Agenda 12/01/2009 Item #16K 9 Agenda Item No. 16K9 December 1, 2009 Page 1 of 3 EXECUTIVE SUMMARY Recommendation to authorize the County Attorney to draft an ordinance creating the Marco Island Museum Advisory Board to report to the Board Of County Commissioners and to specifically review management and policy issues pertaining to the Marco Island Museum. OBJECTIVE: For the Board of County Commissioners ("Board") to authorize the County Attorney to draft an ordinance creating the Marco Island Museum Advisory Board report to the Board and to specifically review management and policy issues pertaining to the Marco Island Museum. CONSIDERATIONS: Collier County entered into a Marco Island Museum License Agreement with the .Marco Island Historical Society on May 13, 2003. The Agreement includes a requirement to establish a 'joint board of four members, two appointed by the County and two by the MIHS, which will plan, dcvelopment, implement, and maintain the policies, goals, and objectives of the museum." Thc County Attorney's Office recommends creating a County advisory board in compliance with Ordinance No. 01-55. as amended, regarding advisory boards. The MIHS has already designated two members: Bill Perdichizzi and Craig Woodward. The proposed ordinance will authorize the Board to designate the additional two members. Staff recommends that the Board designate two members from the County "at large." The ordinance .- will also provide that where a decision cannot be reached by the four person board, the advisory board will be required to report to the Board to break a potential "deadlock." The ordinance will also provide functions. powers and duties for the advisory board. StafT has recommendations for the ordinance which will seek to follow the Collier County Museum's current operating policies and seek to protect the museum's assets. The MIHS would like to use the museum for specific events and functions, including after hours events, and this policy will be reviewed by the new advisory board and presented to the Board. The proposed ordinance will require the Marco lsland Museum Advisory Board to make recommendations to the Board to fully define its functions, powers, and duties. FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no grov.1h management impact associated with this item. LEGAL CONSIDERA nONS: The County Attorney's Office will draft this ordinance after consultation with County staff and representatives from the Marco Island Historical Society.
