EXECUTIVE SUMMARY

Recommendation to authorize a Stipulated Final Judgment in the amount of $108,000 for
Parcels 153 and 853 in the lawsuit styled Collier County v. Tech Foundation, Inc., et ai., Case
No. 03-2499-CA (Golden Gate Parkway Project No. 60027) and to authorize a budget
amendment. (Fiscal Impact $73,037.40)
OBJECTIVE: That the Board of County Commissioners authorize the attached Stipulated Final
Judgment for payment of full compensation, for the taking of Parcels 153 and 853 in the lawsuit
styled Collier County v. Tech Foundation, IIlC., et. al., Case No. 03-2499-CA (Golden Gate
Parkway Project No. 60027), and to authorize a budget amendment for payment of the stated funds.
CONSIDERATIONS: Collier County has condemned .417 acres for road right-of-way, drainage
and utility easements (Parcels 153 and 853) from property owners, Messiah Lutheran Church, Inc.,
of Golden Gate. The County's appraisals valued the takings at $67,100. The County offered the
owner $71,220 as the County's statutory offer on May 14,2003, based on the initial appraisal plus a
settlement incentive. The offer was not accepted. An Order of Taking hearing was held on
September 12, 2003, and the County deposited the sum of$67,100 in the Court Registry.
There is a disparity between owner's appraisal and the County's appraisal. The owner's appraisal,
in the amount of $226,900, includes compensation and severance damages for a reduction in the
setback and a reduction in parking spaces. The County's appraiser found no severance damages.
_. On September 16, 2009, the parties mediated the case and reached a settlement of $108,000.
Attached is a Stipulated Final Judgment. If approved, the County will be responsible for the

* Attorney's Fees are mandated by S73.092, F.S., and arc based on 33% of the total benefit
achieved, i.e., 0.33 x ($108,000 - $71,220).
FISCAL IMPACT: Funds in the amount of$ 73,037.40 are available in Impact Fee District 2
reserves. A budget amendment in the amount of $ 73,037.40 is needed from Impact Fee DistIiet 2
reserves. Source of funds are reserves.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. RNZ

RECOMMENDA TION: That the Board of County Commissioners authorize the Stipulated
Final Judgment as to Parcels 153 and 853, and to authorize all necessary budget amendments and
authorize payment of the funds as stated.

STIPULATED FINAL JUDGMENT
THIS CAUSE having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, by and through its undersigned counsel, and Respondent,
MESSIAH LUTHERAN CHURCH, INe., OF GOLDEN GATE, by and through its undersigned
counsel, for entry of a Stipulated Final Judgment as to Parcels 153 and 853 for Project No.
60027, and it appearing to the Court that the parties are authorized to make such Motion, the
Court finding that the compensation to be paid by Petitioner is the full compensation due the
Respondent, MESSIAH LUTHERAN CHURCH, INC., OF GOLDEN GATE, and the Court
being otherwise fully advised in the premises thereof, it is thereupon
ORDERED AND ADJUDGED that Respondent, MESSIAH LUTHERAN CHURCH,
INC., OF GOLDEN GATE, have and recover from Petitioner, COLLIER COUNTY, FLORIDA,
the total sum of One Hundred Eight Thousand and No 1100 Dollars ($108,000.00) for Parcels 153
and 853, as full payment for the property interest taken and for damages resulting to the remainder,
if less than the entire property was taken, and for all other damages in connection with said parcels;

ORDERED AND ADJUDGED that Petitioner, COLLIER COUNTY, FLORIDA, is
entitled to a credit for the good faith estimate of value previously deposited in the amount of
$67,100,00; it is further
ORDERED AND ADJUDGED that Petitioner, COLLIER COUNTY, FLORIDA, shall pay
Twelve Thousand One Hundred Thirty-Seven and 401100 Dollars ($12,137.40) in attorney's fees,
and no further attorney's fees or costs shall be awarded in this case; it is further
ORDERED AND AJUDGED that Petitioner, COLLIER COUNTY, FLORIDA, shall pay
Twenty Thousand and Noll 00 Dollars ($20,000.00) in expert fees and costs, and no further expert
fees and costs shall be awarded in this case.
ORDERED AND ADJUGED that within thirty (30) days hereof, the Petitioner shall pay to
Respondent, MESSIAH LUTHERAN CHURCH, INC., OF GOLDEN GATE, the total balance of
Forty Thousand Nine Hundred and No/IOO Dollars ($40,900.00), and mail it c/o Vanessa Thomas"
Esquire, Forman, Hanratty, Montgomery, 723 East King Street, Ocala, Florida 34471, for the
benefit of Respondent, MESSIAH LUTHERAN CHURCH, INC., OF GOLDEN GATE; it is
further
ORDERED AND ADJUDGED that within thirty (30) days hereof, Petitioner shall pay the
total sum Thirty-Two Thousand One Hundred Thirty-Seven and 40/100 Dollars ($32,137.40) to the
Forman, Hanratty, Montgomery Trust Account, c/o Vanessa Thomas, Esquire, Forman, Hanratty &
Montgomery, 723 East King Street, Ocala, Florida 34471, for proper disbursement of attorney's
fees, expert fees and costs in accordance with tllis order; it is further
ORDERED AND ADJUDGED that Parcels 153 and 853, identified as perpetual, non-
exclusive road right-of-way, drainage and utility easements, bcing fully described in Exhibit "A"
attached hereto and incorporated herein, is vested in Petitioner pursuant to the Order of Taking

County, Florida be dismissed as to Parcels 153 and 853; it is further
ORDERED AND ADJUDGED that pursuant to Section 74.051(4), F.S., the Clerk of
Courts shall disburse the interest earned on the funds on deposit in the amount of$592.59, plus any
additional accrued interest for parcels 153 and 853, to the Board of County Commissioners, account
number 333-163653-600274; it is further
ORDERED AND ADJUDGED that this Stipulated Final Judgment is to be recorded in the
Official Records of Collier County, Florida; it is further
ORDERED AND ADJUDGED that this Order disposes of all claims arising out of the
taking of Parcels 153 and 853 and that have or could have been asserted in this cause; it is further
