WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has conferred on all cOWlties in Florida the power to establish, coordinate and enforce zoning and such business regulations as are necessary for the protection of the public; and WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC) (Ordinance No. 04-41, as amended) which establishes regulations for the zoning of particular geographic divisions of the COWlty, among which is the granting of variances; and WHEREAS, Petitioner now owns and operates the property located at the intersection of Union Road and U.S. 41 in Collier County, Florida and seeks to alter the signage on the property; and WHEREAS, Petitioner wishes to have a 32 square foot off-premise sign; and WHEREAS, without a variance, Petitioner cannot have an off-premise sign in excess of 12 square feet pursuant to LDC Section 5.06.04.C.16.b.i.; and WHEREAS, without a variance, Petitioner cannot have a sign outside of 1,000 feet of the intersection of the arterial roadway serving the building, structure or use pur~uant to LDC Section 5.06.04.C.16.b.v; and 1 78 ~;1 WHEREAS, with a variance, Petitioner cannot locate a sign closer than 50 feet from a residentially zoned district to a lesser distance of 23 feet, pursuant to LDC section 5.06.04.C.16.c; and WHEREAS, the Board of Zoning Appeals (Board) has held a public hearing with due notice made, and has considered the advisability of granting these variances; and WHEREAS, the Board has found as a matter of fact that satisfactory provision and arrangement have been made concerning all applicable matters required by the Land Development Code; and WHEREAS, all interested parties have been given opportunity to be heard by this Board in a public meeting assembled and the Board having considered all matters presented. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS OF COLLIER COUNTY, FLORIDA, that the Board hereby approves three variances from LDC Section 5.06.04.C.16.b.i, 5.06.04.C.l6.b.v and 5.06.04.C.l6.c as shown in attached Exhibit "A", the text of which, including the content, font and size, are not a portion ofthe variance herein, as submitted by Robert L.
