EXECUTIVE SUMMARY
Recommendation to approve the Disadvantaged Business Enterprise Goal for FY 20, 21, and 22 to
ensure that the Disadvantaged Business Enterprise have an equal opportunity to receive and
participate in Federal Transit Administration assisted contracts by ensuring nondiscrimination in
their award and administration.
OBJECTIVE: To ensure that the Disadvantaged Business Enterprise (DBE) have an equal opportunity to
receive and participate in Federal Transit Administration (FTA) assisted contracts by ensuring
nondiscrimination in their award and administration.
CONSIDERATIONS: The Department of Transportation DBE program applies to projects funded from
the traditional Department of Transportation (DOT) sources. It was established to ensure non-
discrimination in the award of state and federally funded contracts. The goal of the DBE program is
established to remedy past and current discrimination against disadvantaged and small business
enterprises, ensuring a “level playing field” in which DBE’s can compete fairly for DOT and FTA
contracts.
Collier Area Transit (CAT), as a grantee of both the DOT and the FTA, is in the triennial process of
establishing its goal for its DBE program. The final goal will be in effect for the next three (3) years
(Fiscal years 2020, 2021, and 2022).
CAT’s overall total DBE goal being proposed will be 1.77%. The goal is to obtain 1.77% participation
from DBE firms on federally funded solicitations such as professional, consulting, construction, and
procurement contracts during Fiscal Years 20, 21, and 22 beginning October 1, 2019 and ending
September 30, 2022.
The proposed Goal was endorsed by the Public Transit Advisory Committee (PTAC) and is currently
available for public comment until June 23rd, 2019; the proposed DBE Goal will be considered the final
DBE Goal unless substantive public comments are received within the public comment period. If
necessary, a revised Goal will be brought to the Board of County Commissioners (Board) for approval of
revisions.
FISCAL IMPACT: No Fiscal impact is associated with this Item.
LEGAL CONSIDERATIONS: This Item has been reviewed by the County Attorney, is approved as to
form and legality and requires a majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this
Executive Summary.
RECOMMENDATION: To Approve the proposed Disadvantaged Business Enterprise Goal for FY 20,
21, and 22.

DISADVANTAGED BUSINESS ENTERPRISE (DBE) PROGRAM GOAL SETTING
PROCESS FY 2020-2021-2022
The Collier County Board of County Commissioners (BCC) has established a Disadvantaged
Business Enterprise (DBE) program in accordance with regulations of the U.S. Department of
Transportation (DOT), 49 CFR Part 26. The BCC has received Federal financial assistance from
the Federal Transit Administration (FTA), and as a condition of receiving this assistance, the
BCC agrees to comply with 49 CFR Part 26.
It is the policy of the BCC to ensure that DBE’s as defined in part 26, have an equal opportunity
to receive and participate in FTA-assisted contracts.
The BCC will not exclude any person from participation in, deny any person the benefits of, or
otherwise discriminate against anyone in connection with the award and performance of any
contract covered by 49 CFR part 26 on the basis of race, color, sex, or national origin.
In administering its DBE program, the BCC will not, directly or through contractual or other
arrangements, use criteria or methods of administration that have the effect of defeating or
substantially impairing accomplishment of the objectives of the DBE pr ogram with respect to
individuals of a particular race, color, sex, or national origin.
The Goal setting process contained in this Attachment to Collier County’s Disadvantaged
Business Enterprise Program outlines the adopted process to determine the relative availability of
DBE’s to perform the types of contracts anticipated in FY 2020; 2021 and 2022.
The purpose of this process is to determine the percentage of all ready, willing and able
“Establishments” that are DBE’S and to establish a DBE Goal.
U.S. Department of Transportation (DOT), 49 CFR Part 26 establishes a Three Step Process.
Each step used by Collier County is outlined below.

