated:
See Exhibit "A" attached hereto and incorporated herein.
BE IT FURTHER RESOLVED, that the Clerk to the Board is hereby directed to record a certified
copy of this Resolution in the Official Records of Collier County, Florida, and to make proper notation of
this vacation on the recorded plat as referenced above.
This Resolution is adopted this ~ day of ~ 2001, after motion, second and
majority yote fav?ring same.

Beginning at the northeast comer of Lot 5, Willow Park, as recorded in Plat Book 31,
Pages 73 and 74, of the Public Records of Collier County, Florida;
Thence along the common lot line ofLat 5 and Lot 6 of said Willow Park South
02002'08" West 167.48 feet to the southeast comer of said Lot 5, also being the
Point of Terminus of the centerline of a 15' wide drainage easement herein
described.
Sidelines of said easement are to be extended or shortened to provide a minimum
width of 7.50 feet from centerline.
Containing 2512.2 square feet plus or minus.
Subject to easements and restrictions of record.
Bearings are based on the east property line of Lot 5, as being South 02002'08" West.
