Notice is hereby given that the Board of County Commissioners of Collier
County will hold a public hearing on Tuesday, January 27, 2009, in the
Boardroom, 3rd Floor, Administration Building, Collier County Government
Center, 3301 East Tamiami Trail, Naples, Florida. The meeting will begin
at 9:00 A.M.
Petition: ADA-2007-AR-12312, S. Melissa Ross Trust, represented by Cheffy,
passidomo, Wilson & Johnson, LLP, requesting an Administrative Appeal
regarding the decision of the Lot Line Adjustment for property located on
Lot 28 in Olde Cypress, application number LLA-2007-AR-12140. The
applicant is appealing the decision pursuant to 250-58 of the Collier
County Code of Laws and Ordinances. The applicant proposes that according
to 4.03.04 and 10.02.02.B.8 of the Land Development Code the Lot Line
Adjustment decision should be reversed.
NOTE: All Persons wishing to speak on any agenda item must register with
the County Administrator prior to presentation of the agenda item to be
addressed. Individual speakers will be limited to 5 minutes on any item.
The selection of an individual to speak on behalf of an organization or
group is encouraged. If recognized by the Chair, a spokesperson for a
group or organization may be allotted 10 minutes to speak on an item.
Persons wishing to have written or graphic materials included in the Board
agenda packets must submit said material a minimum of 3 weeks prior to the
respective public hearing. In any case, written materials intended to be
considered by the Board shall be submitted to the appropriate County staff
a minimum of seven days prior to the public hearing. All material used in
presentations before the Board will become a permanent part of the record.
Any person who decides to appeal a decision of the Board will need a
record of the proceedings pertaining thereto and therefore, may need to
ensure that a verbatim record of the proceedings is made, which record
includes the testimony and evidence upon which the appeal is based.

I just checked all of our stuff and we have that one and the AOA-2007-AR-12312, Old Cypress _ Lot
28. I am thinking that they forgot to put them in. Both of these were signed off by Susan, so I'm not

have gotten pulled or forgotten?? They did run as scheduled in NON on 1/11/09 as we already

WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and
such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC)
(Ordinance 04-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County, among which are provisions for granting lot line
adjustments; and
WHEREAS, the owner of Lot 28 within the Olde Cypress Unit Three plat applied for a
lot line adjustment (LLA) pursuant to LDC Sections 4.03.04 and 10.02.02.8.8; and
WHEREAS, County Staff determined that, pursuant to LDC Sections 4.03.04 and
10.02.02.8.8, Lot 28 and the Olde Cypress Unit Three plat did qualify for a LLA and therefore
granted the LLA application; and
WHEREAS, the Petitioner, owner of Lot 29 immediately west of Lot 28, duly appealed
the decision of County Staff granting the lot line adjustment pursuant to the Collier County Land
Development Code to the Collier County Board of Zoning Appeals.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA that:

I've been trying to get confirmation on a setback issue on my lot in Olde Cypress, and was wondering if
you could help me out again. I talked to you about the chord vs. radius setback issues before (per emails below)
and I am trying to confirm the side yard setbacks. The lot address is 2949 Lone Pine Lane and the legal is Olde
Cypress Unit 3, Tract 5, Lot 28.
It appears from the Olde Cypress PUD (Ord 99-92) (relevant pages attached) that the lot is probably
designated Single Family Detached, although we originally received information from the County that the lot was
designated zero lot line. The lot is also located on a cul-de-sac, so it is my understanding that I have 2 front yards
and 2 side yards, instead of a rear yard. If that is accurate, then the setbacks for a Single Family Detached
designation would be 25' on the 2 fronts and 5' on the 2 sides. However. I was informed that if the side yard at
the "rear" of the lot had a platted drainage easement of 10', the side setback would be the 10' easement area
instead of 5'. There is a 10' platted easement (PB 32, pg 86) (relevant portions of plat attached) along the rear of
the lot, but is a golf course easement. not a drainage easement. . Also. the rear of the lot i!} preserve, not golf.
course. The developer has informed me that they will execute wfiatever aocumentation is required to waive any
rights as to the golf course easement.
What documentation would the County require, if any, from the developer to effectively waive any rights
reserved in the golf course easement to allow me to use the 5' side yard setback instead of the 10' platted
easement setback? I do not want to build any part of the actual home in the 10', but would like to extend the
lanai, pool and screen cage.
If no documentation is necessary, can you confirm that the 5' side yard setback can be utilized on the
"rear" of the lot? If easier. I would be happy to come down and discuss this with you in person. Thanks again for

more detail.