Step 1
Collier County / Collier Area Transit has executed the Florida Unified Certification Program
Agreement. 49 CFR Part 26 Subpart E- Certification Procedures Section 26.81, requires that all
United States Department of Transportation (USDOT) Recipients participate in a statewide
Unified Certification Program. Collier County / Collier Area Transit is co mmitted to operate in
full compliance with 49 CFR Part 26, Subpart E.
Collier County / Collier Area Transit will utilize certified D.B.E. vendors through the Florida
Unified Certification Program Agreement.
Collier County / Collier Area Transit expects to have contracting or subcontracting possibilities
in the following areas, transit and paratransit services, motor vehicle parts, building contractors,
and computer software services.
Collier Area Transit staff has reviewed past bidders and contracts to establish a region that
includes Collier, Lee, Hillsborough, Miami-Dade, Broward, Palm Beach, Martin, Polk and
Orange County. This region was used to indentify DBE and Non-DBE firms willing and able to
work in Collier County.
Collier Area Transit staff utilized the Florida Department of Transportation Disadvantaged
Business Enterprise Online Directory
(http://www3b.dot.state.fl.us/EqualOpportunityOfficeBusinessDirectory/CustomSearch.aspx) for
certified DBE vendors in the identified region willing to work in Collier County.
Staff identified 5543 ready, willing and able certified DBE’s (certified by the FDOT, Equal
Opportunity Office, in the Disadvantaged Business Enterprise Directory) in the identified region
as of May 9, 2019.
Collier Area Transit staff utilized the 2014 US Census Bureau County Business Patterns
(http://censtats.census.gov/cgi-bin/cbpnaic/cbpsel.pl) for ready, willing and able TOTAL
establishments that currently provide service in our service area.
Staff identified 61,035 ready, willing and able TOTAL establishments that currently provide
service in our service area.
The process used to obtain the percent of DBE’s to TOTAL establishments for the potential
contract percent is illustrated below.

The percent of DBE establishments by NAICS codes available in the Collier County area is
9.08%.
To ensure that Step One Base Figure is as accurate as possible, weighting was used to make
CAT’s goal calculation more accurate. Weighting takes into consideration the type of work and
what percent of the total anticipated expenses it will consume. Categories where established
grouping like NAICS codes to potential federally and state funded projects.

Step 2
Step 2 of the Goal setting process is designed to adjust the Step 1 base figure to make it as
precise as possible. After calculating a base figure of the relative availability of DBEs, evidence
was examined to determine what adjustment was needed to the base figure in order to arrive at
the overall goal.
Historical Collier County DBE participation data for FY 16, 17 and 18 was shown to have a
median of 0.38% DBE participation.
An adjusted figure was established utilizing median past participation figure and the base figure
of Step 1. The adjusted figure resulted in 1.77%
In order to reflect as accurately as possible the DBE participation that would be expected in the
absence of discrimination, the adjusted figure of 1.77% will be used for Fiscal Years 2020, 2021,
and 2022.
Step 3
Race/Gender-Neutral and Race/Gender-Conscious Split methodology.
Staff reviewed the “U.S. Department of Transportation Office of Small and Disadvantaged
Business Utilization” guidelines prior to preparing the DBE Goal. The guidelines for step 3
provide assistance in determining what factors to consider in projecting the overall portion of the
goal that will be met through race/gender-neutral means. With one exception, the examples are
based on past participation or experience. As in step 2, this is our ninth plan. Therefore, in
determining the race/gender-neutral and race/gender-conscious split, staff used the available data
below.

This data will be continually monitored and updated if necessary through FY 2020, 2021 and
2022.
DBE Outreach and Public Participation
Collier County staff sent emails to over 1459 registered DBE’s in our region requesting their
input into development of the DBE goal. This letter also included an open invitation to present
and provide information if so desired. Furthermore, following the development of the goal, the
same entities were notified of the public comment period, as well as publication in the
newspapers, displayed at various local governmental entities within the urban and rural area, and
placed on Collier Area Transit website. Attached is the responses from the firms and public.

30-Day Public Comment Period Announced The Collier County Public Transit & Neighborhood Enhancement Division is announcing a 45-day
public comment period for the Disadvantage Business Enterprise (DBE) Goal Setting.
The Department of Transportation Disadvantaged Business Enterprise (DBE) program applies to
projects funded from traditional Department of Transportation (DOT) sources. It was established to ensure
nondiscrimination in the award of state and federally funded contracts. The goal of the DBE program is
established to remedy past and current discrimination against disadvantaged and small business enterprises,
ensuring a “level playing field” in which DBEs can compete fairly for DOT and Federal Transit
Administration (FTA) contracts.
Collier Area Transit (CAT), as a grantee of both the Department of Transportation and the Federal
Transit Administration, is in the triennial process of establishing its goal for its DBE program. The final
goal will be in effect for the next three years (Fiscal years 2019/20, 2020/21, 2021/22).
Collier Area Transit is recommending the following Disadvantaged Business Enterprise (DBE) goal
for applicable professional, consulting, construction, and procurement contracts during Fiscal years
2019/20, 2020/21, 2021/22, beginning October 1, 2019 and ending September 30, 2022. The overall total
DBE goal being proposed will be 1.77%.
The draft goal will be available for public comment for 30 Days and CAT would like to gain your

My recommendation would be that the (DBE) goal for professional Engineer (eg Electrical Engineers ‐PE) and consulting
Engineers be 25% (or 0.44%) of the 1.77% overall total. If this is not stipulate in your goal, as a DBE trying to find a
Prime I would be wasting my time. Primes need to be encouraged to seek out professional services otherwise only
janitor and construction workers are used to satisfy the goal.

