EXECUTIVE SUMMARY
Recommendation to approve a Resolution for final acceptance of the private roadway and drainage
improvements for the final plat of Legacy Lakes, Application Number PL20140002259, and
authorize the release of the maintenance security.
OBJECTIVE: To have the Board of County Commissioners (Board) grant final acceptance of the
infrastructure improvements associated with the subdivision, accept the plat dedications, and release the
maintenance security.
CONSIDERATIONS:
1) On October 5, 2015, the Growth Management Department granted preliminary acceptance of the
roadway and drainage improvements in Legacy Lakes.
2) The roadway and drainage improvements will be maintained by the Legacy Lakes homeowner’s
association.
3) The required improvements have been constructed in accordance with the Land Development
Code. The Growth Management Department has inspected the improvements and is
recommending final acceptance of the improvements.
4) A resolution for final acceptance has been prepared and approved by the County Attorney's
Office. The resolution is a requirement of Section 10.02.05 C of the Land Development Code. A
copy of the document is attached.
FISCAL IMPACT: The roadway and drainage improvements will be maintained by the Legacy Lakes
homeowner’s association. The existing security in the amount of $1,546,702.62 will be released upon
Board approval, and pursuant to the terms of the Construction and Maintenance Agreement dated October
30, 2015.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. - SAA
RECOMMENDATION: To grant final acceptance of the roadway and drainage improvements in
Legacy Lakes, Application Number PL20140002259, and authorize:
1. The Chairman to execute the attached resolution authorizing final acceptance of the
improvements, and acceptance of the plat dedications.
2. The Clerk of Courts to release the maintenance security.

of Collier (lounty. Inc.. a F lorida not-fbr-profit corporation. hereinafter ref-erred to as
"Developer," and the Board ol'County Clommissicrners ol'Collic-r County. Florida. hereinalier
ref'erred to as the "Board.
RECITALS:
A.
l)eveloper has, simultaneously with the delivery of this Agreement, applied lor the approl'al
by the Board of a certain plat of a subdivision to be knorvn as: I,EGACY I.AKIrS
Chapters 4 and l0 of the Collier County I-and Developnrent Code requires the Developer to
post appropriate guarantees fbr the construction of the irnprol'ements required by said
subdivision regulations, said guarantees to be incorporated in a bonded agreemcnt fbr the
construction of the required improvements.
NOW. T'IIEREF'ORE, in consideration of the fbregoing premises and mutual covenants
hereinalter set fbrth. Developer and the Board do hereby covenant and agree as firllows:
Developer will cause to be construcled: Roadway, drainage, water & sewer lmprovements
rvithin l2 months fiom the date of approval said subdivision plat, said improvements
hereinafier ref.erred to as the required improvements.
Developer herewith tenders its subdivision perfbrmance security (attached hereto as
F.xhibit "A" and by ref'crence made a part hereof) in the amount of one million, five
hundred tbrty six thousand, seven hundred and two dollars and sixty two cents.
($1,546,702.62) which amount represents l0% of the total contract cost to conrplete
construction plus 100% of the estimated cost to complete the required improvements at
the date ol this Agreement.
In the event of detault by the Developer or failure of the Developer to complete such
improvements within the time required by the [-and Development Code, Collier
County, may call upon the subdivision performance security to insure satisfactory
completion of the required improvements.
1'he required irnprovements shall not be considered complete until a statement of
substantial completion by Developer's engineer along with the final project records
have been firmished to be reviewed and approved by the County Manager or his
designee for compliance rvith the Collier County [.and Developmcnt Code.

'['he County Manager or his designee shall. rvithin sixty (60) days of receipt of the
staternent of substantial completion, eitl.rer: a) notify the [)eveloper in writing of his
prelinrinary approval ofthc improvenrents; or b) notity the Developer in rvriting olhis
refirsal to approve irrprovements. therer.vith speciti.ing those conditions which the
Dcveloper must f'ulfill in order to obtain the County Manager's approval of the
irnprovements. Howerer, in no event shalI the C)ounty Manager or his designee ref'use
prelirninary approval ofthe improvements ilthey are in lact constructcd and submitted
ftlr approval in accordance with the requirerrents of this Agreement.
['he Developer shall maintain all required improvements fbr a minimum period ol'one
year after preliminary approval by the County Manager or his designee. Afier the one
year maintenancc pcriod by the Developer has terminated, the Developer shall petition
the Countv Manager or his designee to inspect the required improvements. 'Ihe County
Manager or his designee shall inspect the improvements and. if found to be still in
compliance with the Collier County Land Development Code as reflected by final
approval by the Board. the Board shall release the rentaining l0% of the subdivision
perfbrmance security. The Developer's responsibility lbr maintenance of the required
inrprovements shalI continue unless or until the []oard accepts maintenance
responsibility for and by the County.
Six (6) months after the execution ol this Agrcement and once within every six (6)
rnonths therealler the Developer may request the County Manager or his designee to
reduce the dollar amount of the subdivision perf<rrmance security on the basis of work
complete, Each request tbr a rcduction in the dollar irmount of the subdivision
perfbrmance security shall be accompanied by a statement of substantial completion by
the Developer's engineer together with the projcct records necessary fbr review by the
C'ounty Manager or his designee.'fhe County Manager or his designee may grant the
request fbr a reduction in the amounl of the subdivision pertbrmanoe security fbr the
improlcments completed as of the date of the request.
In the event the Developer shall iail or neglect to lultlll its obligations under this
Agreemenl, upon certilication t-ll'such failure. the County Manager or his designee may
call upon the subdivision perforrnance security to secure satisf'actory completion.
