EXECUTIVE SUMMARY
Recommendation to approve the use of an alternative road impact fee rate, previously approved
by the Board of County Commissioners for Taco Bell, for a Wendy’s Restaurant being
constructed at Tamiami Crossings and for an addition to an existing Taco Bell converting to a
Kentucky Fried Chicken in Immokalee.
OBJECTIVE: That the Board of County Commissioners approves the use of an alternative road
impact fee rate, previously approved for Taco Bell, for a new Wendy’s Restaurant being const ructed
at Tamiami Crossings and for an addition to an existing Taco Bell being converted to a Kentucky
Fried Chicken (KFC) in Immokalee.
CONSIDERATIONS: On April 12, 2011, the Board of County Commissioners approved an
alternative road impact fee calculation study for Taco Bell conducted in accordance with the
provisions of Section 74-204 of the Collier County Code of Laws and Ordinances; the review by
Tindale-Oliver and Associates, Inc.; and the resulting 14% reduction from the adopted Road Impact
Fee rate. The analysis provided that fast food restaurants that do not offer breakfast and are not open
24-hours generate less travel than the average fast food restaurant with a drive-through.
Both Wendy’s and KFC are comparable in that they do not serve breakfast and are not open 24-hours.
The current adopted Road Impact Fee rate for a Fast Food Restaurant with Drive -Through is
$96,567.14 per 1,000 square feet. A 14% reduction will result in an adjusted rate of $83,047.74 per
1,000 square feet. Approval of the use of the alternative impact fee rate calculation to be used for
Taco Bell and KFC is recommended by staff and the impact fee consultant.
A copy of the Taco Bell Alternative Study is on file in the Impact Fee Administration Office.
FISCAL IMPACT: If the Board accepts and approves the use of the alternative impact fee rate, the
resulting rate is 14% lower than the current rate for a Fast Food Restaurant with Drive Through. This
adjustment accurately reflects the demand created by the proposed facilities on public transportation
facilities.
GROWTH MANAGEMENT IMPACT: Impact fees provide financial resources for the
construction and/or expansion of the County’s capital infrastructure, as necessary to accommodate
growth. Consistent with Objective 2 of the Capital Improvement Element (CIE) of the Collier
County Growth Management Plan (GMP), development is required to contribute its fair share of the
costs of providing public facilities necessitated by growth, however impact fees may not be collected
in excess of the amount reasonably anticipated to fund such improvements. The fees for Wendy’s
and KFC are based on an alternative road impact fee calculation which represents a current, localized
and accurate assessment of the facility’s impact and associated cost of providing transportation-
related capital facilities attributable to the new development.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved
as to form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: To approve the use of an alternative road impact fee rate, previously
approved for Taco Bell, for a new Wendy’s Restaurant being constructed at Tamiami Crossings and
for an addition to an existing Taco Bell converting to a KFC in Immokalee. Staff also recommends
that the Board of County Commissioners approves the use of the alternative road impact fee rate on
any future fast food restaurants with a drive-through that do not offer breakfast and are not open 24-

hours, until such time that the alternative rate can be added to the impact fee rate schedule in early
2020.

We have completed a review of the Revised Independent Impact Fee Calculation Study for the proposed
Taco Bell site to be located at420l E. Tamiami Trail, at the intersection of E. Tamiami Trail and
Lakewood Boulevard. The study, dated February 2,2011, is completed by Nunner Engineering Services
(the Consultant).
TOA reviewed the trip length and percent new trips data with regard to the issues mentioned in the letter
to Collier County dated December 8, 2010.
r The calculation of trip lengths of diverted trip ends has been clarified and no change was
necessary.
o The Consultant has reviewed and revised both trip type categorizations and trip lengths associated
with Sites I mdZ. The trip lengths observed are now accurately reflected in the final variables.
o The Consultant does not weigh the trip characteristics by study site size as required by the
County's Administrative Manual. [t is recommended that the variables obtained at each individual
site be accepted by the County and that the trip characteristics variables be weighted for the final
impact fee calculation.
Table I on the next page presents the results of the values for the three trip characteristics variables and
suggested change to be incorporated to obtain the weighted average values for each variable. Table 2
shows the adopted transportation impact fees in comparison to the fees calculated for Taco Bell using the
Phase I and Phase [I transportation impact fee variables.

The analysis suggests that fast food restaurants that do not offer breakfast (or another meal, such as lunch
or dinner) generate less travel than the average fast food restaurant with drive through. As such, it is
recommended that the County accept the hip characteristics variables and calculated impact fee.

We have completed a review ofthe Independent Impact Foe Calculation Study dated October 28, 2010 for
the proposed Taco Bell site to be located at 4201 E. Tamiami Trail, at the interseotion of E. Tamiami Trail
and Lakewood Boulevard, submitted by Nunner Engineering Services (the Consultant).
TOA reviewed the trip generation rate, trip length, and poroent new trips data. The calculations for trip
genoretion rate were found to be oorrect; however, three issues were identified with the final hip
characteristics variablos:
o The Consultant do€s not weigh the trip characteristics by study site size (based on 1,000 square
feet) and instead uses a straight average.
. Based on the sample of origin-destination surveys, the Consultant does not appear to multiply the
diverted trip lengths by 2, as stated in the county's Administrative procedures Manual as it
pertains to altemative transportation impact fees.
o The sample of origindestination surveys validated the trip characteristics obtained from Site 3
(within l0%); however, the results obtained from TOA's sample are fundamentally different than
the variables computed by the Consultant for Sites I and 2. Specifically, in about one-third ofthe
sample surveys evaluated for Site 2, the Consultantls results incorrectly categorized trip types and
the subsequent trip lengths.
The table on the next page presents the results ofthe sample taken of origin-destination surveys for all
three study sites. The table shows the results calculated by the Consuttant and the results ofthe ToA
review, as well as, the percent different between the two.

It is recommended that the Consultant correct the trip types and trip lengths of the origin-destination data
for at least Sites I and 2 (ideatly for all sites), as well as, correct the calculation for diverted trip lengths,
before the County accepts the study findings. These calculations are explained in the article titled
"Measuring Travel Characteristics for Transportation Impact Fees" by W.E. Oliver, which was referenced
in the County's Administrative Procedures Manual.

l. Google maps takes first route away from Collier Blvd. My local
experience is that driver would use Collier Blvd. as I have shbwn.
