EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20190000627, to disclaim, renounce and vacate the County and the public interest
in the Drainage, Utility and Maintenance Easement (Parcel 846) located approximately 3800-feet
south of Immokalee Road (C.R. 846) on the west side of Collier Boulevard (C.R. 951) as recorded in
Official Record Book 3920, page 445 of the public records of Collier County, Florida, located in
Section 27, Township 48 South, Range 26 East, Collier County, Florida. (This is a companion to
Agenda Item 16.A) Both items must be approved or denied on today’s agenda.
OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in the Drainage,
Utility and Maintenance Easement (Parcel 846) located approximately 3800-feet south of Immokalee
Road (C.R. 846) as recorded in Official Record Book 3920, page 445 of the public records of Collier
County, Florida, located in Section 29, Township 48 South, Range 25 East, Collier County, Florida, being
more specifically shown in Exhibit A.
CONSIDERATIONS: Petition VAC-PL20190000627 has been received by the Development Review
Division, Growth Management Department from Daniel Waters, P.E., of Peninsula Engineering, as agent
for contract purchaser, D.R. Horton, Inc., to vacate the Drainage, Utility and Maintenance Easement
(Parcel 846) located approximately 3800-feet south of Immokalee Road (C.R. 846) as recorded in Official
Record Book 3920, page 445 of the public records of Collier County, Florida, located in Section 27,
Township 48 South, Range 26 East, Collier County, Florida.
According to the Warranty Deed dated 1987, recorded in OR Book 1422, page 1910, Ali R. Ghahramani,
M.D., Investment Limited Partnership, a Florida Limited Partnership, is the current owner of the real
property underlying the easements. The owner proposes to vacate the existing Drainage, Utility, and
Maintenance Easement and proposes to provide replacement easements to the County and Meadowood
Homeowners Association that is part of the proposed subdivision plat of Meadowood (Petition #
PL20180003143). The plat will be heard at the same hearing as this vacation request.
The Drainage, Utility and Maintenance Easement was conveyed by Order of Taking and subsequently
confirmed by Stipulated Final Judgment in 2005 from Ali R. Ghahramani, MD Investment Limited
Partnership (with responsibility for maintenance) and to Collier County (without responsibility for
maintenance). The purpose of the easement was to create a stormwater discharge and treatment pond for
accepting and treating the stormwater runoff from Collier Boulevard.
Vacating the easements will permit the owner of the land surrounding the burdened property to develop
and improve the land for residential use. The general public will benefit by the land being utilized to
create additional housing in the community, and by the maintenance of t he land to meet the standards
which are expected in such a residential community.
There is no public detriment associated with this vacation because adequate replacement easements will
be provided by the plat of Meadowood, petition PPL-PL20180003143, and there will be no adverse
impact on adjacent property owners.
Letters of No Objection have been received from F.P.& L., CenturyLink, Comcast, Collier County Right -
of-Way Acquisition Section, Transportation Engineering Division and Collier County Stormwater
Management Section.
The Development Review Division has reviewed this petition and found no reason for objection.
FISCAL IMPACT: Growth Management Department, Development Review Division staff, has

collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of
recording and processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this action.
LEGAL CONSIDERATIONS: Petitioner is requesting to vacate a Drainage, Utility and Maintenance
Easement (Parcel 846) located approximately 3800-feet south of Immokalee Road (C.R. 846) as recorded
in Official Record Book 3920, page 445 of the public records of Collier County, Florida, located in
Section 29, Township 48 South, Range 25 East, Collier County, Florida, as further described in Exhibit A
to the attached Resolution.
Pursuant to Resolution 2013-166 and Florida Statutes Section 177.101, the Board may adopt resolutions
vacating plats in whole or in part of subdivisions in Collier County, returning the property covered by
such plats either in whole or in part into acreage, when the following criteria are met:
1. The request is in the interest of the general public welfare, or no public detriment is established
2. The vacation will not affect the ownership or right of convenient access of persons owning other
parts of the subdivision.
This item has been approved as to form and legality, and requires a majority vote for Board approval ---

RECOMMENDATION: To approve the attached Resolution, relating to Petition VAC-
PL20190000627, which will vacate the County and the public interest in the Drainage, Utility and
Maintenance Easement as recorded in Official Record Book 3920, page 445 of the public records of

Florida, being more specifically shown in Exhibit A, and directs the Clerk to the Board to record a
certified copy of the Resolution in the public records of Collier County, Florida.

Sorry for the delay getting back to you with this. Our ERP has been approved by SFWMD (a copy of the permit is
attached); that permit grants the approval for construction of the proposed Meadowood development SWMS and takes
the contributing area from Collier Boulevard to the Meadowood SWMS into account in the stormwater models. We
assumed that the contributing area from the ROW to the development was 100% impervious in our calculations. The 25
year peak stage within each of the lakes of the proposed Meadowood SWMS is at elevation 13.8 ft‐NAVD. The
permitted peak stage for Basin 5 of the Collier Boulevard widening was at elevation 15.0 ft‐NGVD / 13.8 ft‐NAVD. Based
on having the same peak stage within the development SWMS and the existing roadway SWMS, I don’t anticipate the
road could have any adverse tailwater impact. The ERP for the roadway SWMS and the permit for the development are
attached and the images below show the peak stage information for each.
The plat that is under review concurrently with the application for vacation of the existing drainage easement will
dedicate the obligation to maintain the development SWMS to the Meadowood HOA and reserves to the county the

right (but not the obligation) to enter and perform maintenance on the drainage system. Let me know if there is any
reason we would have to add specific language beyond the standard dedications into the plat.

I saw your comment about the easement vacation at Meadowood and that the county staff is going to review to make
sure that the proposed lake system for our project provides sufficient capacity still for the Collier Boulevard. Can you let
me know who from the county staff is going to be doing that review? We have received our ERP for the project from
SFWMD and that permit shows that the peak stage of the ponds within Meadowood is at the same elevation as the peak
stage in the ERP for the existing county pond. I would like to pass that info onto whoever from the county side is doing
that review. Give me a call if you want to discuss in more detail.
