Agenda 12/16/2008 Item #10N Agenda Item NO.1 ON December 16, 2008 Page 1 of 14 EXECUTIVE SUMMARY Recommend approval by the Board of County Commissioners to award Bid #09- 5148 to Subaqueous Services, LLC in the total amount of $1,755,096 for 2008 Dredging of Doctors and Wiggins Passes and approve all necessary budget amendments. OBJECTIVE: Award the 2008 dredging of Doctors and Wiggins Passes to Subaqueous Services for a contract value of $1,755,096. Award of this contract will allow this dredging of these two passes to be compieted before 5/1/2009, the start of turtle nesting season. CONSIDERATIONS: On November 3, 2008 Bid #09-5148 was posted and 155 inquires were sent out. Out of the 155 inquires, 71 packages were requested, and only 4 bids were received. Bids were opened on December 5, 2008. Bid results were as follows: . Millmac Corporation - $1,368,200 . American Marine and Construction, Inc. - $1,399,000 . All American Concrete, Inc. - $1,479,809 . Subaqueous Services, Inc. - $1,755,095.84 Coastal Planning and Engineering, our design professional has evaluated each bidder and is recommending the award of this contract to Subaqueous Services, Inc. for the following reasons: 1. Subaqueous Services is the only bidder with the record of knowledge and experience with projects similar in scope and complexity as Wiggins and Doctors Passes. 2. Millmac, the low bidder would need to purchase or rent the dredge with primary experience with smaller dredging projects in largely protected waters. 3. American Marine and construction does not have dredge experience and plans to subcontract out the dredging and monitoring while providing only project management. 4. All American Concrete would subcontract out the dredging and monitoring and did not provide sufficient information on references and past work experience. Past experience is that dredgers with inadequate equipment or experience risk not completing on time especially under winter wave conditions in the open Gulf. A Notice to Mariners warning of inadequate water depths at the mouth of Wiggins Pass has been posted for over 6 months. Dredging Wiggins and Doctors passes for safe navigation is critical in this period before turtle nesting season begins, ~- ADVISORY COMMITTEE RECOMMENDATIONS: The TDC by a vote of 7 to 2 at their November 24, 2008 meeting recommended that the contract be awarded to the lowest qualified and responsive bidder. This item was presented and discussed at the Coastal Agenda Item No. 10N December 16, 2008 Page 2 of 14 Advisory Committee (CAC) meeting on November 13, 2008. This will be presented to the CAC for final approval on December 11, 2008. COUNTY ATTORNEY FINDING: This item has been reviewed and approved by the County Attorney's Office. This item is not quasi judicial, and as such ex parte disclosure is not required. This item requires majority vote only. This item is legally sufficient for Board action. - CMG FISCAL IMPACT: The source of funds for this contract is Category "An Tourist Development Tax dollars. The original FY 09 approved budget for this contract in Beach RenourishmentlPass Maintenance Fund (195) totals $1,500,000 which is the amount recommended by the Coastal Advisory Committee and Tourist Development Council. The current bid submitted by Subaqueous totals $1,755,096 and a budget amendment totaling $255,100 or some lesser amount depending upon the final negotiated contract price will be necessary from Fund (195) reserves in order to fund this contract. Current Fund (195) budgeted reserves total $15,877,900 of which $9,500,000 is set aside by policy for future beach renourishment and any catastrophe events. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. RECOMMENDATION: That the Board of County Commissioners award Bid #09-5148 to Subaqueous Services, LLC for dredging of Doctors and Wiggins Pass at a cost not to exceed $1,755,096 and authorize the Board Chairman to execute the standard contract and approve all necessary budget amendments. In fact, this dredge company has worked on these Collier County inlets in the recent past. The other three bidders did not show experience dredging inlets exposed to the open Gulf weather using at least a 14" dredge. Two of the bidders do not own a 14 in dredge or larger, while the third did not submit any references or statement of capability with his bid. Each of the three claim to have personal experienced with larger dredges among their personal from previous companies, but their existing company was without this experience. Our past experience and that of Collier County's is that dredgers with inadequate experience or equipment risk not completing a project in a timely manner, especially under winter wave conditions, Milmac was the low bidder, and they propose to buy or rent a dredge and start dredging within 30 days of award. Milmac previous job experience has been with smaller dredging jobs largely in protected waters. Milmac provided