EXECUTIVE SUMMARY
Recommendation to approve the document necessary to convey an easement to Florida Power &
Light Company over property owned by the Collier County Water-Sewer District at 9622
Vanderbilt Dr., Naples, FL 34108.
OBJECTIVE: To convey an easement for installation of electric infrastructure on Collier County Water-
Sewer District property required to power a new pump station. The public purpose is to bring utility
infrastructure into compliance with current County standards while meeting demand, improving
reliability, protecting public safety and providing environmental protection.
CONSIDERATIONS: On September 11, 2012, under Agenda Item 11.E, the Board of County
Commissioners (Board) approved Contract Number 11-5782 for designing wastewater infrastructure
improvements for the Wastewater Basin Program. The renovation of Pump Station 101.06 is one of
many projects designed as part of the Wastewater Basin Program. The existing site for Pump Station
101.06 is undersized and located next to a Vanderbilt Lagoon canal. The property for the new Pump
Station 101.06 was purchased by the Collier County Water-Sewer District, pursuant to Board action on
March 10, 2015, under Agenda Item 16.C.3.
On April 9, 2019, the Board approved Agenda Item 16.C.1, conveying an easement to Florida Power &
Light Company (FP&L) for the necessary easement. The easement was signed by the Chairman and
recorded on April 23, 2019, in OR Book 5620, Page 3338, Public Records of Collier County, Florida.
Adjoining property owners have expressed their concerns regarding the size and location of the
improvements. Accordingly, the Collier County Public Utilities Engineering & Project Management
Division has agreed to have FP&L locate the transformer in a less visible location in the rear of the
property. This existing easement will remain intact as FP&L will use it for access to the new easement in
the rear of the property.
The project includes installation of a new electric line and transformer for the pump station. A n easement
to FP&L for the installation of electric lines and fiber, including, but not limited to, conduit, poles, and
transformer box, is required. The easement area measures approximately 863 square feet and is shown
and described on Exhibit “A” to the Easement. The County will not be compensated because the
easement is required to provide the electrical facilities necessary for the operation of the pump station.
FISCAL IMPACT: The total cost for recording the Easement will not exceed $18.50. Funds in the
amount of $18.50 are available in Wastewater User Fee Fund (414).
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this action.
LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires a
majority vote for approval. ---- JAB
RECOMMENDATION: To approve the Easement, authorize the Chairman to execute the Easement,
and direct the County Manager or his designee to follow all appropriate closing procedures and record the
Easement in the Public Records of Collier County, Florida.
