I. Roll Call Chairman Poteet called the meeting to order at 11:30 A.M. Roll call was taken and a quorum was established. Mr. Seef moved to allow Mr. Bromley to participate in the meeting via telephone due to an extraordinary circumstance. Second by Ms. Calkins. Carried unanimously 6—0. Ms. Lenhard was welcomed as a new member of the Committee. Brad Cornell, Audubon of Southwestern Everglades and Gladys Delgadillo, Conservancy of Southwest Florida were also present and were allowed to provide comments throughout the meeting. II. Approval of Agenda Ms. Patterson-Weber moved to approve the Agenda. Second by Ms. Calkins. Carried unanimously 7-0. III. Approval of April 8,2019 minutes Mr. Seef moved to approve the minutes of the April 8,2019 meeting as presented. Second by Ms. Pratt. Carried unanimously 6—0. Ms. Lenhard abstained as she was not serving on the Committee at the time of the meeting. IV. Coordinator Communications a. Results of Acquisition History item to the May 28th BCC Meeting Ms.Araque reported that at the recent Board of County Commissioners (BCC) meeting direction was given for development of an acquisition strategy plan before consideration will be given to the referendum language. b. Miscellaneous items None V. Referendum Language Task Force a. Review of information found to date i. Acquisition and other costs through FY18 Ms. Araque provided the "Conservation Collier Program 5/8/2019 Cash Sources& Uses FY03 through FY18"and "Total for All Cycles" spreadsheet for informational purposes. The following was noted during Committee discussions: • That the pie chart should be amended to reflect the timeframes from 2003 —2013, and 2013 —present given acquisition of properties were ceased in 2013 and reinitiated in 2018. • The "Land acquisitions& Capital Improvements" section should be separated into two different categories. • Mr. Seef has developed an optional format for on the"Total for All Cycles"which he will forward to Staff. 2 May 30, 2019 • It would be beneficial to include data on the amount authorized for land purchases during certain years versus funds actually spent for the "Total for All Cycles" spreadsheet as not all monies were expended in some years; as owners did not accept the County's offer for purchase. ii. Other action items Discussion occurred on the format the item will be presented to the BCC (Ordinance change vs. Resolution) and Ms. Belpedio noted that she will review historic data from the previous initiative to determine the most optimal format for the item. b. Proposed Components of ballot language Ms.Araque provide the "Project Management Plan: Drafting of Conservation Collier Ballot Language"for informational purposes. i. Schedule for November 2020 election The referendum is anticipated to be placed on the November 2020 ballot and Staff will confirm the deadlines required for the voting process. ii. Ad Valorem tax proposed Funding for this program is intended to be through an Ad Valorem Tax on the Collier County property owners. iii. Millage rate Millage rate would be set over a 10-year period. iv. Number of years for ad Valorem tax Ad Valorem Tax would be for a 10-year term to include a sunset provision. v. Allowance of bonding and/or a preference for a cap Bond funding is to be included in the referendum language, if not, it is possible the option may not be utilized by the County. The other alternative is to limit the program to "pay as you go." Mr. Williams will clarify the BCC's philosophy for the funding/financing and report his findings to the Committee. Discussion occurred on whether the referendum should provide specific program funding allocations for land acquisition, management and capital improvements. Concern was expressed designating categories with specific percentages for each funding allocation which; may limit the County's flexibility in utilizing the assets within the program. It may be more beneficial to simply cite the intended uses for the funds (i.e. including language such as "compatible public access and amenities" for the preserves or similar wording). c. Discussion of Project Management Plan and Task Force Timeline Ms.Araque provided the "Draft—Project Management Plan: Acquisition Plan" for informational purposes which outlined the timeline for development of the plan and delivery to the BCC. The Committee noted: 3 May 30, 2019 • That the intent is to deliver the proposed acquisition plan to the BCC in October, and the final ballot language in November. • It is anticipated that the BCC will consider the ballot language in December of 2019. • It would be beneficial to expand the responsibilities of the Referendum Language Task Force to include the development of the Acquisition Strategy Plan. • The referendum language and acquisition plan will be forwarded to the full Committee for consideration. • The next regularly scheduled Committee meetings are in July and October however, a meeting in September and/or November may be required to complete the tasks. d. Subcommittee for Acquisition Plan The Committee reported that the Task Force is charged with preparing the referendum language will now be the "Referendum Language and Acquisition Plan Task Force Subcommittee. " VI. Chair Committee Member Comments Chairman Poteet reported that he will be meeting individually with BCC Members to provide updates on the acquisition plan and referendum language, Staff may attend as well. PROJECT MANAGEMENT PLAN: DRAFTING OF CONSERVATION COLLIER BALLOT LANGUAGE PURPOSE & BACKGROUND On February 26, 2019 (Item #9C) the Board of County Commissioners voted to allow Conservation Collier Land Acquisition