A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
RELATING TO PETITION AVESMT-2008-AR-14016,
FIDDLER'S CREEK PHASE 4, UNIT 2, TO ACCEPT THREE
REPLACEMENT DRAINAGE EASEMENT AREAS OVER LOT
6 & 7 AND LOT 14 & 15 AND LOT 22 IN BLOCK "A", AND
TO DISCLAIM, RENOUNCE AND VACATE THE COUNTY'S
AND THE PUBLIC'S INTEREST IN TWO 15 FOOT WIDE
DRAINAGE EASEMENTS ALONG THE LOT LINES OF LOT
7 & 8 AND LOTS 13 & 14 ALSO IN BLOCK "An ALL
LOCATED WITHIN FIDDLER'S CREEK PHASE FOUR UNIT,
UNIT TWO AS FILED IN THE PUBLIC RECORDS OF
COLLIER COUNTY IN PLAT BOOK 45, PAGES 40
THROUGH 47, SITUATED IN SECTION 11 AND 14,
TOWNSHIP 51 SOUTH, RANGE 26 EAST, COLLIER
COUNTY, FLORIDA.
WHEREAS, pursuant to Section 177.101, Florida Statutes, Petitioner,
GBP Development, Ltd. has requested the vacation of the County's interest in
two 15 foot wide drainage easements along the lot lines of Lot 7 & 8 and Lot 13
& 14 in Block "A" located in Fiddler's Creek Phase Four, Unit Two, as filed in Plat
Book 45, pages 40-47 of the Public Records of Collier County, Florida situated in
Section 11 and 14, Township 51 South, Range 51 East, being more specifically
depicted and described in Exhibit 'A'; and
WHEREAS, in conjunction with, and as part of Petitioner's request,
Petitioner has offered for dedication three replacement drainage easement areas
over Lots 6 & 7 and Lots 13 & 14 and Lot 22, also in Block "A" of Fiddler's Creek
Phase 4, Unit 2 attached hereto and also being more specifically depicted and
described in Exhibit "B", in the place of the vacated easements; and
WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest
in the two 15 foot wide drainage easements as specifically depicted and
described in Exhibit 'A' is hereby vacated, extinguished, renounced and
disclaimed, and this action is declared to be in the Public's interest and for the
Public's benefit.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board
is hereby directed to record a certified copy of this Resolution in the Official
Records of Collier County, Florida at that time the requirements of this
Resolution are fulfilled, and to make proper notation of this vacation on the
recorded plat as referenced above.
This Resolution adopted after motion, second and majority vote favoring
same, this day of , 2009.

the Dana at Cardinal Management Group, even though I believe you are mailing a copy to her. Lastly. I
look forward to receiving the confirmation of the ads placement. the sworn affidavits from the newspaper
and the recorded resolution (email is best). I will be sure that both you and Steve are provided with an
affidavit of mailing from the management company.
By the way. can either you or Steve advise which section of the Florida Statutes governs the providing of
these notices so I can tell Cardinal management how quickly they have to mail these to the unit owners? I
think Steve indicated the County liked to provide 15 days notice prior to the hearing, but I would also like
to review the statute. I am home on maternity leave so I cant research the issue from home, but I can
have my secretary email me a copy of the applicable section of the Florida Statutes from my office. Any
help you or Steve could provide would be greatly appreciated.

drainage easements in Amador. This Notice is required to be given to all owners within 250 feet. and
consequently, it must be mailed 10 Ihe all unit owners in Ihe Varenna and Menaggio condominium associalions.
As we discussed. please mail this Nolice to all unit owners in Menaggio and Varenna as soon as possible. and
email me a copy of the Affidavit(s) of mailing confirming same. I have asked the County to advise of the timeline
as to when this notice must be given, and it appears it must be mailed at leasl15 days before the hearing before
the Board of County Commissioners on April 14, 2009 (allhough I am waiting for confirmation of same). So. if
you mail it out next week (Ihe earlier the better). Ihat should be just fine.

