EXECUTIVE SUMMARY
Recommendation for the Board of County Commissioners (BCC) to approve a Resolution
designating approximately 17.665 acres of land owned by the Community Redevelopment
Agency (CRA) as a Brownfield Area; designate the Bayshore Gateway Triangle
Redevelopment Agency Local Advisory Board as the Bro'wnfield Advisory Committee; and
authorize the County Manager, or his designee, to notify the Department of Environmental
Protection of said designation.
OBJECTIVE: To designate, by Resolution, approximately 17.665 acres of land owned by the
Community Redevelopment Agency (CRA) as a Brownfield i\rea; designate the Bayshore
Gateway Triangle Redevelopment Agency Local Advisory Board as the Brownfield Advisory
Committee; and authorize the County Manager, or his designee, to notify the Department of
Environmental Protection (DEP) 0 f said designation.
CONSIDERATIONS: The CRA has purchased and assembled four (4) contiguous parcels of
land approximately 17.665 acres in size on Bayshore Drive f()r redevelopment (Exhibit A). The
CRA has been working on a plan to redevelop this site with a reuse that will catalyze
redevelopment along the Bayshore Drive COlTidor.
-. The site consists of a vacant 17+-acre parcel and 4315 Bayshore Drive, a 0.63 acre parcel. The
0.63 acre parcel was a gasoline station and automotive repair shop with related uses for nearly
four decades. A Phase II study documented ground contamination stemming 11'Om underground
storage tanks that stored leaded gasoline from 1969 to 1980 (see Exhibit B). As such, this site
meets the criteria to receive designation as a Brownfields Area.
Brownfield areas are general1y abandoned, idled, or underutilized commercial or industrial
properties where expansion or redevelopment is complicated by actual or perceived
environmental contamination. Designated Brownfield areas provide a variety of economic
incentives, including a $2,500 Job Bonus Refund for each new job created in the Brownfield area
by an eligible business.
\Vithin the 17+-acre project, one parcel in tbe site is known to have petroleum contamination and
the CRA is obligated to submit a Site Assessment Report (SAR) to the Florida Department of
Enviromnental Protection (OEP) by May 3, 2010. To meet this obligation, the CRA has retained
an engineering finn to work on the site, which is cunently underway. For the CRA to be eligible
for Brownfield benefits incUlTed during cleanup and remediation in the 2009 Tax Year, the
Brownfield area must be designated by December 31, 2009.

Because this site within the proposed Brownfield area is actually contaminated and is undergoing
environmental remediation, the CRA plans to execute a Brownfield Site Rehabilitation

Agreement (BSRA) with DEP which will make the site eligible for several more tax incentives
including:
. Voluntary Cleanup Tax Credits (VCTC);
· Cleanup liability protection;
. Low-interest loans for assessment and cleanup;
. Sales tax exemption on building materials; and
. State loan guarantees.
The BSRA must be executed by December 31, 2009 between the Board of County
Commissioners and DEP to qualify expenses incurred in the 2009 tax year for the above benefits.
There are no fiscal impacts associated with entering into a BSRA with the DEP and the duration
of time for which the CRA will be committed to remediate the site will be contingent upon
discovery. The BSRA will allow for mid-project adjustments without penalties in the event there
are unanticipated complications with the site's remediation. The BSRA will come before the
Bce under a separate agenda item in December.
ADVISORY BOARD RECOMMENDATION: During its October 6, 2009 regular monthly
meeting, the CRA Local Advisory Board, by unanimous vote, suppOlied this designation and
requested that the Board of County Commissioners designate the Bayshore Gateway Triangle
CRA Advisory Board as the Brownfields Advisory Committee for any and all Brownfield Areas
in the Bayshore Gate\vay Triangle Redevelopment Area, as required and provided for in
376.80(4) of the Florida Statutes.
FISCAL IMP ACT: There is no fiscal impact to designate the Brownfie1ds Area other than staff
time and cost to advertise public meetings. Initial FY201 0 remediation activities in the amount of
$49,200 will be funded by a "seller's escrow" account fi'om the proceeds of the sale of 4315
Bayshore Drive in the amount of $100,000. There is no Fund 187 TIF involved at this time.
GRO\VTH 1\fANAGEMENT IMPACT: The Brownfields Area designation of the 17.665 acre
CRA site is deemed to be consistent with the Economic Development Element (EDE) and the
Future Land Use Element (FLUE) of the Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attomey's Office, and is legal1y sufficient for Board action. (STW)
RECOM1\IENDATION: That tbe Board of County Commissioners approve the attached
Resolution designating a Brownfield Area within the Bayshore Gate\vay Triangle eRA for
rehabilitation purposes in accordance with Sections 376.77-377.85, Florida Statutes, designates
the eRA Local Advisory Board as the Bro\vnfields Advisory Committee, and authorize the
County Manager, or his designee, to notify the Department of Environmental Protection of said
designation.