addition written information, not submitted with their bid, claiming an ability to tackle open Gulf dredging using a larger dredge in a more difficult dredging environment. This information was not convincing and is not submitted. American Marine and Construction Inc does not have dredging experience, but plans to use National Hydraulics to perform the work. National Hydraulics does not have experience with dredges 14" or larger, but they plan to lease a 14" dredge, All American Concrete, Inc did not submit any references, experience or description of capability with their bid. Their submittal was unresponsive to the bidding requirements. They claim to be dredging a lake using a 14" dredge, and a harbor entrance on the west coast of Florida. Leased dredges and subcontracting some or all of the work is not uncommon in the dredging industry, but these practices can be risky if timely completion of the work is critical. For this reason, Subaqueous is Agenda Item No. 10N December 16, 2008 Page 5 of 14 the clear choice based on their extensive experience dredging inlets exposed to the open ocean using larger dredges. But Subaqueous can be a difficult contractor, requiring close supervision. If the cost saving using one of the lower bidders is critical, and the County can except the risk associated with using companies with limited larger dredge and open water experience, only then could the low bidder be accepted. The risk includes excessive delays and an incomplete project. Attached please find the results of interviews by CPE staff on the four bidders and references, I personally talked with Milmac and American Marine, soliciting additional information on their qualifications. I plan to develop additional information in the next few days. All American Concrete and American Marine seem to have the equipment and capability but iimited open ocean water experience, All American Concrete did mention they are currently working on a project in the open ocean and own a 14" dredge. National Hydraulic Dredge contracted by American Marine mentioned they plan on leasing a 14" dredge. Both companies All American Concrete and American Marine (National Hydraulic Dredge) are submitting references tomorrow regarding their most recent projects. All American Concrete. I spoke with Kevin (project manager) in reference to open ocean work experience in the Gulf of Mexico and experience with a 14" or larger dredge, According to Kevin they are currently working with the USACE on the Horseshoe Cove Turning Basin dredging project. This project is located in the Gulf of Mexico near Horseshoe Beach, Levy County, This project involves removing the shoais along the entrance channel and turning basin. The required dredging depth is 6 feet. The total quantity to be dredged is about 69,000 cubic yards of material. The dredged material is being placed at an upland disposal area located about 2 miles from the project site. The other dredging project Kevin mentioned was a project in Pinellas County that involved the dredging of a lake. This project involved dredging approximately 1 million cubic yards with a 14" dredge. According to Kevin the current owner does have experience with dredges that are 14" or larger and open ocean work experience when he worked at a different company. Kevin Agenda Item NO.1 ON December 16, 2008 Page 6 of 14 mentioned they own a 14" dredge and will provide me with their most recent projects that are similar to the bid project (Wiggins Pass). For this project they plan on dredging material at a rate of 1600 to 2000 cubic yards per day. Subaqueous Services, LLC - I spoke with Curtis Huggins (president) in reference to open ocean work experience in the Gulf of Mexico and experience with a 14" or larger dredge. According to Curtis they were the contractor to work on the last Wiggins Pass dredging project and they have much experience working in the open ocean: to list a few: Wiggins Pass, Tampa, Jupiter Inlet, and Sebastian Inlet. Curtis mentioned that they have experience working with 14" or larger dredges, They currently own four 16" dredges, a 24" dredge, and 12" dredge. For this project they plan on using two 16" Ellicott dredges. Curtis mentioned the subcontractors listed in the Bid will be used for survey, and refueling, America Marine & Construction. INC - I spoke with Bob Day in reference to open ocean work experience in the gulf and experience with a 14" or larger dredge. According to Bob he has experience with working in the open ocean and mentioned working on the artificial reef construction project for the City of Naples. During this project he worked with Gunderboom & Center Contracting. Bob Day will provide the GC license for American Marine Construction. They plan on hiring National Hydraulic Dredge, and Earth Tech to perform the beach nourishment. Bob mentioned they plan on using two dredges to perform work which include a 14" Ellicot Hydraulic Dredge and a 