Agenda 12/01/2009 Item #16G 5 Agenda Item No. 16G5 December 1, 2009 Page 1 of 11 ~"'.- EXECUTIVE SUMMARY Recommendation that the County Attorney be authorized to file a lawsuit to evict Southern Motor Sports, Inc. a Florida Corporation and its principles, affiliate entities or persons, or any combination thereof, from CRA owned premises identified in Lease Agreement, dated November 14, 2008, including but not limited to, eviction, the pursuit past due rent, damages, and costs due and owing to Collier County CRA under the Lease Agreement and as otherwise provided by law. OBJECTIVE: That the County Attorney be authorized to file a lawsuit to evict Southern Motor Sports, Inc. a Florida Corporation, its principles, affiliate entities or persons, or any combination thereof, from CRA owned property identified in Lease Agreement, dated November 14, 2008 and since amended (Lease Amendment), including but not limited to, eviction, the pursuit of past due rent, damages, and costs due and owing to Collier County CRA under the Lease Agreement and as otherwise provided by law. . ,- CONSIDERATIONS: On November 14, 2008, Southern Motor Sports, Inc. and Corradi Cooper Street, Inc. ("Tenant") entered into a Lease Agreement for property located at 1936 David Boulevard ("Property"), located within the Bayshore Gateway Triangle Community Redevelopment Area. On September 16, 2009 the CRA purchased the Property and the Lease Agreement was assigned to the CRA (July 28, 2009, Agenda ItemJ4B). Tenant was advised of same by letter, dated October 6, 2009 which is made pm1 of this agenda item. The Bayshore/Gateway Community Redevelopment Agency Executive Director met with the tenants to discuss possible avenues in which the CRA could assist the business, such as, entering into a new lease with reduced rents, acceptance of partial payments, etc., and the tcnants were not responsive to the offers. On November 10, 2009, the County Attorney Office sent Tenant a letter advising that the rent is past due and that it had until November 18, 2009 to payor else legal action would be pursued (attached as backup). This item is to request that the Board authorize the County Attorney working in coordination with the Executive Director of the Bayshore Gateway Triangle Community Redevelopment Area to pursue such legal action. As of December I, 2009, $12,000.00, plus sales use tax is owed in past rent and delinquent water and sewer bills and there is no reason to believe that it is forthcoming. FISCAL IMPACT: The approximate out of pocket costs will be $325 (filing fee is $300 and service of process is $25). County Attorney and Bayshore Gateway Triangle Community Redevelopment Area staff time and resources are also necessary to pursue legal action. I f a lawsuit is pursued and the CRNCounty prevails it may receive a judgment and/or writ ordering rent, damages, and costs, or levy or propel1y. Such an Order would require further enforcement in order to get paid or obtain the property. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County ,-.