ECONOMIC DEVELOPMENT AND ENVIRONMENTAL

COMMITTEE: AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Collier County Community Redevelopment Agency (CRA), owns 17.665 acres (more or
less) on Bayshore Drive. Naples. Florida (the "Property") the legal description of which is attached hereto as
Exhibit A and as depicted on Exhibit G. attached hereto. both or \\ hich are incorporated herein by the this
reference; and
WHEREAS, Collier County Community Redevelopment /\gency, proposes to redcvelop the proper1y to
facilitate economic development and environmental remediation. ifneeded: and
WHEREAS, Collier County Community Redevelopment J\gency, requests that the Collier County Board
of County Commissioners designate the Property a Brownfield Area as authorized under the Florida Brownfields
Redevelopment Act. Sections 376.77 - 376.85. Florida Statutes; and
WHEREAS, the CRA Goard requests that the Bayshore Gatewa} Triangle Local Advisor)' Board serves
as the Brownfields Advisory Committee for any and all Brownfields Areas in the Bayshore Gateway Triangle
CRA, and
WHEREAS. the Brownfields Redevelopment Act authorizes this Board. by Resolution. to designate
contiguous areas consisting of one or more Brownfields sites as Brownfields Areas to facilitate environmental
remediation, ifneeded, and to facilitate economic development: and
WHERE/\S, all of the designated Brownfield Area is within a Collier COllnty designated Community
Redevelopment Area (Bayshore Gateway Triangle component): and

NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, that:
Section I. Findings. The Commission, acting as the governing body of Collier. County and the
Community Redevelopment Agency, finds the preamble bereofto be true and correct.
Section 2. Designation. For the purposes of the Florida Brownfield Redevelopment Aet, Sections
376.77 - 376.85, Florida Statutes., the Property attached hercto as Exhibit A and as depicted on Exhibit B, is
hereby designated a Brownfield Area. The area is within a Collier County Community Redevelopment Area is
hereby designated for environmental remediation. if needed. and for redevelopment purposes per Sections 376.77
through 376.85, Florida Statutes. This designation shall not render Collier County liable for costs of site
rehabilitation or source removal (as defined in Sections 376.77 through 376.&4, Florida Statutes) nor for any other
costs above and beyond such costs otherwise attributable to Collier Count)' in its role as property owner of all of
the subject designated Brownfield Area.
Section 3. Advisory Committee. The Bayshore Gateway Triangle CRA Local Advisory Board shall
serve as the Brownfields Advisory Committee for any and all Brownfields Areas designated within the Bayshore
Gatel,.l..ay Triangle eRA boundary.
Section 4. Notification. The County Manager &hall notify the Florida Department of Environmental
Protection, pursuant to Section 376.&0. Florida Statutes, of this Brownfield Area designation.
Section 5 Officers and employees of Collier County and Community Redevelopment Agency are
hereby authorized to do all things necessary and proper to carry out the intent and purposes of this Resolution.
Section 6. This Resolution shall take effect immediately upon passage and adoption. This
Resolution adopted after motion, second and majority vote this ___ day of November 2009.

