PROCLAMATION I RESOLUTION NO. 2001.~
PROCLAMA nON OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY TO DECLARE A STATE OF EMERGENCY FOR ALL TERRITORY
WITHIN THE LEGAL BOUNDARIES OF COLLIER COUNTY INCLUDING ALL
INCORPORATED AND UNINCORPORATED AREAS
WHERAS, more than 1400 fires burning over 100,000 acres have occurred since January 1, 2000
in Florida; and
WHERAS, the effect of an extended lack of rainfall over the past two years coupled with below
normal temperatures has the potential for causing widespread danger to property, livestock and lives; and
WHERAS, the limited surface water supply limits the ability of flJ'efighters to combat wildland
fires; and
WHERAS, the lack of rainfall, which could replenish depleted water sources, adds to the severity
of the drought and wildfire threat; and
WHERAS, Chapter 252.38 (3)(a)(5), Florida Statutes, provides authority for political
subdivisions, such as Collier County, to declare a State of Local Emergency and to waive the procedures
and formalities otherwise required of political subdivisions in order to take whatever action is necessary to
ensure the health. safety and welfare of the community; and
WHERAS, Collier County Ordinance 84-37, states that when a quorum of the Board of County
Commissioners is unable to meet, the Chairman of the Board of County Commissioners. or the vice-
Chairman in his or her absence, or the County Manager in the absence of the Chairman or vice-Chairman is
authorized to declare a State of Local Emergency.
NOW THEREFORE, IT IS RESOL VED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, in regular session, this 27lh day of
February, 2001, that the prolonged drought and the extreme wildfire behavior threat in Collier County
poses a serious threat to the lives and property of residents and guests of Collier County and that a State of
Local Emergency shall be declared effective this date for all unincorporated and incorporated areas within
the legal boundaries of Collier County, Florida.
BE IT FURTHER RESOLVED, that the Board of County Commissioners hereby exercises its
authority and waives the procedures and formalities required by law of a political subdivision, as
authorized under Chapter 252.38. Florida Statutes. Further that the Board of County Commissioners shall
consider extending this State of Local Emergency for additional seven day increments as long as conditions
warrant.
This Proclamation adopted after second and majority vote favoring the same.