You were part of a mass email of 1000+ DBE in the region comprised of Collier, Lee, Hillsborough, Polk, Orange, Martin,
Miami‐Dade, Broward and Palm Beach Counties who were identified as being willing to perform work in Collier County
with the Transit Division. We appreciate your feedback regarding our DBE goal, and are utilizing your input and our past
experience to determine measures required to establish a realistic goal. While we have made a small improvement in
DBE participation, we have not been successful in obtaining our DBE goal. In an effort to improve this outcome and
increase DBE participation, Collier Area Transit (CAT) will be working with our Purchasing Department to ensure our
identified region are properly notified of any and all projects that will be going up for bid. Although the proposed goal
may seem low, by establishing a realistic goal based on available DBE Firms and past participation, in addition to
conducting initiatives to encourage participation, CAT hopes to meet or exceed the goal and use this time as a stepping
stone for justification to increase the goal during the next goal setting period.

traditional Department of Transportation (DOT) sources. It was established to ensure nondiscrimination in the award of
state and federally funded contracts. The goal of the DBE program is established to remedy past and current

compete fairly for DOT and Federal Transit Administration (FTA) contracts.
Collier Area Transit (CAT), as a grantee of both the Department of Transportation and the Federal Transit Administration,
is in the triennial process of establishing its goal for its DBE program. The final goal will be in effect for the next three
years (Fiscal years 2019/20, 2020/21, 2021/22).
Collier Area Transit is recommending the following Disadvantaged Business Enterprise (DBE) goal for applicable
professional, consulting, construction, and procurement contracts during Fiscal Years 2020/2021/2022, beginning October
1, 2019 and ending September 30, 2022. The overall total DBE goal being proposed will be 1.77%.
The draft goal will be available for public comment for 30 Days and CAT would like to gain your input, CAT staff members
are available to speak with you or give a presentation regarding the DBE process. If you would like to schedule a

Miami‐Dade, Broward and Palm Beach Counties who were identified as being willing to perform work in Collier County
with the Transit Division. We appreciate your feedback regarding our DBE goal, and are utilizing your input and our past
experience to determine measures required to establish a realistic goal. While we have made a small improvement in
DBE participation, we have not been successful in obtaining our DBE goal. In an effort to improve this outcome and
increase DBE participation, Collier Area Transit (CAT) will be working with our Purchasing Department to ensure our
identified region are properly notified of any and all projects that will be going up for bid. Although the proposed goal
may seem low, by establishing a realistic goal based on available DBE Firms and past participation, in addition to
conducting initiatives to encourage participation, CAT hopes to meet or exceed the goal and use this time as a stepping
stone for justification to increase the goal during the next goal setting period.

Omar,
Madrid Engineering is a FDOT DBE with 26 years in business. The FDOT has a DBE participation
goal that hovers around 10.0%; the City of Orlando is more like 15%. It takes considerable effort to do
the paperwork initially and each year for (re)certification, so it hardly seems worth it to pursue work if
the goal is only 1.77%. As an example, we have existing contracts for materials testing and
construction inspection as subconsultants to a prime geotechnical engineer working for the FDOT.
Lets say the Prime Consultant has named 4 DBE subconsultants to his/her team, not unreasonable
for this type of contract. Then the 10% DBE goal or requirement gets split among the 4 DBE firms,
and each gets 2 to 3% of the contract. If the contract is a 5-year, $5M contract (which is a very large
engineering contract), a DBE might get $100,000 of work over a 5 year period, or just $20,000 per
year (versus the prime consultant getting $900,000 per year).
That is the reality of the FDOT. If Collier County’s percentage is just 1.77%, it is not worth the time
and effort trying to team on a job unless it is handed to the DBE sub with no marketing effort on their
part. Using your goal and the same contracting scenario, each DBE subconsultant would be 0.44%
of the contract, or $4400 per year.

My recommendation, if you can, is to make that percentage 10.0% and see what happens. It certainly
could be worth it to local and nearby DBE companies to go after that work. We are far enough away
that only rarely do we get work in Collier County, and then for the FDOT directly but not county
projects.
Please do not take offense at anything I’ve said. I’m trying to give you objective feedback, based on
my experience as a DBE. I will not be able to attend a public hearing down there.

This is 95% of our revenue.
If indeed, the goal that will be established over the next 3years is, 1.77% for FDOT Projects, this gives very little assistance if
any to a DBE Company such as mine.
Today, the challenges and risks are greater than 10 years ago due to the way business has changed.
As a consequence, competition has increased.
DBE companies, need an advantage, and quite frankly a value of 1.77% on projects provides very little assistance.

