Agenda Item NO.1 OC;; December 1. 2009 Page 1 of 8 , EXECUTIVE SUMMARY To obtain direction regarding the roles, responsibilities and reporting relationships for the position of Executive Director of the Collier County Airport Authority; approve the formal position description for recruitment purposes and authorize the appointment of an interim Director OBJECTIVE: To secure direction from the Board of County Commissioners on essential functions of the position of Executive Director - Airport Authority, including reporting relationship, allowing a search committee to commence the recruitment process, secure and interview candidates and recommend a suitable candidate to fill the upcoming vacancy in the position. CONSIDERATIONS: At the November 10, 2009, Board meeting, the Airport Authority asked the County Commission to consider a recommendation to approve and authorize the Authority to begin a search for a new Executive Director due to the resignation of the current Executive Director, Theresa Cook. Specifically, the Authority sought Board authorization to contract with an external recruitment firm to identify qualified candidates for this vacancy and to consider the appointment of an existing member of the Collier County Airport Authority Board to serve in the capacity of Interim Director during the period of the candidate search. ."*~ In the discussion period that followed, the Board weighed a number of factors to determine whether this was the appropriate time to approve the item and authorize a search to begin. In summary, rather than approving the item as recommended, the Board asked staff to bring back the following for review at the meeting of December 1, 2009: (1) Based on the Collier County Airport Authority Board's recommendation for an Interim Director, ask the Board of County Commissioners to approve an appointment to this position while an external search is conducted;' (2) Consider whether the essential functions and responsibilities of the position need to be re-evaluated to meet the needs of the organization now and into the future; and (3) Provide factors for a recruitment profile, including essential functions for the position from which a candidate search can be started. At a meeting held on Friday, November 20, 2009, the Collier County Airport Authority Board convened, with one item for discussion being item VIII.D., to adopt Resolution No. 10-08 appointing an individual to serve in the interim, beginning December 7, 2009 and selting the salary for the individual selected. During this meeting, the Airport Authority Board appointed Debra Brueggeman, an existing employee of the Airport Authority, to fill the interim role. Staff has researched and outlined below a number of options for consideration in defining the various roles, responsibilities and reporting relationships between the BCC, the Airport Authority and the Executive Director. It is important to note that further study may be required based on the direction provided by the BCC, as it is necessary to ensure compliance with Federal Aviation Administration and Federal regulations, Florida Statutes, and amend or update County Ordinances, Airport Authority Administrative Code and/or the Collier County Classification Specification for the essential functions of the position as needed. - Page 1 of 3 -.'. .^~."'---_.. , .'''''''.'''-''-- Agenda Item NO.1 OG December 1, 2009 Page 2 of 8 Qption #1: Maintain the current structure of the Airport Authority with no changes to the functions or duties of the Executive Director as outlined in the classification specification (as attached), with the Collier County Airport Authority Board recruiting, interviewing, selecting and recommending a candidate to the BCC for approval. This option is consistent with Ordinance No. 04-03 (Collier County Airport Authority Ordinance) and therefore no changes are necessary. With acceptance of this option, a subcommiltee appointed by the Airport Authority Board to select an Executive Director will review all applicant submissions, rank the applicants and make its recommendations to the Authority. At a noticed meeting, the Authority will vote on the selection, and if approved, the Authority Chairman will negotiate a proposed employment agreement with the selected candidate, inclusive of salary. Upon completion of the negotiations, the Authority will vote to accept the proposed agreement; once approved, the item will be placed on the agenda of the Board of County Commissioners. Upon final acceptance by the BCC, the offer will be extended to the individual selected. .Qption #2: Research changes to the Collier County Airport Authority Ordinance and/or Airport Authority Administrative Code amending the reporting relationship of the Executive Director, Airport Authority, situating the position similar to that of the County Community Redevelopment Agency Board's Executive Directors and having the position report directly to the Board of County Commissioners, acting as the Collier County Airport Authority Board, with the current Authority serving the new Board in an advisory capacity. ......, W~h acceptance of this option, it would be necessary to review the existing