EXECUTIVE SUMMARY
Recommendation to approve the Release and Satisfaction of lien for
payment in full received for the Code Enforcement Action entitled Board of
County Commissioners vs. Satrice Metelus, Special Magistrate Case No.
2007030478, relating to property located at 3169 Areca Avenue, Naples,
Florida. ( Revenue received $2,246.18)
OBJECTIVE: That the Board of County Commissioners (Board) approve a
Release and Satisfaction of Lien for payment in full received from Southern
Financial Title Services, Inc" in the amount of $2,246.18, in relation to the Code
Enforcement Special Magistrate action entitled Board of County Commissioners
vs. Satrice Metelus, Case No. 2007030478.
CONSIDERATIONS: On June 1, 2007, The Special Magistrate found Satrice
Metelus (Respondent) in violation of the Collier County Land Development Code
for keeping a recreational vehicle in a residentially zoned area. Respondent was
ordered to store the recreational vehicle in the rear yard and concealed from
view. by storing the vehicle in the confines of a completely enclosed structure, or
by removing the vehicle from the residentially zoned area on or before June 8.
2007 or a fine of $50 per day would be imposed until compliance has been
confirmed.
Due to non-compliance and based on the above order, the Special Magistrate
entered an order dated July 20, 2007 imposing a lien. The Order Imposing a
Lien was recorded at O.R. Book 4268, Page 3974, et seq., of the Official Public
Records of Collier County. The property was brought into compliance by Satrice
Metelus by removing the recreational vehicle from the property on July 5, 2007.
When calculated at $50 per day for the noncompliance period of 40 days, the
accrued lien amount is $2,000.
The property has since gone into foreclosure, been acquired by a bank (HSBC
Bank), and sold to a private third-party purchaser. The title company for HSBC
Bank (seller in this subsequent third-party sale) has paid the full amount due of
$2,246.18, and is requesting a release of lien.
FISCAL IMPACT: Payment in full of $2,246.18, which includes $2,000 in fines,
plus Operational Costs of $246,18, has been provided.
GROWTH MANAGEMENT IMPACT: There is no growth management impact
associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. -

RECOMMENDATION: That the Board of County Commissioners (Board)
approve the release and satisfaction of the Lien recorded at O.R. Book 4268,
Page 3974, et seq., of the Official Public Records of Collier County for payment
received from Southern Financial Title Services in the amount of $2,246,18, in
relation to the Code Enforcement Special Magistrate action entitled Collier
County vs. Satrice Metelus, Case No. 2007030478. By approval of this item,
authorize the Chairman to sign the attached Release and Satisfaction of Lien.

KNOW ALL MEN BY THESE PRESENTS: That the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA is the owner and holder of a
certain lien against all real and personal property owned by:

The lien was recorded on 08/10/2007 in Official Records Book 4268, Page 3974, et
seq., of the Official Records of Collier County, State of Florida, The lien secures the
principal sum of Two Thousand Two Hundred and Forty Six dollars and eighteen cents,
plus accrued interest and penalties, if any, and imposes certain obligations against real
property situated in Collier County, Florida. which property is described as follows:
3169 Areca Avenue. Naples, FL 34112
Cost: $2,246.18
Collier County, a political subdivision of the State of Florida, by execution of this Release
and Satisfaction of Lien, acknowledges payment as full satisfaction of the lien and
hereby cancels said lien.
The Clerk of the Circuit Court is hereby directed to record this Release and Satisfaction
of Lien in the Official Records of Collier County, Florida, to acknowledge that the lien
ceases to exist.
