to change the zoning classification of the herein described real property.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE:
The zoning classification of the real property as more particularly described by Exhibit
"A", attached hereto and incorporated by reference herein, and located in Section 23, Township
50 South, Range 25 East, Collier County, Florida, is changed from Residential Multi-Family-6
(RMF-6) and Commercial Intermediate (C-3) Zoning Districts to a Community Facility (CF)
Zoning District, and the appropriate zoning atlas map or maps, as described in Ordinance 2004.

1. The Master Plan provided is considered conceptual in nature. Development of the
parking area shall be consistent with the LDC requirements at the time of site
development plan (SDP) review and approval.
2. Access lighting to illuminate the site's Bay Street pedestrian crosswalk shall be
required at the time of SDP review and approval.
3. Parking lot areas shall be composed of a porous material, such as pavers or
another similar type of approved porous material that do not produce airborne
dust.
4. Irrespective of that depicted on the Master Plan, a masonry wall, as required by
Subsection 5.03.02.E of the LDC, shall be provided to separate the parking lot
from adjoining residential uses.
5. The hours of operation shall be posted on the site, and a locking gate shall be
secured at all times outside of these operating hours.

We who live in the area of Bayview Park have a clean, quiet, peaceful neighborhood. It seems to uWOr-r .
that for that to be changed there should be either a serious public need or a pressing problem that can r,r- tip OV"fA.
be solved in no other way. Neither of those conditions exists. If there were a serious enough need the
county would be able to invoke eminent domain. It hasn't and won't. A parking lot is hardly worthy of
that. Also, there is no pressing need for the drastic action which has been proposed which would, in our
opinion and in the opinion of the Planning Commission and its Staff, do grave harm to our quality of
Iife,be totally incompatible with the current character and use of this residential neighborhood, have a
strong potential for reducing our safety, and undoubtedly would have a negative effect on the value of
our property.
We fully support the plan to re-design of the Park to increase the number of trailer parking spots from
16 to 40. This would make parking outside the Park rare on weekdays and usually unnecessary on
weekends.We are not anti-boater. Several of us are or have been boat owners.
We oppose this requested zoning change for the following reasons:
l.IT IS UNNECESSARY. Mr. McAlpin presented to the Planning Commission a figure of an average of S6
launches per out-of-season weekday based on counting strips laid across the road which we who live
there know to be a gross exaggeration. We actually sat in the Park on a beautiful FrL in season,Jan.9,
and counted both launches and haul-outs throughout the day. We counted 4S launches with there
never being nearly that many in the water at the same time.We have also taken pictures on Sun.,Jan.25
which show about 8-9 boats parked along Hamilton Ave. between 3-4Pm. This means that at most there
were 45 boats launched at this time{hardly the 112 average claimed by Mr.McAlpin). With 40 spots in
the Park only 5 would have had to park along the mangroves just outside the Park.
2.INEFFECTIVE. The proposed lot is more than 1/3'" of a mile from the Park, hardly closer than Hamilton
Ave.
3.SAFETY. There is no current safety problem. A representative from the Sheriff's Dept. has said that
there is rarely a problem or complaint. Indeed, we feel that the proposed changes would make the
neighborhood less safe with a thoroughfare being cut between homes which would necessitate trailers
making 2 more turns, increased traffic on Bay St., strangers walking between and behind homes, and the
potential for loitering and littering in the parking lot next to and behind homes.
4.COMPATIBllITY.This proposal to chop up our neighborhood by cutting a thoroughfare through the
middle of the block, tearing down new(3-4 years old)homes to make a parking lot, either installing
intrusive lighting or omitting it thereby making the increased trailer and foot traffic through the area
more dangerous, and erecting fences and/or high walls is entirely incompatible with the current use and
character of the neighborhood which constitute violations of the Growth Management Plan and would
cause serious detriment to our quality of life. Some things which mr. McAlpin suggests are
contradictory. Since fences would not protect our privacy he offers to build walls as high as necessary to
do so. By code, new homes have first floors 10' above the water line. Walls over 10' high would only
exacerbate the incompatibility with the current nature of this residential neighborhood. The specific
violations of the GMP are cited in the minutes of the Planning Commission as major reasons for voting
down the requested zoning change.
5. EFFECT ON PROPERTY VALUES. All of the above, as cited in the Planning Commission minutes which I
am including at the end of my remarks, will make future development less attractive thereby negatively
affecting home values which is also in violation of the GMP. Parks and Recreation personnel know this
and this, we feel, is exactly what they want. They can't invoke eminent domain. This plan would drive
down home values making it easier to persuade owners to sell. This amounts to back door eminent
domain.

Planning Commission Staff recommended DENIAL of this zoning request.
On Dec. 4,2008 the Planning Commission voted down this request by a 6-2 vote,
On Jan. 21, 2009 Parks and Recreation Dept.'s own Advisory Board DENIED Mr.McAlpin's request for a
recommendation to proceed with this plan.
These agencies aren't anti-boater and neither are we. With increased parking in the Park, new parking
becoming available in Isles of Capri, and the recent purchase of Port of The Islands, we feel there is no
need to ruin a neighborhood.