ordinance and administrative code, and make adjustments to the powers, functions and duties afforded to members of the Authority. Following adoption of any changes to the ordinance or code, the appropriate steps would be taken to complete recruitment in accordance with the changes. .Qption #3: Research changes to the Collier County Airport Authority Ordinance and/or Airport Authority Administrative Code amending the reporting relationship of the Executive Director, Airport Authority, situating the position similar to that of a County Manager's Agency Director position, having the pQsition report directly to the County Manager, or his designee. With acceptance of this option, it would be necessary to review the existing ordinance and administrative code, and potentially make adjustments to the powers, functions and duties afforded to members of the Authority. Following adoption of any changes to the ordinance or code, the appropriate steps would be taken to complete recruitment in accordance with the changes. .Qption #4: Research the feasibility of outsourcing the entire Airport Authority function, inclusive of the Executive Director and all staff. With acceptance of this option, it would be necessary to review the existing ordinance and administrative code, and potentially make adjustments to the powers, functions and duties afforded to members of the Authority. Following adoption of any changes to the ordinance or code, the appropriate steps would be taken to contract for the professional services of an Executive Director and Airport staff. ......." LEGAL CONSIDERATIONS: How to proceed is a policy decision. Each option as set forth above may be accomplished in a legally sufficient manner. Once an option is selected by the Board, the County Attorney's Office will work with staff on the documents that are necessary to implement the Board's decision - JBW Page 2 of 3 r--~ Agenda Item No. 10G December 1, 2009 Page 3 of 8 FISCAL IMPACT: Fiscal impact for recruitment of a new Executive Director of the Airport Authority is unknown at this time; to be determined based on the direction provided by the BCC. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. RECOMMENDATION: That the Board: 1. Direct the County Manager to proceed with one of the 4 options listed in the considerations section of this executive summary, or provide an alternative direction. 2. Depending on which option is selected, direct the County Manager to bring back the appropriate document(s) for the Board's subsequent approval and further direction. 3. Ratify the actions taken by the Airport Authority on November 20, 2009 in their adoption of Airport Authority Resolution No. 10-08 to appoint Debra Brueggeman in an interim status in the position of Manager - Airport, beginning December 7, 2009, continuing until a permanent Executive Director is hired or the date the Board of County Commissioners implements an alternative to hiring a permanent Executive Director. ESSENTIAL FUNCTIONS The following duties are normal for this position. The omission of specific statements of the duties does not exclude them from the classification if the work is similar, related, or a logical assignment for this classification. Other duties may be required and assigned. Selects, supervises, directs, and evaluates assigned staff, processing employee concerns and problems, directing work, counseling, disciplining, and completing employee performance appraisals; develops and oversees staff scheduling requirements. Conceives and prepares recommendations regarding policies, rules and regulations, directives, programs, agreements, leases and contracts and other documents, which may require the consideration, action or approval of the Airport Authority (the Authority). Implements the directives of the Authority with regard to all matters concerning the operations and functions of the Authority. Develops the annual budget for all airports; oversees and administers budgetary expenditures. Determines airport capital improvement needs and oversees projects. Prepares and administers the F ive- Year Master Plan, Annual Work Program, and Annual Report for the consideration, amendment and approval of the Authority. Develops and implements the Airport Development Program and grant funding program. Formulates and implements the Foreign Trade Zone for Collier County. Ensures compliance with all Federal Aviation Administration (FAA) and Florida Department of Transportation (FDOT) airport safety policies and regulations; oversees compliance with all Environmental Protection Agency, Department of Environmental Protection (DEP), and County regulations regarding fuel storage and fueling operations. Gathers information on new trends in the field of aviation. Manages the Authority's relationships with all regulating agencies such as FAA, FDOT, U.S. Fish & \\lildlife, Environmental Protection Agency (EP A), Florida Game and Freshwater Fish Commission, AmlY Corp of Engineers, Economic Development Administration (FDA), and United States Department of Agriculture (USDA). Develops and implements airport marketing plans and promotional programs to the aviation community and citizens of Collier County.
