EXECUTIVE SUMMARY
Recommendation to approve Petition AVESMT-2008-AR-13809, to disclaim, renounce and
vacate the County's and the Public's interest two drainage easements which were
originally created in Official Record Book 2130, Pages 1078-1081 and shown on the plat
of Fiddlers Creek Phase Four, Unit Two, as filed in Plat Book 45, pages 40-47 of the
Public records of Collier County, Florida situated in Section 11 & 14, Township 51 South,
Range 26 East, Collier County, Florida, the vacated easements being more specifically
depicted and described in Exhibit "A".
OBJECTIVE:
To adopt a resolution vacating two drainage easements as described and originally created in
Official Record Book 2130, Pages 1078-1081 and shown on the plat of Fiddlers Creek Phase 4,
Unit 2 in Plat Book 45, pages 40-47 of the Public Records of Collier County, Florida, situated in
Section 11 & 14. Township 51 South, Range 26 East, Collier County, Florida, the vacated
easements being more specifically depicted and described in Exhibit "A";
CONSIDERATIONS:
Petition AVESMT-2008-AR-13809, Fiddlers Creek Phase 4, Unit 2, has been received from
Carrie Lademan, Esq. of Woodward, Pires & Lombardo, PA as agents for GB Peninsula, LId.,
Petitioners. This vacation request is intended to remove two drainages easements that no
longer serve their intended purposes. Both easements have become unnecessary as
reconfiguration by the platting process has made these easement obsolete. All adjoining
property owners and required entities have been notified and no letter or response of objection
has been presented. Staff thereby recommends approval.
FISCAL IMPACT:
Engineering and Environmental Services staff has collected a $2,000 "Petition to Vacate" fee
from the petitioner which covers the County's cost of recording and processing the Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.
HISTORICAL/ARCHAEOLOGICAL IMPACT:
There are no known historical or archaeological impacts.

This item has been reviewed for legal sufficiency and is legally sufficient for Board action. This
matter is quasi-judicial and as such requires ex parte disclosure and requires a majority vote

RECOMMENDATIONS:
To adopt a resolution vacating two drainage easements as described and originally created in
Official Record Book 2130, Pages 1078-1081 of the Public Records of Collier County, Florida,
situated in Section 11 & 14, Township 51 South, Range 26 East, Collier County, Florida, the
vacated easements being more specifically depicted and described in Exhibit "A";
Authorize the Chairman to execute the Resolution and direct the Clerk to the Board to record a
certified copy of the Resolution in the Public Records, and to make proper notation of this
vacation on the recorded plat as referenced above.

OF COLLIER COUNTY, FLORIDA, RELATING TO PETITION
AVESMT-2008-AR-13809, DISCLAIMING, RENOUNCING AND
VACATING THE COUNTY'S AND THE PUBLIC'S INTEREST IN

OFFICIAL RECORD BOOK 2130, PAGES 1078-1081 AND SHOWN
ON THE PLAT OF FIDDLER'S CREEK PHASE FOUR, UNIT TWO,
AS FILED IN PLAT BOOK 45, PAGES 40-47 OF THE PUBLIC
RECORDS OF COLLIER COUNTY, FLORIDA, SITUATED IN
SECTION 11 & 14, TOWNSHIP 51 SOUTH, RANGE 26 EAST,

WHEREAS, pursuant to Section 125.01 and 125.37, Florida Statutes, Petitioner,
GB Peninsula, Ltd., has requested the vacation of the County's interest in two drainage
easements, originally created in Official Record Book 2130, Pages 1078-1081 of the
Public Records Collier County, Florida, situated in Section 11 & 14. Township 51 South,
Range 26 East, the easements to be vacated are being more specifically depicted and
described in Exhibit 'A'; and
WHEREAS, the Board has this day held a public hearing to consider petitioner's
request, and notice of said public hearing was given as required by law; and
WHEREAS, the granting of the Petitioner's request will not adversely affect the
ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in the
drainage easements as specifically depicted and described in Exhibit 'A' are hereby
vacated, extinguished, renounced and disclaimed, and this action is declared to be in
the Public's interest and for the Public's benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of this Resolution in the Official Records of
Collier County, Florida, and to make proper notation of this vacation on the recorded
plat as referenced above.
This Resolution adopted after motion, second and majority vote favoring same,
this day of , 2009.

WHEREAS, pursuant to Section 125.01 and 125.37, Florida Statutes, Petitioner,
GB Peninsula, Ltd., has requested the vacation of the County's interest in two drainage
easements, originally created in Official Record Book 2130, Pages 1078-1081 of the
Public Records Collier County, Florida, situated in Section 11 & 14, Township 51 South,
Range 26 East, the easements to be vacated are being more specifically depicted and
described in Exhibit 'A'; and
WHEREAS, the Board has this day held a public hearing to consider petitioner's
request, and notice of said public hearing was given as required by law; and
WHEREAS, the granting of the Petitioner's request will not adversely affect the
ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in the
drainage easements as specifically depicted and described in Exhibit 'A' are hereby
vacated, extinguished, renounced and disclaimed, and this action is declared to be in
the Public's interest and for the Public's benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of this Resolution in the Official Records of
Collier County, Florida, and to make proper notation of this vacation on the recorded
plat as referenced above.
This Resolution adopted after motion, second and majority vote favoring same,
