06/25/2019 EXECUTIVE SUMMARY Recommendation to increase the estimated annual expenditure threshold for Purchase Order driven contract ITB # 18-7390, “Bottled Drinking Water and Point of Use Water Coolers.” OBJECTIVE: To obtain approval to increase the annual expenditure threshold for Purchase Order driven contract Invitation to Bid (“ITB”) # 18-7390, “Bottled Drinking Water and Point of Use Water Coolers” to $79,000. CONSIDERATIONS: Various County Divisions require the use of bottled drinking water and point o f use water coolers for various County Facilities and County-sponsored events throughout the year. The Division of Facilities Management is responsible for the oversight of the agreement. When this ITB was awarded on September 13, 2018, the annual expenditure estimated by staff was based on historical information and the expected needs for the foreseeable future. Additional demand from other Divisions is the driving factor in the request to increase the PO, and this demand was underestimated. Historical annual spend over the last three (3) fiscal years, including framework purchase orders, averages $60,000. Facilities continually conducts cost-benefit analysis on their contracts to ensure that the County is getting the best value services. Staff recommends increasing the annual threshold to $79,000 to ensure the agreement has the capacity in the event of a major incident, like a hurricane, that may spike demand. The Facilities Management Division is always looking for a way to provide best value opportuniti es for the organization and is working on the implementation of bottle water fill stations (for water fountains) as budget permits. Facilities Management, as the contract administrators, will continue cost containment efforts utilizing potable water, where and when available. FISCAL IMPACT: Funds are available in the Division of Facilities Management Operating Budget 001-122240 and other user division cost centers. The base annual amount to be spent under Purchase Order driven contract ITB #18-7390 is estimated to be $79,000 among the various Divisions. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. RECOMMENDATION: That the Board of County Commissioners authorizes an increase of the estimated expenditures threshold for Purchase Order driven contract ITB # 18-7390, “Bottled Drinking Water and Point of Use Water Coolers,” to $79,000. Correction to Local Vendor Preference Language on the Instruction to Bidders Form and Form 7: Vendor Submittal – Local Vendor Preference Affidavit: Current Language: Local business means the vendor has a current Business Tax Receipt issued by the Collier County Tax Collector for at least one year prior to bid or proposal submission to do business within Collier County, and that identifies the business with a permanent physical business address located within the limits of Collier County from which the vendor’s staff operates and performs business in an area zoned for the conduct of such business. A Post Office Box or a facility that receives mail, or a non-permanent structure such as a construction trailer, storage shed, or other non-permanent structure shall not be used for the purpose of establishing said physical address. In addition to the foregoing, a vendor shall not be considered a "local business" unless it contributes to the economic development and well-being of Collier County in a verifiable and measurable way. This may include, but not be limited to, the retention and expansion of employment opportunities, support and increase to the County's tax base, and residency of employees and principals of the business within Collier County. Vendors shall affirm in writing their compliance with the foregoing at the time of submitting their bid or proposal to be eligible for consideration as a "local business" under this section. A vendor who misrepresents the Local Preference status of its firm in a proposal or bid submitted to the County will lose the privilege to claim Local Preference status for a period of up to one year under this section. The vendor, at a minimum, must achieve the requirements of the Specifications or Scope of Work stated. The results of this solicitation may be used by other County departments once awarded according to the Board of County Commissioners Procurement Ordinance. Various Collier County Government departments on and off the Government Center’s main campus at Tamiami Trail East, Naples Florida, require the services of a vendor to lease water coolers and replacement drinking water bottles, and/or to provide and deliver bottled drinking water in various size containers. Historically, the County has spent approximately $42,000 on average over the past 3 years on bottled drinking water. In addition, the County would like to obtain prices for an alternative option to drinking water bottles—the purchase of bottleless water coolers or point-of-use water coolers that filter tap water and dispense hot and cold water. These coolers may be ordered individually by County departments for their use at their request. BACKGROUND Collier County is interested in pursuing an agreement with a vendor who can provide lease bottled water coolers, purchase, deliver cooler replacement bottles, purchase point-of-use water coolers and replacement filters, and/or purchase and deliver bottled water to various County offices. TERM OF CONTRACT The contract term, if an award(s) is made is intended to be for three (3) years with two (2) one (1) year renewals. Prices shall remain firm for the initial term of this contract. Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. All goods are FOB destination and must be suitably packed and prepared to secure the lowest transportation rates and to comply with all carrier regulations. Risk of loss of any goods sold hereunder shall transfer to the COUNTY at the time and place of delivery; provided that risk of loss prior to actual receipt of the goods by the COUNTY nonetheless remain with VENDOR. AWARD CRITERIA ITB award criteria are as follows: The County’s Procurement Services Division reserves the right to clarify a vendor’s submittal prior to the award of the solicitation. It is the intent of Collier County to award to the lowest, responsive and responsible vendor(s) that represents the best value to the County. DETAILED SCOPE OF WORK The County is interested in contracting with a vendor who will: 1. Provide pricing for the rental of Bottled Water Coolers inclusive of all charges, including but not limited to the product, equipment, bottled water, transportation and delivery, semi-annual cleaning program, labor, and any other charges. The rental shall include a preventive maintenance program on a semi-annual basis (every six months) which includes the cleaning of all rental equipment and replacement of defective or non-working parts. Turnaround time to provide service shall be within 24 hours of contact by the County department. 2. Provide pricing for Point-of-Use Water Coolers, (Technical Specifications below) or equivalent, inclusive of all charges, including but not limited to the purchase price of the equipment, warranty, filter, shipping and handling and any other charges. An equivalent product may be substituted as long as it meets the majority of the specifications listed below. The County shall determine whether the substitute product meets the required specifications. 3. Provide several types of bottled drinking water in different sizes and amounts inclusive of shipping and handling charges.
