EASEMENT USE AGREEMENT
THIS EASEMENT USE AGREEMENT("Agreement")is made and entered into this ` kA-1-‘
day of 2019,by and between SHIRLEY J. STEVENSON,AS TRUSTEE OF THE SHIRLEY
J. STEVENSON REVOCABLE TRUST UNDER AGREEMENT DATED THE 8TH DAY OF
OCTOBER, 1993 (the "Owner"), and IMPERIAL GOLF ESTATES HOMEOWNERS
ASSOCIATION, INC. (the "Association"), and the COLLIER COUNTY BOARD OF COUNTY
COMMISSIONERS (the "County"), a political subdivision of the State of Florida.
RECITALS:
WHEREAS, the Owner trust is the record owner of fee simple title to and interest in that
certain real property legal described as follows:
Lot 88, IMPERIAL GOLF COURSE ESTATES, PHASE IV, according to the plat
thereof recorded in Plat Book 13, at Pages 104 through 106 inclusive, of the Public
Records of Collier County, Florida(hereinafter the "Subject Property"); and
WHEREAS,pursuant to that certain plat of Imperial Golf Course Estates,Phase IV recorded
in Plat Book 13, at Pages 104 through 106 inclusive, the County is the exclusive owner of certain
drainage easement rights along with rear (west) 12' of the Subject Property, a portion of which
encumbers the Subject Property(hereinafter the "Easement Area"); and
WHEREAS, the Easement Area is managed and maintained by the Imperial Golf Estates
Homeowners Association; and
WHEREAS, a screen enclosure and related pool improvements were constructed upon the
Subject Property by the Owner's predecessor in title, resulting in a 2.8' encroachment of the said
improvements into the Easement Area, as shown on the survey attached hereto as Exhibit"A" (the
"Encroachments"); and
WHEREAS, the rear boundary of the Subject Property abuts the Imperial Golf& Country
Club golf course (open space); and

WHEREAS, there are presently no pipes or drainage facilities located within the Drainage
Easement,according to the PUD Development Plans provided by John Houldsworth,Senior Planner
for the County; and
WHEREAS,the Owner purchased the Subject Property with the Encroachment in place and
the County and the Association have no present objection to the continued use of the Encroachments
within the Easement Area, provided that the Owner agrees to the terms and conditions set forth
below; and
WHEREAS,the Encroachments were constructed in or about 1986 and issued Certificate of
Completions/Occupancies by the County; and
NOW THEREFORE, for and in consideration of the Recitals, the sum of Ten Dollars
($10.00) and for other good and valuable consideration, the receipt and sufficiency of which is
hereby expressly acknowledged, the parties do hereby agree as follows:
1. The above recitals are true and correct and are hereby incorporated as if set forth
herein.
2. The Owner shall provide both the County and the Homeowner's Association
whatever access they require to continue their drainage easement and maintenance rights and further
agrees to waive any claim of damage to the encroaching pool deck and screen enclosure arising out
of either the County's or the Homeowner's Association's maintenance activities within the Easement
Area, whether such damage is intentional or unintentional.
3. The County agrees that until otherwise notified, Owner and Owner's successors in
title may continue use of the screen enclosure and related pool improvements within the Easement
Area. In addition, the Owner and Owner's successors in title may repair and/or replace the
Encroachments from time to time so long as such action does not cause the improvements to further
encroach into the Easement Area. The County retains the right, however, in its sole discretion,to
demand by written request that the Encroachments be removed from the Easement Area, which
Owner will do at his/her sole cost and expense within a reasonable time from receipt of such request.
4. The Owner agrees for itself and its successors and assigns that they shall release,
indemnify and hold the County harmless from and against any and all obligations,claims,liabilities,
expenses and/or fees(including reasonable attorney fees and court costs)including personal injury or
property damage arising out of the use of the Easement Area by the Owner or Owner's contractors,
agents or invitees, or the Association, at any time while the Encroachments remain within the
Easement Area. Further,the Owner, for herself and her successors and assigns agree to release and
hold the County harmless from and against any and all obligations, claims, liabilities, expenses
and/or fees(including reasonable attorney fees and court costs)including personal injury or property
damage arising out of the use of the Easement Area by the County, including but not limited to
damage which may occur to the Encroachments during the normal operation, maintenance, repair

and/or replacement, as applicable, of the Easement Area and/or the improvements and/or the
infrastructure, which may now or in the future be located within the Easement Area.
5. Binding Effect: This Easement Use Agreement shall be recorded in the Public
Records of Collier County,Florida,at Owner's sole cost and expense.This Agreement is intended to
bind the Parties, with their respective heirs, successors and assigns.
6. Governing Law: This Agreement shall be governed by the laws of the State of
Florida.
