EXECUTIVE SUMMARY
Recommendation to approve a Second Amended Declaration of Taking and Stipulated Order
of Taking and Final Judgment in the amount of $3,500.00 for Parcel 130 (to be redesignated
as Parcels 130TSE and 130SW-U-SL- TSMPE) in the lawsuit styled Collier County v.
Alexander G. Christou, et al., Case No. 07-4923-CA (Santa Barbara Boulevard Extension
Project 60091). (Fiscal Impact $3,500.00)
OBJECTIVE: That the Board of County Commissioners approve a Second Amended Declaration
of Taking and Stipulated Order of Taking and Final Judgment for payment of full compensation, for
the taking of Parcel 130FEE, to be redesignated as Parcels 130TSE and 130SW-U-SL- TSMPE, in
the lawsuit styled Collier County v. Alexander G. Christou, et. at., Case No. 07-4923-CA (Santa
Barbara Boulevard Extension Project No. 60091).
CONSIDERATIONS: Collier County filed a Petition for condemnation of fee simple interest in
9,694 square feet for road right-way (Parcel 130FEE) from Respondents FFT Santa Barbara I, LLC
& FFT Santa Barbara, II, LLC. The County's initial appraisal dated July 30, 2007, valued the
taking at $165,000.00. The County offered the owner $190,000.00 as the County's statutory offer
on August 29, 2007 which included a settlement incentive. No Order of Taking was entered
because Respondents objected to the fee interest taken. Instead, Respondents have agreed to settle
the case for $3,500.00 if the County agrees to accept a ten-foot temporary slope easement,
designated 130TSE, and a ten-foot perpetual, non-exclusive sidewalk, utility, street light and traffic
signal mast pole easement, designated as Parcel 130SW-U-SL-TSMPE. Staff is recommending
acceptance of this deviation because such deviation will place the County in the position of saving
$161,500.00.

GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners approve (1) a Second
Amended Declaration of Taking, and (2) a Stipulated Order of Taking and Final Judgment as to
Parcel130FEE, redesignated as Parcels 130TSE and 130SW-U-SL-TSMPE, and authorize payment
as stated.

Eminent Domain and Joint Motion made by Petitioner, COLLIER COUNTY, and Respondents,
FFT SANTABARBARA 1, LLC and FFT SANTA BARBARA II, LLC, by and through their
undersigned counsel, for entry of a Stipulated Order of Taking and Final Judgment, and it appearing
that proper notice was given to all persons having or claiming any equity, lien, title or other interest
in or to the real property described as Parcels BOTSE and 130SW -U-SL- TSMPE in the Amended
Petition in Eminent Domain, and the Court being fully advised in the premises, it is therefore
ORDERED AND ADJUDGED that:
1. This Court has jurisdiction of this cause, the parties hereto and the subject matter hereof.
2. The pleadings in this cause are sufficient and the Petitioner is properly exercising its
delegated authority.