Dear Mr. Jackson:
Environmental Risk Management Inc. (ERM1) has prepared this Phase II Environmental
Site Assessment (ESA) report of the abo\'e referenced subject property in accordance
\'\'ith our Contract Agreement executed on April 24, 2008. Please refer to Figure 1 and
Figure 2 for the Site Location Map and Site Plan. respectively.
1.0 PROJECT UNDERSTANDING
ER\1I's Phase I ESA identified the following potential environmental concems:
· The Hubert's Welding & Repair facility, subject property, is listed in the
FDEP Storage Tank RepOli for previously maintaining three Underground
Storage Tanks (LST'sl. Based on oeu L US research and regulatory fi Ie
review, the CSTs have been closed in place. However, ERMI found no
evidence of the filing of a Tank Closure Assessment Report crCAR)
which has been a requirement under Chapter 62-761, Florida
Administrative Code (FAC) since approximately 1986. This
environmental regulation requires the completion of a TeAR at the time
the tanks are closed in-place or removed from the site. The TCAR
documents the specific tank closure procedures that \vere conducted and
assesses the soil and groundwater quality in the localized area of the tank
system. Since these tanks were closed in-place prior to 1986, a TCAR
was not required at that time. Ho\\e\er. no assessment of soil and/or
groundwater quality in the localized area of the former tank s}'stem was
ever documented. Therefore. this former on-site tank system area is an
environmental concern. Further investigation can be done to gain additional
security regarding the potential f()r environmental risk within the above
referenced area. This decision to conduct sampling and analyses would be
the user's decision. and should be based on the user"s risk tolerance.

· A hydraulic lift station was observed on the subject property during the
site reconnaissance. The hydraulic lift was located on concrete.
Hydraulic lifts have the potential to leak hydraulic fluids, which could
impact the soil and groundwater in the vicinity of the lift. Concrete
staining was observed in connection with the hydraulic lift station. This is
defined as a REC according to the ASTM International Standard
designation E 1527-00.
· Several storage containers of various sizes were observed on the subject
property during the site reconnaissance. The containers were located on
concrete and contained lavv'nmower and various automobile parts and
vehicular oils. Several areas were observed to have concrete staining.
Further investigation can be done to gain additional security regarding the
potential for environmental risk v,'ithin the above referenced areas.
However, this decision to conduct sampling and analyses would be the
user's decision, and should be based on the user's risk tolerance.
2.0 PHASE 1/ ESA SCOPE OF WORK
On April 30, 2008, ERl\11 conducted the following scope of work:
· ERMI installed two Temporary Monitoring Wells (TMWs) on the subject
property within the areas most likely to be impacted. These areas are identified in
the Project Understanding.
· ERMI field screened the soils removed at 2-foot depth intervals from the well
installations and the borings conducted at randomly selected locations within the
area of the UST farm with an Organic Vapor Analyzer (OVA). Soil boring logs
and field notes are included in Appendix A.
· ElU\1I collected one soil sample from the former dispenser area at the depth
interval determined to have the highest OVA screening value. The soil sample
was submitted to Environmental Science (ESe) Laboratory and analyzed for
common petroleum constituents via EP A Methods 8021 Band 8310.
· ERMI collected groundwater samples from the temporary monitoring well
locations. The groundwater samples were submitted to ESC Laboratory and
analyzed for common petroleum constituents via EPA \t1ethods 8021 Band 8310.
· ERMI interpreted the soil and groundwater quality findings and correlated the
results with the applicable FDEP documented Chapter 62-770, Florida
A..dministrative Code (FAC) cleanup target levels to assess the on-site soil and
groundwater quality at the sample locations. ERMI prepared this final Phase I I
ESA report with graphics to summarize the results of the above referenced scope
of work.

