A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AMENDING SCHEDULE THREE OF APPENDIX A OF
CHAPTER 74 OF THE COLLIER COUNTY CODE OF LAW AND ORDINANCES, AS
AMENDED, THE SAME BEING THE COLLIER COUNTY CONSOLIDATED IMPACT
FEE ORDINANCE; INCREASING COMMUNITY PARKS IMPACT FEE RATES FROM
$571.02 PER EQUIVALENT DWELLING UNIT (EDU) TO 5748.00 PER EDU; ALSO
INCREASING REGIONAL PARKS IMPACT FEE RATES FROM $249.82 PER EDU TO
$746.110 PER EDUj ESTABLISHING TIERED RATES ASSOCIATED WITH VARIED
HOUSING TYPES AND UNIT SIZES; ADDING A NEW LAND USE CATEGORY FOR
HOTELS AND MOTELS APPLICABLE TO COMMUNITY AND REGIONAL PARKS
IMPACT FEES; PROVIDING AN EFFECTIVE DATE.
WHEREAS, on May 25, 1999, Ihe Board of County Commissioners of Collier County
adopted Ordinance No. 99-39, the Collier County Parks and Recreational Facilities Impact Fee
Ordinance, Ihereby establishing Ihe County's then applicable parks and recreational facilities
impact fee rates. and, as such, those rates have been in effect for more than Ihree (3) years; and

superceding all of the County's then existing impact fee regulations, and consolidating ~:Of th~

County's impact fee regulations into that Ordinance, codified as Chapter 74 of the CoIliljf.-c-ountyr.

Code of Law and Ordinances (the Code), and incorporating the aforementioned ~ and;

recreational facilities impact fee rates established by the adoption of Ordinance No. 99-39; and
WHEREAS. Section 74-502 of the Code states that impact fee studies should be
reviewed at least every three (3) years, thus, Ihe County has retained Duncan Associates (the
Consultant) to review the existing parks and recreational facilities impact fees and recommend
changes to the fees where appropriate; and
WHEREAS, Collier County uses impact fees to supplement the funding of necessary
capital improvements required to provide public facilities to serve new population and related
development; and
WHEREAS, the County's exceptional growth in the past Ihree (3) years, in conjunction
with sharply increasing parks and recreational facilities replacement costs warrants that the Board
should undertake proactive measures to match parks and recreational facilities inventory levels
with future needs; and
WHEREAS, the County's Consultant recommends a community parks impact fee rate
increase from $571.02 to $748.00 per equivalent dwelling unit (EDU) (an increase of $176.09);
and a regional parks impact fee rate increase from $249.82 to $746.00 per EDU (an increase of
$496.18); and
WHEREAS. tbe County's Consultant also recommends establishing tiered impact fee
("dtes relalive to housing typc and unit size. as well as adding botcls and motcls as a new land use
category with respect to these impact fees, in order to more equitably distribute the costs of
acqUiring public facilities based upon a rational nexus relaling costs incurred by fee payers to
infrastructure impacts created by various land uses; and
WHEREAS, staff has thoroughly reviewed :the Consultant's findings and
recommendations and concurs with the recommended parks and recreational facilities impact fee
rate increases as specified herein.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
The Board of County Commissioners hereby declares that the parks and recreational
facilities impact fee rates set forth in the revised Schedule Three of Appendix A of Ordinance No.
2001-13. as amended. the Collier County Consolidated Impact Fee Ordinance, the same being
Schedule TItrec of Appendix A of Chapter 74 of the Collier County Code of Law and Ordinances.
attached hereto, and incorporated by reference herein as Exhibit" A" are fair and reasonable sums
to be assessed to those who receive the benefits of new and expanded parks and recreational
facilities public facilities necessitated by increased population and related development
BE IT FURTHER RESOLVED that the revised Parks and Recreation impact fee
schedule shall take effect upon filing with the Florida Department of State.
This Resolution is adopted after motion, second and majority vote favoring adoption this