Collier County will hold a public hearing on Tuesday, April 14,
2009 in the Boardroom, 3'0 Floor, Administration Building, Collier
County Government Center, 3301 East Tamia~i Trail, Naples,
Florida. The meeting will begin at 9:00 A.M. The title of the
proposed Resolution is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, RELATING TO PETITION AvESMT-200a-AR-14016,
FIDDLER'S CREEK PHASE 4, UNIT 2, TO ACCEPT THREE REPLACEMENT
DRAINAGE EASEMENT AREAS OvER LOT 6 & 7 AND LOT 14 & 15 AND
LOT 22 IN BLOCK "A", AND TO DISCLAIM, RENOUNCE AND VACATE THE

Any person who decides to appeal a decision of the Board will need
a record of the proceedings pertaining thereto and therefore, may
need to ensure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the
appeal is based.

WHEREAS, pursuant to Section 177.101, Florida Statutes, Petitioner,
GBP Development, Ltd. has requested the vacation of the County's interest in
two 15 foot wide drainage easements along the lot lines of Lot 7 & 8 and Lot 13
& 14 in Block "A" located in Fiddler's Creek Phase Four, Unit Two, as filed in Plat
Book 45, pages 40-47 of the Public Records of Collier County, Florida situated in
Section 11 and 14, Township 51 South, Range 51 East, being more specifically
depicted and described in Exhibit 'A'; and
WHEREAS, in conjunction with, and as part of Petitioner's request,
Petitioner has offered for dedication three replacement drainage easement areas
over Lots 6 & 7 and Lots 13 & 14 and Lot 22, also in Block "A" of Fiddler's Creek
Phase 4, Unit 2 attached hereto and also being more specifically depicted and
described in Exhibit "B", in the place of the vacated easements; and
WHEREAS, the Board has this day held a public hearing to consider
petitioner's request, and notice of said public hearing was given as required by
law; and
WHEREAS, the granting of the Petitioner's request will not adversely
affect the ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest
in the two 15 foot wide drainage easements as specifically depicted and
described in Exhibit 'A' is hereby vacated, extinguished, renounced and
disclaimed, and this action is declared to be in the Public's interest and for the
Public's benefit.

BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Boal? A
is hereby directed to record a certified copy of this Resolution in the Official
Records of Collier County, Florida at that time the requirements of this

DRAINAGE EASEMENT
THIS DRAINAGE EASEMENT, granted as of the \ L\ day of
No\l~k\ ,2008, by GBP DEVELOPMENT, LTD., a Florida limited
partnership, whose address is: 8156 Fiddler's Creek Parkway, Naples, Florida 34114-0816,
as the Grantor, to COLLIER COUNTY, its successors and assigns, hereinafter referred to as
the "Grantee."
WITNESSETH: That the Grantor, for and in consideration of the sum of ten dollars
($10.00) and other good and valuable consideration paid by the Grantee, the receipt of which
is hereby acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its
successors and assigns, a non-exclusive easementforthe installation, repair and maintenance
of drainage facilities on, over, across, under and through portions of Lots 6, 7, 14, 15 and 22,
Block A, Fiddler's Creek Phase Four, Unit Two, according to the plat thereof recorded in Plat
Book 45, Pages 40 through 47, of the Public Records of Collier County, Florida, as more
particularly described in Exhibit "A"aUached hereto and incorporated herein by reference (the
"Easement Area").
TO HAVE AND TO HOLD the same unto the Grantee and its assigns, together with the
right to enter upon said land to operate, maintain, repair, and replace said drainage facilities
in the Easement Area.
This Easement shall be nonexclusive and the rights, covenants and agreement of the
parties shall run with the title to the property and shall be binding on and inure to the benefit of
the parties hereto and their successors and assigns. The Grantor covenants that it has the
right to convey the Easement, and the Grantor hereby retains for itself, its successors and
assigns, the right to use the Easement Area provided such use does not interfere with the
Grantee's rights herein.
