EXECUTIVE SUMMARY
To request the Collier County Community Redevelopment Agency Board recommend that
in the Board of County Commissioners' Deeember 2, 2008 vote to approve a single Land
Development Code (LDC) amendment cycle for the 2009 calendar year to begin on March
I, 2009 and end on December 31, 2009 that thcy include LDC amendments submitted by
the Bayshore Gateway Triangle component of the Community Redevelopment Agency; and
consider any amendments to the Bayshore Gateway Triangle Mixed Use Overlay, if there
are any at that time. Companion to Item 16F _ (Fiseallmpact $3,000)
OBJECTIVE: For the Collier County Redevelopment Agency Board (CRAB) to recommend
that the Board of County Commissioners (BCC) include amendments to the LDC amendment
cycle for the 2009 calendar year as submitted by the Bayshore Gateway Triangle CRA and
consider any amendment to the Bayshore Gateway Triangle Mixed Use Overlay.
CONSIDERATIONS: The Bayshore Gateway Triangle component of the CRA has issued a
request for proposals to update the 10-year old CRA Redevelopment Plan. As part of that update,
the selected consultant will review and make recommended changes to the Bayshore Mixed Use
District (BMUD) and Gateway Triangle Mixed Use District (GlMUD) Overlays that were
adopted in 2005, incorporated into the CoJlier LDC and amended in 2006 and 2007.
- The purpose of this request is to request that the BCC to include the 'to be submitted'
recommend changes to the Bayshore Gateway Triangle CRA Overlays as may be deemed
necessary in the proposed 2009 LDC amendment cycle, and meet the LDC cycle schedule
requirements.
LEGAL CONSIDERATIONS: This item is consistent with Chapters 106 and 250 of the
Collier County Code of Laws and Ordinances, the Land Development Code, and Sections
125.01(1)(h) and 163.3161 et seq. Florida Statutes. The approval of the inclusion of the
Bayshore/ Gateway Overlay amendments into the amendment cycle is not quasi-judicial and
requires a simple majority vote. This item has been reviewed by the County Attorney's Office
and is legally sufficient for Board action, (MMSS)
FISCAL IMPACT: The CRA amendments will be subject to the applicable fee of $3,000 per
amendment plus all associated advertising costs, Fund 187 has sufficient funds to support the
LDC amendment process.
GROWTH MANAGEMENT IMPACT: CDES Staff, as part of the LDC review and vetting
process will assess the proposed amendments to the LDC for consistency with the Growth
Management Plan during the review portion of the cycle (approximately March 1, 2009 - June 1,
2009). Any LDC proposed amendments that may require an amendment to the Growth
Management Plan will be removed from the cycle and deferred until such time as any such
Growth Management Plan is adopted and becomes legally effective.
