EXECUTIVE SUMMARY
Recommendation to convey a Utility Easement for wastewater Master Pump Station Number 167
within the Heritage Bay PUD.
OBJECTIVE: That the Board of County Commissioners of Collier County, Florida (Board), convey a
Utility Easement to the Board of County Commissioners of Collier County, Florida, as the Governing
Body of Collier County and as Ex-Officio the Governing Board of the Collier County Water-Sewer
District (District). The public purpose is to allow the District to service proje cted wastewater collections
needs.
CONSIDERATIONS: On July 26, 2005, Agenda Item 16.E.2, the Board approved a Utility Easement
for a future master pump station and public water supply well site within the Heritage Bay PUD. A copy
of the recorded Utility Easement is attached for reference.
The existing Utility Easement recorded at O.R. Book 3855, Page 878, measures 150’ x 150’ or .516 acres.
Additional easement area is required to accommodate two drive through driveways to provide adequate
space for wastewater pumper trucks to discharge their tanks, provide a storage area for emergency
generators/diesel pumps and to provide space for future expansion. The additional easement area shown
on the exhibit attached to the Utility Easement contains 1.94 acres. A location map is attached.
In addition, the increased easement area will not interfere with the use of the site for other County
government uses as intended. The attached County Utility Easement (CUE) has been reviewed and
approved by the County Attorney’s Office and the Public Utilities Department.
FISCAL IMPACT: The total cost will not exceed $18.50 for the recording of the Utility Easement.
Funding for Project 70146 (Master Pump Station) is available in, and is consistent with, the FY19 Capital
Budget approved by the Board on September 20, 2018. The source of funding is the Wastewater User
Fee Fund (414).
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to ensure the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board approval. - JAB
RECOMMENDATION: That the Board of County Commissioners:
1. Approves and authorizes the Chairman to execute the attached Utility Easement;
2. The District accepts the attached County Utility Easement; and
3. Directs the County Manager or his designee to follow appropriate closing procedures and
record the Utility Easement in the official records of Collier County, Florida.

Tamiami Trail East, Suite 101, Naples, Florida 34112, hereinafter referred to as "Grantor", tothe BOARD OF
COUNW COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF
COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY

TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter upon said land,
excavate, and place or remove materials, including, but not limited to, sewer lines and pipes, service and
pump stations, and other equipment or improvements appurtenant thereto or thereunder for the purpose of
constructing, operating, and maintaining utility facilities thereon. The easement granted herein shall constitute
easements running with the land and shall burden the lands described above.