12" dredge. Bob indicated he has experience with a 12" hydraulic dredge but no experience with a 14" inch or larger hydraulic dredge. In addition Bob mentioned on a good day with fair weather they plan on dredging about 1800 cubic yards per day. According to Sam from National Hydraulic Dredge his staff does have experience with working in the open ocean and dredges that are larger then 14". Sam mentioned National Hydraulic Dredge does not have work experience in the open ocean or with a 14" dredge, but his staff does. Sam explained that since Hendry Corp went out of business they have acquired staff members from Hendry Corp along with equipment. Sam submitted a resume of one of his employees that will be working on the project (see attached). Sam mentioned they plan on leasing a 14" dredge and will provide me with their most recent projects that are similar to the bid project (Wiggins Pass). Roger W. According to Jamel the nature of the project that Millmac performed for Smith Warner was a 15,OOOCY dredge and fill project. (Jamel was not completely sure of the volume). The contract was for the dredging of nearshore silty sand and placement to create a beach and a shallow swimming area. The area that they were required to dredge was 440 meters x 30 meters. The depths in this area were between 0.5 meters and 1 meter and they were required to dredge to between 1.5 and 2 meters. Jamel said that Millmac performed slower than expected and that their dredging rate was slower than expected. Jamel expected that their slow performance was due to the fact that they were performing shallow dredging over a wide area and they needed to move the dredge every 15 to 20 minutes. According to Jamel, the job was not completed satisfactoriiy. However, he stated that there were surveying inaccuracies on the part of Smith Warner and that he would not completely blame Millmac for the incomplete job. Jamel would consider that the job did not end so well and that Millmac was not interested in staying around to fully complete the project. I asked Jamel if he would use them again and he said yes, under different contract conditions. He mentioned that the job was sole sourced and that if Millmac is properly monitored he would recommend them. Phone Call October 2, 2008 12:00am City of Holmes Beach - Joe Dunnes - Holmes Beach 941-708-5800 x229 Joe indicated that Millmac had worked on three dredging projects for the City of Holmes Beach. These projects were navigation channel dredging projects with truck haul to upland deposition sites. He indicated that he has had all positive experiences with Millmac that they have kept him apprised of every situation during the work. Joe stated that the employees are pleasant to work with and that he has had no problems with them whatsoever. I asked if they complete their projects on time. Joe indicated that this year they had difficulty in mobilizing to the site - they were late because their previous job had run long - but that they kept him informed and that in each of the previous years they had been on time. Each year they have demobilized from the site on time as well. This year the volume dredged at Holmes Beach was 9,000cy but in previous years the volumes dredged were 15,OOOcy each year. He would use them in the future and says that all their jobs for the City of Holmes Beach have been completed successfully. Agenda Item No.1 ON December 16, 2008 Page 8 of 14 Disnev Cruise Lines - lief! a message with Bert Swets and one with Dianne Gafney (FL contact) I will continue to attempt to reach them both. I spoke with Bert Swets VP Marine and Tech Op. for the Disney Cruise Line, in reference to the Beach Renourishment project in Castaway Cay, Bahamas. Bert seemed very enthusiastic and pleased with the contractors work. Bert mentioned Millmac was very professional, and he would hire them again. According to Bert the work was performed by a cutter head dredge and Millmac placed 100,000+ CY's of sand within the project area and provided additional back fill in case of future storm events. Actually he said they gave them extra back fill so I assume this extra fill was free of charge. Bert indicated the work was completed quicker then anticipated. Bert indicated that the work was not easy. The contractor had to work around the operations of the cruise ships, and he indicated the mob was not easy. Bert mentioned that the contractor was able to adjust well with these and other issues that were not anticipated. I asked if they would hire again, and Burt responded absolutely and that Millmac was very professional. It is our understanding that Collier County and Coastal Planning and Engineering have some reservations concerning awarding this contract to our company. To allay these fears, we offer the following pertinent information. It should be noted for the record that Millmac Corporation has been asked to provide certain information verbally by Mr. Steve Keehn, not in writing. We