individual reasons, if you're going to vote no, and that you actually look at the criteria set forth in the staff
report and base it on that.
CHAIRMAN STRAIN: You didn't give me a chance to get there, but I will do so right now.
I will be voting against this proposal. I will state my reasons now because they're lengthy and
there's no sense of saying it numbers of times.
First of all, I want to set some criteria for all of you. I know we all realize, but maybe the public
doesn't. TIle purchase of this land, in my discussions, in my meetings with Mr. McAlpin and Ms. Dejohn
when I asked was this on the consent or summary agenda, I was told it was on the consent aJl;enda.
Now, if you know anything about the BCC agenda, the consent agenda is one of those massive
pages of items that they just votc on in blank. They say okay. And it's not always as openly debated in the
public when it's on a consent agenda item.
Also, I'm concerned that this is a setup for future buy-outs. Right now property mices are
established ba.ed on a residential nei uttin in this kind of u 0 one's oin
to live by it. So ueS!: what. other properties out at a better price.
e would ne.ver ever consider this if a private developer was doing it. And government is not
above the law and they shouldn't be III this case.
There were discussions here today. There's been no proven environmental problem. They're within
a 6O-foot right-of-way.
The safety issw: that tbey keep harping on is going to be exasperated (sic) more by the parking lot
this further dis~y than it is now.
And we also heard tbat we are still going to have people probably parking on the side of the road.
So nothing is accomplished in what thcy believe are the accomplishments by making this purchase.
So I have a series of lengthy discussion to tell you why I'm going to be voting against this proposal.
If you want to piggyback on the back of it, that's up to you all. But I'm going to teU you what they are and
then we'll be looking lor a motion.
In the CCME we have Policy 12.2.7; it says the county shall continue to assess all undeveloped
property within the coastal high hazard. P", 0'A."':J -
Well, this was acknowledged in testimony, it's develope~ So that's inconsistent with CCME
Policy 12.2.7.
Recreation open space Policy 1.1.5 states, the correct gr imnTlJVe existing parks and recreation
facility deficiencies which are necessary in order to meet the level of service standards.
We have not seen anything that says this is the only alternative in which to meet the level of service
standards. And I surely think that destroying a neighborhood does not make it necessary.
Policy 1.3.1 of the recreational and open space says, county owned or managed parks and
recreational facilities shall abide by all bicycle and pedestrian access where location is appropriate.
This is absolutely inappropriate, as clearly stated to us by Collier County staff as being
incompatible with the neighborhood.
Recreation and open space Policy 1.4.2 states, that Collier County shall continue to coordinate with
the provision of recreational facilities and activities with other governmental jurisdictions that own or
operate such a facility. Such governmental entities shall include but not necessarily be limited to the City of
Naples.

by a way to get in and out of that parking lot. I don't believe if someone pulling a trailer's going to use the
worst route there, they're going to use the easiest route there. Plus it creates a highly unsafe condition on
i Danford Street, more so than they currently have today. So we actually are aggravating the situation, not
bettering it.
~ Whether the proposed change would adversely affect property values.
I r No doubt, the property values will be affected negatively.
Whether the proposed change would be a detriment to the improvement or development of adjacent
properties.
* Obviously very few people are going w want to live next to a parking lot. And the additional safety
hazards on that street will probably make sme people with children don't move there.

. Well, I think it grants a special privilege w government, one way and ahove anybody in the priv~
sector could possibly have in a residential neighborhood.

There is no reason. In met, there are two CO's, developed existing homes on that property, showing
it could be used.

Whether it's possible to find other adequate sites in the county.
We already know there is. In fact, there's been numerous sites proposed to the BCC. Some have
been turned down, some have been taken. Most recently they're considering the one at Port of the Isles.
Number 18, such other factors, standards or criteria. the Board of COlnlty Commissioners shall
deem important.

previously discussed at the prior NIMs were re-discussed, but no new issues were raised. In the end,
the attendees remained adamantly opposed to the project; and the meeting was ended at 7:15 p.m.
Staff has received a total of 17 letters of objection to the project from 14 different property owners,
which as previously noted, have been included in Appendix 5.
SUMMARY:
Staff anticipates that the proposed change to the CF Zoning District from the RMF-6 and C-3 zoning
districts would have an adverse impact upon living conditions in this redo 'nantl residential
neighborho~ . As noted, staff believes that l!a r er par mg should instead be expanded on the
COWlty-owned park site itself and not pennitted to overflow into the neighborhood unless It could be
accomplished by the appltcants' successful consolloatlon 01 the three neIghborhood properties within
the allowable C-3 Zoning District. This would also eliminate the need for the proposed access road
through the neighborhood. Due to the failure of the project to adequately address compatibility issues
with the neighborhood in which it is llfonosed to be located, staff finds the proposal to be
incompatible the provisions of the LDC and, in particular, with Polley 5.4 of the FLUE and Policy
I.J.I ot the ROSE._..---
STAFF RECOMMENDATION:
The Zoning and Land Development Review staff recommends that the CCPC forward Petition RZ-
2008-AR-12930 to the BCC with a recommendation of denial. However, should the CCPC choose to
forward the petition with a recommendation of approval, staff suggests that it be contingent upon the
following conditions:
1. '["he Master Plan provided is considered conceptual in nature. Development of the parking area
shall be consistent with the LDC requirements at the time of site development plan (SDP)
review and approval.
2. Access lighting to illuminate the site's Bay Street pedestrian crosswalk shall be required at the
time of SDP review and approval.
3. Parking lot areas shall be composed of a porous material, such as pavers. or another similar type
of approved porous material that do not produce airborne dust.
4. Irrespective of that depicted on the Master Plan, a masonry wall, as required by Subsection
5.03.02.E of the LDC, shall be provided to separate the parking lot from adjoining residential
uses.
5. The hours of operation shall be posted on the site, and a locking gate shall be secured at all
times outside of these operating hours