shortest street frontage. In all zoning districts, except the E (estates)
zoning district, the setback requirement for the remaining front yard(s)
shall not be reduced by more than 50 percent of the full front yard setback
requirement for that district. exclusive of any road right-of-way or road
right-of-way easement. Additionally, in the E (estates) zoning district
only. the setback requirement for the remaining front yard(s): (i) shall not
be reduced to less than 15 feet, and (ii) shall not include any road
right-of-way or road right-of way easement within the reduced front yard.
In the case of shoulder lots which conform to the minimum lot width and area requirements
of the zoning district, the required front yard adjacent to the longest street may be reduced by
five feet providing that in no case may this yard be less than 25 feet.
In the case of through lots, unless the prevailing front yard pattern on the adjoining lots
indicates otherwise, a full depth front yard shall be provided on all frontages. Where one of the
front yards that would normally be required on a through lot is not in keeping with the
prevailing yard pattern, the development services director may waive tbe requirement for the
normal front yard and substitute therefore a special yard requirement which shall not exceed
the average of the yards provided on adjacent lots.
Depth of a required front yard shall be measured so that the yard established is a strip of the
mirnmum width required by the district regulations with its inner edge parallel to the front lot
line. In the cases of irregularly shaped lots, including culs-de-sac, the depth may be measured]
at right angles to a straight line joining the foremost points of the side lot line, provided the '*
depth at any point is never less than the minimum length of a standard parking space as
established within section 2.3.4. of this Code.
However, in the Golden Gate Estates Subdivision, unimproved perimeter and bisecting access
easements, or improved access easements serving three or fewer lots of record, shall not
constitute a front yard for the purpose of establishing building setback lines.
Where lots in residential districts comprising 40 percent or more ofthe frontage on one side of
a street between intetsecting streets are developed with structures having an average front
yard with a variation of not more than six feet, no building thereafter erected shall project
beyond the average line so established. This provision applies in all residential zoning districts
and to all residentially designated areas.
Yard, rear: The required open space extending across the entire width of the rear yard between
the inside lines of the side yards and except in corner lots is generally that lot line most
opposite the right-of-way line.
When dealing with irregularly shaped lots where a typical rear lot line cannot readily be
defined the site development review director will determine the rear lot line for the purposes
of establishing yard requirements.

In the case of through lots and corner lots, there will be no rear yards, but only front and side
yards. Depth of a required rear yard shall be measured so that the yard established is a strip
of the minimum width required by zoning district regulations with its inner edge parallel to
the rear lot line.
Yard, side: The required open space extending along each side lot line between the rear lines
ofthe required front yard and the rear lot line, or in the absence of any clearly defined rear lot
line, to the point on the lot farthest from the rear line of the front yard.
In the case of through lots, side yards shall extend from the rear lines of required front yards.
~ In the case of corner lots. yards remaining after front yards have been established on both
frontages shall be considered side yards.
Yard, special: A yard other than one adjacent to a public right-of-way performing the same
functions as a side or rear yard, but so placed or oriented that neither the term "side yard" nor
the term "rear yard" clearly applies. (See Front yard, Side yard, Rear yard, or section 2.6.4).
The site review development director, or his designee, shall determine which lot line is front,
side or rear for purposes of determining yard requirenlellts.
Yard, wale/front: The required open space extending along the entire waterfront property with
depth measured from property line. bulkhead, shoreline, seawall, mean high water mark,
access eaS€lnent, whichever is the most restrictive. Waterfront property is hereby defined as
pmperty abutting on the Gulf of Mexico, bays, bayous. navigable streams. and on man-created
canals. lakes, or impounded reservoirs. For the purpose of this ordinance, the minimum
setback for any principal or accessory structure adjacent to the water shall be the same as the
setback specified for the side or rear yard, as the case may be, in the particular zoning district.
However, these setbacks shall never he less than 10 feet for any structure unless specifically
provided for in section 2.6.2.2 of the Land Development Code.
Zero lot l,ne hOl/sing: A single-family detached dwelling structure on individually platted lots
which proyides a side yard or patio on one side of the dwelling and no yard on the other. (See
section 2.6.27,)

4.03.04 Lot Line Adjustments
An adjustment of a lot line between contiguous lots or parcels which may be platted or unplatted
and which are under separate ownership or the same ownership shall be exempt from this section if all
of the following conditions are met. Procedures for demonstration of compliance with the following
conditions are set forth in Chapter 10.
A. It is demonstrated that the request is to correct an engineering or surveying error in
a recorded plat or is to permit an insubstantial boundary change between adjacent
parcels; and
B. Both landowners whose lotlines are being adjusted provide written consent to the
lot line adjustment; and
C. lnstrument(s) evidencing the lot line adjustment shall be filed in the official records of
Collier County, Florida, upon approval, and shall indicate that the result of the lot line
adjustment will meet the standards of, and conforms to, the requirements of this LOC,
including the dimensional requirements of the zoning district and the subdivision in which
the lots are located. However, in cases of an existingnonconforming lot of record ,
the adjustment shall not increase the nonconformity of the lot; and
O. It is demonstrated that the lot line adjustment will not affect the development rights
or permitted density or intensity of use of the affected lots by providing the opportunity to
create a newlot(s) for resale or development.

of 1.55 tons of solid waste per capita per year. In addition, the LOS requires two years of
landfill lined cell disposal capacity at present fill rates and ten years of landfill raw land