have been told that he needs information today (end of business day) as he is making his recommendation tonight. I have verbally protested this course of action because I fear that a decision to bar Millmac from performing this work will be made without one interview of key personnel, calling any customers, any requests for financial information or other items that are germane to this decision. Weare qualified to perform this work, and ANYONE who claims that we are not is ignoring important facts. The Specification and Bid 1. Millmac's price was the lowest of the four that were offered. The next closest bidder was within 3 percent of our price. Therefore, the market indicates that our price is reasonable for this type of work. All of the required documentation was submitted with our bid, and /here were no questions or indications at /he bid opening /hat we were disqualified due to any technicality wi/h our bid submission. Millmac, on /his date, has been asked to submit additional information, in care of Mr. Keehn, so /hat Mr. Keehn can make his recommendation. To that end, we offer /he following: The Equipment The county has specified a 14 inch dredge to perform /his work. Millmac presently owns a dredge (Margaret Jean) /hat can properly perform this work. However, because the specification indicates that a 14 inch dredge is /he required equipment, Millmac is complying wi/h the request to do /he work with this specific equipment. Millmac has ordered and will be receiving a new Ellicott, Series 670, 14 inch dredge. It is /he largest portable 14 inch dredge available. It is perfectly suitable to perform all aspects of this job. This required work is somewhat special because not only is /here shallow draft work but inlet work is also involved. This dredge is ideal for this project because it is small enough to go inside and do the navigational canals, yet it is also large enough to withstand the anticipated average weather days for the inlet work. We respectfully request that you contacl Mr. Steve Miller, of Ellicott Dredge at (cell 410-302-4348). The county specified the size of the dredge and the timeframe for completion of the work. This was not an option open to the contractor. It is interesting to note that none, repeat none, of the four contractors that responded to this RFQ has a 14 inch dredge in stock, ready for use. The specification does not state "at least a 14 inch dredge," it must be exactly a 14 inch dredge. Our dredge will be fully built and ready for delivery the second week of January. We offer to fly a representative to the factory to see this and similar dredges now complete. We want you to gain an appreciation for /he quality and workmanship of this equipment. The Dredl!inl! Contractor Millmac Corporation has been in business since 2000. Michael Miller is the sole owner. His resume has been previously submitted. He will be the lead project manager / engineer / superintendent on this job. Mr. Miller, along with his team consisting of Witliam Leeds and Tudor Truica, have a combined 85 years of dredging, marine construction, and marine repair experience. Our dredgemasters, who will be operating the dredge, have over 8 years of experience on this specific dredge and over 20 years of dredge operations in dredges ranging from 26 inch down to 8 inch. It was not requested, but we can provide complete resumes on our dredgemasters, if needed. One of our team members, Mr. Charles Kehm (Cell Phone (305) 968-2242), our designated harbonnaster and marine watercraft captain, has over 30 years of marine and small craft experience. He is the past marine pilot for the Turks and Caicos Islands, owned and operated an inter-island ferry service and operated the largest fleet of charter vessels in the area. In addition to the above senior staff, we have Paul DeMariano (cell 813-765-8587), whom you may know as the past port director to Port Everglades and Jacksonville, Florida. He has been directly involved in dredging operations that exceed millions of cubic yards of material. Please take note that Millmac has successfully perfonned teclmically difficult "open ocean" projects, while using smaller equipment than has been specified. Our 8 inch dredge "Bette Jean" perfonned coastal dredging and beach restoration work for Disney Cruise Line's Castaway Cay. The Family Beach is fully exposed to the ocean, and the dredge and crew perfonned well within the requirements of Disney. Millmac has performed "open ocean" dredging on the north coast of Jamaica for Iberostar Resorts. The dredge was fully exposed to swells, currents, and tides and perfonned well within the requirements of the project owner. Millmac is currently perfonning dredging operations for Gulf Copper Drydock and Rig Repair on a continuous basis using our Dredge "Margaret Jean." The dredge "Margaret Jean" is very stout, as evidenced by withstanding the full forces of Hurricane Ike (September 2008) with no damage.
