VACATE TIm COUNlY'S AND TIm PUBLIC'S INTEREST IN THE 10' WIDE
UTILIlY AND DRAINAGE EASEMENT LOCATED ALONG TIlE LOT LINE
COMMON TO LOTS 23 AND 24, TRACT 5, ACCORDING TO TIlE PLAT OF
"OLDE CYPRESS, UNIT TIlREE" AS RECORDED IN PLAT BOOK 32, PAGES
84 THROUGH 86, PUBLIC RECORDS OF COLLIER COUNlY, FLORIDA, AND
TO ACCEPT A RELOCATED 10' WIDE UTILIlY AND DRAINAGE
EASEMENT ON SAID LOTS 23 AND 24. LOCATED IN SECTION 21,
TOWNSHIP 48 SOUTH, RANGE 26 EAST.
WHEREAS, pursuant to Section 177.101, Florida Statutes, Douglas A. Lewis, Esq., of Roetzel &
Andress, as agent for the petitioners, Mark M. Savino and Cynthia A. Savino, does hereby request the
vacation of the 10' wide Utility and Drainage Easement located along the lot line common to Lots 23 and 24,
Tract 5, according to the plat of "Olde Cypress, Unit Three" as recorded in Plat Book 32, Pages 84 through
86, Public Records of Collier County, Florida, and to accept a relocated 10' wide Utility and Drainage
Easement on said Lots 23 and 24; and
WHEREAS, the Board has this day held a public hearing to consider vacating the 1 0' wide Utility and
Drainage Easement located along the lot line common to Lots 23 and 24, Tract 5, as more fully described
below, and notice of said public hearing to vacate was given as required by law; and
WHEREAS, the granting of the vacation will not adversely affect the ownership or right of convenient
access of other property owners.
NOW, TIlEREFORE, BE IT RESOLVED BY TIlE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNlY, FLORIDA, that the following be and is hereby vacated:
See Exhibit "A" attached hereto and incorporated herein.
BE IT FURTIlER RESOLVED BY TIlE BOARD OF COUNlY COMMISSIONERS OF
COLLIER COUNlY, FLORIDA, that the 10' wide Utility and Drainage Easement, more particularly
described in Exhibit "B" attached hereto and incorporated herein, is hereby accepted as a relocated easement
for the 10' wide Utility and Drainage Easement vacated herein.
BE IT FURTIlER RESOLVED, that the Clerk to the Board is hereby directed to record a certified
copy of this Resolution in the Official Records of Collier County, Florida, and to make proper notation of this
vacation on the recorded plat as referenced above.

UTILITY AND DRAINAGE EASEMENT
THIS UTILllY AND DRAINAGE EASEMENT, made the I"J.... day of October, 2000, by MARK M,
SAVINO and CYNTHIA A, SAVINO (collectively "Grantor"), to FLORIDA POWER AND LIGHT COMPANY, a
Florida corporation ("FP&L), SPRINT SPECTRUM, L.P" a foreign limited partnership ("Sprint"), cable television
Franchisc(s), as defined by Florida Statutes ~166,046,I(c), who provide Cable Scrvice, as defined by Florida
Statutes S 166,046,I(a) ("Cablevision"), OLOE CYPRESS MASTER PROPERTY OWNERS ASSOCIATION,
INC., a Florida non-profit corporation ("Olde Cypress"), and THE BOARD OF COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, as the governing body ofCollicr County and as ex-officio the governing board of The Collier
County Water-Sewer District (the "County"), their respective successors and/or assigns (collectively, hereinafter
referred to as "Grantee"),
WITNESSETH:
Grantor, in consideration of the sum of$10,OO in hand paid by Grantee, the receipt and sufficiency of which
is hereby acknowledged, does hereby grant, give and convey a perpetual non-exclusive easement beneath, under and
through that certain real property situated in Collicr County, Florida and more particularly described on Exhibit "A"
attached hereto (the "Easement Area") to (i) FP&L for purposes limited to the construction, installation, operation
and maintenance of underground electrical utility facilities, lines and cables, provided that no such construction,
installation, operation and maintenance shall interfere with the faCIlities of any other public utility (in the event
FP&L damages the facilities of a public utility, it shall be solely responsible for the damages); (ii) Sprint for
purposes limited to the construction, installation, operation and maintenance of underground telephone utility
facilities, lines and cables, provided that no such construction, installation, operation and maintenance shall interfere
with the facilities of any other public utility (in the event Sprint damagcs the facilities of a public utility, it shall be
solely responsible for the damages); (iii) Cablevision for purposes limited to the constructIOn, installation, operation
and maintenance of underground cable television or media utility facilities, lines and cables, provided that no such
construction, installation, operation and maintenance shall interferc with the facilities of any other public utility ( in
the event Cablevision damages the facilities of a public utility, it shall be solely responsible for the damages); (iv)
Oldc Cypress for the purpose of installation and maintenance of a drainage and utility easement with full
responsibility for maintenance, and (v) the County for purposes of a drainage easement, with no responsibility for
maintenance, provided that in all of the foregoing cases, Grantee's use of the Easement Area shall not be
inconsistent with use by the County as a County utility easement.
To have and to hold said easement unto Grantee and its successors and assigns forever,
Grantor hereby warrants that Grantor is the fee simple owner of the Easement Area and Grantor has full
power and authority to grant this easement.
Grantee and its assigns shall have the right to clear and keep clear all trees, undergrowth and other
obstructions that may interfere with the normal operation and maintenance of said facilities, out of and away from
the property described herein, provided that Grantee shall repair and restore the surface of the Easement Area and
landscaping thereon, including but not limited to plants, trees and shrubs, to the condition existing prior to any acts
by Grantee thereon, Grantor and Grantor's successors and/or assigns, agree not to build, construct or place, nor
permit others to build, construct or place any buildings or other structures on the Easement Area that may
unreasonably interfere with the normal operation or maintenance of any above-described facilities,
'Ibese covenants, terms and conditions shall attach to and run with the land, and are binding upon the
parties, their successors and assigns,

JOINDER. CONSENT AND SUBORDINATION TO
UTILITY AND DRAINAGE EASEMENT
Bank of America, N.A., a national banking association, being the owner and holder of that certain
Mortgagee recorded on August 25,2000, in Official Records Book 2715, Page 65, of the Public Records of
Collier County, Florida, which Mortgage encumbers the land described in the foregoing Utility and
Drainage Easement, hereby joins in and consents to the said easement. The joinder of the undersigned shall
be construed to be a subordination of the lien referenced herein to the easement granted, but in no other
manner shall it affect the priority of the lien ofthe undersigned's mortgage or the tenns thereof.
