LOCATED AT THE EASTERN CORNER OF THE
INTERSECTION OF DAVIS BOULEVARD AND TAMIAMI
TRAIL EAST IN SECTION 11, TOWNSHIP 50 SOUTH, RANGE
25 EAST, IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 67-1246, Laws of Florida,
and Chapter 125, Florida Statutes, has conferred on all counties in Florida the power to establish,
coordinate and enforce zoning and such business regulations as are necessary for the protection
of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 2004-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County; and
WHEREAS, on January 4, 2019, Insubstantial Site Development Plan Amendment SDPI-
PL20180002049 for Gateway (formerly known as Trio) was issued a denial letter by the Growth
Management Department for the reasons as set forth in the record; and
WHEREAS, Richard D. Yovanovich, Esq., representing London of Naples, Inc., filed
Petition ADA-PL20190000305, which appealed the administrative denial of SDPI-
PL20180002049; and
WHEREAS, on June 25, 2019, the Board of County Commissioners, acting as the Board
of Zoning Appeals (the Board), held a properly noticed public hearing to consider the appeal;
and
WHEREAS, all interested parties have been given the opportunity to be heard by this
Board in public meeting assembled, and the Board has fully considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA, that:
Petition Number ADA-PL20190000305, the appeal filed by Richard D. Yovanovich,
Esq., representing London of Naples, Inc., is hereby GRANTED for the reasons set forth in the
record of the proceedings of the public hearing held before the Board of County Commissioners,
acting as the Board of Zoning Appeals, on June 25, 2019, and SDPI-PL20180002049 is hereby
remanded back to the Growth Management Department for approval.

A future land use plan element designating proposed future general distribution, location, and extent of the uses of land for residential uses,
commercial uses, industry, agriculture, recreation, conservation, education, public facilities, and other categories of the public and private
uses of land. The approximate acreage and the general range of density or intensity of use shall be provided for the gross land area
included in each existing land use category. The element shall establish the long-term end toward which land use programs and activities
are ultimately directed.
Fla. Stat. §163.3177(6)(a)1
1. Each future land use category must be defined in terms of uses included, and must include standards to be followed in the control
and distribution of population densities and building and structure intensities. The proposed distribution, location, and extent of the
various categories of land use shall be shown on a land use map or map series which shall be supplemented by goals, policies, and
measurable objectives.

h. Provide guidelines for the implementation of mixed-use development including the types of uses allowed, the percentage
distribution among the mix of uses, or other standards, and the density and intensity of each use.

Section 1.05.01 - Purpose and Intent
F. In order to ensure that all development in unincorporated Collier County is consistent with the Collier
County GMP, it is necessary and proper to establish a series of zoning districts to ensure that each permitted,
accessory and conditional use is compatible with surrounding land uses, served by adequate public facilities,
and sensitive to natural and coastal resources. Each zoning district has its own purpose and establishes
permitted uses, uses accessory to permitted uses, conditional uses, dimensional standards and other land
use, density and intensity regulations and references, sign regulations, off-street parking and loading
regulations, landscaping regulations, and other regulations that control the use of land in each zoning district.
