RELATING TO PETITION NUMBER
V A-2002-AR-2909 FOR A HEIGHT VARIANCE
FROM THE REQUIRED 35 FEET TO 69 FEET IN A
PUBLIC USE ZONE LOCATED IN SECTION 12,
TOWNSHIP 50 SOUTH, RANGE 25 EAST, IN
COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and
such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 91-102) which establishes regulations for the zoning of particular geographic
divisions of the County, among which is the granting of variances; and
WHEREAS, the Board of Zoning Appeals. being the duly elected constituted Board of
the area hereby affected, has held a public hearing after notice as in said regulations made and
provided, and has considered the advisability of a 34-foot variance from the required 35 foot
maximum height limit to 69 feet as shown on the attached plot plan, Exhibit "A", in a "P"
Public Use Zone for the property hereinafter described, and has found as a matter of fact that
satisfactory provision and arrangement have been made concerning all applicable matters
required by said regulations and in accordance with Section 2.7.5 of the Zoning Regulations of
said Land Development Code for the unincorporated area of Collier County; and
WHEREAS, all interested parties have been given opportunity to be heard by this
Board in public meeting assembled, and the Board having considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED BY the Board of Zoning Appeals of
Collier County, Florida, that:
The Petition V A-2002-AR-2909 filed by Craig 1. Pajer, P.E., of ABC National Inc.,
representing the Collier County Board of County Commissioners, with respect to the property
hereinafter described as:
Exhibit "B"
be and the same hereby is approved for a 34-foot variance from the required maximum height
limit of 35 feet to 69 feet as shown on the attached plot plan, Exhibit "A", of the "P" Public
Use Zoning District wherein said property is located, subject to the following conditions:

BE IT FURTHER RESOLVED that this Resolution relating to Petition Number
V A-2002-AR-2909 be recorded in the minutes of this Board.

CONDITIONS OF APPROVAL
V A-02-AR-2909
a) This variance is for the additional height permitted by this resolution.
Any other departure from the dimensional standards of this code shall
require a separate variance.
b) Pursuant to Section 1.8.10 of the land Development Code, should
such nonconfonning structure or nonconforming portion of a structure
be destroyed by any means to an extent of more than 50 percent of its
actual replacement cost at time of destruction, as determined by a cost
estimate submitted to the site development review director. it shall not
be reconstructed except in conformity with provisions of this zoning
code,
c) Pursuant to Section 2.2.25.8.1 of the land Development Code, if,
during the course of site clearing, excavation or other construction
activity an historic or archaeological artifact is found, all development
within the minimum area necessary to protect the discovery shall be
immediately stopped and the Collier County Code Enforcement
Department contacted.
d) Provide traffic mitigation measures at the intersection of Harrison Road
and Palm Drive that limit turning movements to right turns into Harrison
Road and right turns onto Palm Drive.