The goal of 1.77% is essentially not a goal, this needs to be looked into. I see that it was 1.60% previously so
this may appear to be an increase but I am not sure how this moves the needle.
The determination of the goal is based on a methodology required by the government which includes establishing a
region from which DBE firms are likely and willing to do work in Collier County. Additionally, the methodology
determines potential work that will be solicited by Collier Area Transit (CAT) in order to determine the North American

Industry Classification System (NAICS) codes to identify the types of businesses within the region that are available to
perform service.
The total firms in the region is included as part of the methodology to determine the realistic goal for the DBE program.
Although the 1.77% seem low that does not preclude the County from utilizing the services of a higher percentage of
DBEs if they are qualified and awarded work solicited.
Where is the data for this coming from? The data used is US Census Bureau Business data as well as Florida
Department of Transportation (FDOT) BDE Directory.
Has there been a survey or evaluation of how DBE's can participate to help increase this goal and
participation? What is being done for DBE's to do work, grow, expand and then be put in a position to pursue
as a prime? I am not aware of a survey any survey that was conducted. However, as part of this goal setting process we
have reached out to DBE’s to solicit their input.
What can Collier Area Transit do to increase this goal, get the word out to DBE's about projects etc.? Collier
County’s procurement process utilizes an electronic system called Bidsync. The system posts solicitation with the small
business Association as well to reach DBE’s. There is a cost to receive notification through the system. In an effort to
include DBEs the County is paying that cost for a registered DBE so that they can receive all notifications of solicitations
for the County.
How can we help as a DBE? We encourage DBEs to register in Bidsync.
I looked at the procurement site and did not see any upcoming projects, nor a forecast of projects expected to
be procured over the next 12 months.

The goal of 1.77% is essentially not a goal, this needs to be looked into. I see that it was 1.60% previously so
this may appear to be an increase but I am not sure how this moves the needle.
The determination of the goal is based on a methodology required by the government which includes
establishing a region from which DBE firms are likely and willing to do work in Collier County. Additionally, the
methodology determines potential work that will be solicited by Collier Area Transit (CAT) in order to
determine the North American Industry Classification System (NAICS) codes to identify the types of businesses
within the region that are available to perform service.
The total firms in the region is included as part of the methodology to determine the realistic goal for the DBE
program. Although the 1.77% seem low that does not preclude the County from utilizing the services of a
higher percentage of DBEs if they are qualified and awarded work solicited.
Where is the data for this coming from? The data used is US Census Bureau Business data as well as Florida
Department of Transportation (FDOT) BDE Directory.
Has there been a survey or evaluation of how DBE's can participate to help increase this goal and
participation? What is being done for DBE's to do work, grow, expand and then be put in a position to pursue
as a prime? I am not aware of a survey any survey that was conducted. However, as part of this goal setting
process we have reached out to DBE’s to solicit their input.
What can Collier Area Transit do to increase this goal, get the word out to DBE's about projects etc.? Collier
County’s procurement process utilizes an electronic system called Bidsync. The system posts solicitation with
the small business Association as well to reach DBE’s. There is a cost to receive notification through the
system. In an effort to include DBEs the County is paying that cost for a registered DBE so that they can
receive all notifications of solicitations for the County.
How can we help as a DBE? We encourage DBEs to register in Bidsync.
I looked at the procurement site and did not see any upcoming projects, nor a forecast of projects expected to
be procured over the next 12 months.

experience to determine measures required to establish a realistic goal. While we have made a small improvement in
DBE participation, we have not been successful in obtaining our DBE goal. In an effort to improve this outcome and
increase DBE participation, Collier Area Transit (CAT) will be working with our Purchasing Department to ensure our
identified region are properly notified of any and all projects that will be going up for bid. Although the proposed goal
may seem low, by establishing a realistic goal based on available DBE Firms and past participation, in addition to
conducting initiatives to encourage participation, CAT hopes to meet or exceed the goal and use this time as a stepping
stone for justification to increase the goal during the next goal setting period.

My business, JC Machine works, either directly or indirectly for the Department of Transportation on Moveable Bridge
Projects.
This is 95% of our revenue.
If indeed, the goal that will be established over the next 3years is, 1.77% for FDOT Projects, this gives very little assistance if
any to a DBE Company such as mine.
Today, the challenges and risks are greater than 10 years ago due to the way business has changed.
As a consequence, competition has increased.
DBE companies, need an advantage, and quite frankly a value of 1.77% on projects provides very little assistance.