Advisory Committee (CCLAAC) to develop ballot language for the 2020 election. Subsequently, during their next quarterly meeting on April 8, 2019 the CCLAAC created the Referendum Language Task Force to draft language. The ballot language will ask voters to approve an ad valorem tax to continue to fund the Conservation Collier Program's acquisition and management of environmentally sensitive lands. The following provides a timeline to have the ballot language to the BCC by their first meeting in December 2019. TIMELINE ➢ April- June 2019 Conservation Collier Referendum Language Task Force meetings o April 29;May 9; and June 13, 2019 ➢ May 30,2019"Special" CCLAAC meeting scheduled o During the May 9 Task Force it was decided to have a Special CCLAAC meeting to discuss questions the full CCLAAC would like to take to the BCC ➢ June 13, 2109-Task Force drafted language and voted to send to July 8 CCLAAC ➢ July 8, 2019 CCLAAC meeting o CCLAAC discusses findings by the Task Force ➢ June-September Conservation Collier Referendum Language Task Force meetings ➢ October 14, 2019 CCLAAC o CCLAAC vote on the final ballot language to be sent to the BCC in November/December ➢ November BCC meeting o BCC votes on Ballot language provided by CCLAAC ➢ June 26, 2020-Ballot language due to Supervisor of Elections for November 3, 2020 General Election REQUIREMENTS FROM SUPERVISOR OF ELECTIONS For the final wording in English and Spanish is due June 26, 2020. The title is limited to 15 words and the body of the referenda is limited to 75 words. STAFF'S ROLE ➢ Assist CCLAAC with creating a timeline for developing the ballot question. ➢ Provide CCLAAC with examples of relevant past ballot initiative language ➢ Codify their proposed language recommendations, including the final ballot language that they(CCLAAC)will ultimately adopt to transmit to the BCC ➢ Schedule a regular agenda item discussion for CCLAAC to present their ballot recommendations to the Board. RUNNING LIST OF QUESTIONS FROM TASK FORCE TO BCC: 1. Is the BCC in agreement that the language shall go on the November 2020 ballot? 2. Is the BCC in agreement with keeping the funding as done in the previous ballot? a. Ad valorem tax? b. .25 Mill for 10 years with a sunset provision? 3. Is the BCC in agreement with allowing the option for bonding? If yes, is there a preference for a cap? KEY POINTS TO INCLUDE IN BCC EXECUTIVE SUMMARY 1. CCLAAC recommends following breakdown of monies a. 75%Acquisition with up to 10%of that for amenities Amenities may include boardwalks, facilities,parking lots, and interpretive staff b. 25% for Management 1 EXECUTIVE SUMMARY Recommend that an Agreement for Sale and Purchase be prepared to expand the boundary of the Winchester Head multi-parcel Project to include the Koch parcel (folio 39959960000) immediately adjacent to existing Conservation Collier owned multi-parcel Project. OBJECTIVE: Review request to expand the boundary of the Winchester Head multi- parcel project acquisition area to include the Koch parcel. CONSIDERATIONS: The Winchester Head Multi-parcel Project consists of 115 parcels and a total of 158.67 acres. To date,Conservation Collier has acquired 56 parcels for a total of 80.12 acres. The owner of a property adjacent to the Winchester Head Multi-parcel Project with folio#39959960000 approached Conservation Collier staff about selling the 1.14-acre property. Staff supports the requests for the following reasons: • The parcel is immediately adjacent to existing Conservation Collier land to the west. • There are 6 other vacant undeveloped properties between the Koch parcel and the nearest home. • The parcel consists primarily of Florida Natural Areas Inventory Priority 1 (highest ranking)land. • The property is mixed wetland hardwoods. Staff will evaluate other adjacent parcels with the pending Acquisition Plan and provide options to CCLAAC during review of the Acquisition Plan to expand the Winchester Head multi-parcel project area. If the CCLAAC finds the recommendation acceptable,an Agreement for Sale and Purchase will be prepared with a sales price based on an in-house appraisal consistent with the Conservation Collier Purchasing Policy. Such Agreement for Sale and Purchase will be brought back to the CCLAAC for future consideration. FISCAL IMPACT: A staff appraiser with the Collier County Government Real Property section will evaluate the parcel based on the appraisal reports done for the entirety of the Winchester Head multi-parcel area (Project) in July 2017. Staff contracted with two independent, state-certified, general real estate appraisal firms to appraise all parcels within the Project.The appraisers based their analyses on comparable sales from wetland, not upland parcels. The appraisals provided an averaged appraised value for parcels within the Project at $12,500 an acre. The in-house appraisal will reflect any market changes in the last two years since the area-wide appraisal evaluation. If the Board of County Commissioners approves the contract, the funds will be withdrawn from the Conservation Collier Trust Fund(172),from donation funds. GROWTH MANAGEMENT IMPACT: Fee simple acquisition of conservation lands is consistent with and supports Policy 1.3.1(e) in the Conservation and Coastal Management Element of the Collier County Growth Management Plan. LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires majority vote for approval. -JAB STAFF RECOMMENDATION: CCLAAC recommend that an Agreement for Sale and Purchase be prepared that would expand the boundaries of the Winchester Head multi-parcel project acquisition area to include the Koch parcel.