3.0 SOIL ASSESSMENT
3.1 Soil Assessment Methodology
The general methodology for the soil assessment was derived from the FDEP
"Guidelines for Assessment and Source Removal of Petroleum Contaminated Soil"
dated Mav 1998. Our methodology consisted of field screening soil samples. During
the field event on April 30. 2008. ERMI collected soil samples for OVA screening
from six soil borings (SB-l through SB-6). Grab soil samples \vere taken at
approximately 2-foot depth intervals to approximately 1-2 feet \vithin the
groundwater table. A Site i\1ap is included as Figure 2. \vhich illustrates the
locations of the six soil borings.
3.2 Soil Field Screening and Results
On April 30. 2008. ERMI collected soil samples from the SIX soil borings (S8-1
through S8-6) for in-thc-field OVA screening purposes. This screening \vas
completed to investigate \vhethcr any petroleum hydrocarbons were present in soil
above and near the surface of the groundwater table at concentrations considered
representative of impacts that may be considered "excessively contaminated". The
field screening of these samples was conducted using a Photo-Ionization Detector
(PID) OVA. OVA screening was conducted by collecting soil from a stainless steel
hand auger then transfening the soil samples into 16 ounce mason jars. ERI\,lI uses
the soil sample headspace screening procedure, as described in Section 4.1 of the
FDEP "Guidelines for Assessment and Source Removal of Petroleum Contaminated
Soil" dated Mav ] 998. The PID/OV/\ was field calibrated prior 10 use. ERMI
collected one soil sample (S8-5 7ft) for laboratory analysis. The soil borings were
backfilled after sampling.
In-the-field OVA results indicated detections of petroleum related volatile organics in
the soil samples collected. Please refer to Figure 2 for the sample locations and
Appendix A for soil boring logs and OV A results.
3.3 Soil Laboratory Analytical Results
ERMI collected one soil sample from the boring depth interval that displayed the
highest OVi\ reading and/or olfactory observations for laboratory analysis. The soil
sample collected was transferred to the appropriate laboratory sample containers and
placed in an iced cookr and delivcred ovcrnight to ESC laboratory for analysis. The
soil sample submitted was analyzed for common petroleum constituents via EPA
Methods 8021B and 8310.

documentation are included in Appendix B.

(0.52 milligrams per kilogram (mg/kg)), Toluene (2.6 mg/kg), Total Xylenes (3.6
mg/kg), and Methyl Tert-butyl ether (0.94 mg/kg), which all exceed their applicable
FDEP commercial Soil Cleanup Target Levels (SCTLs), as per Table V of Chapter
62-777 F AC (effective April 17,2005). Please refer to Table 1 for a summary of soil
lab results.
4.0 GROUNDWA TER ASSESSMENT
4.1 Well Construction and Installation
On April 30, 2008, ERMI installed two Temporary Monitoring Wells (TMW-l and
TMW-2) to a depth of approximately 6 feet using a clean, manual hand auger with a
3.25-inch diameter bucket. TMW-l and TMW-2 were constructed of 2-inch diameter
PYC with 5 feet of 0.010 inch slotted screen section. The annular space between the
well and the borehole was then filled with 20/30 grade silica sand to fom1 a filter pack.
The temporary wells were removed and backfilled after sampling. The location of
TMW-l and TMW-2 are presented in Figure 2.
4.2 Groundwater Sampling Methodology
On April 30, 2008, ERMI personnel collected groundwater samples from the
temporary monitoring wells (TMW-l and TMW-2) in accordance with the
established FDEP SOP 011001 FS 2200 Groundwater sampling protocol document
dated, April 9, 2007. The \vells \vere purged prior to sampling using a peristaltic
pump. Purge water was dispersed onto the land surface and allowed to evaporate or
retum to the surficial aquifer. The \vells were purged until they met purge completion
criteria. The groundwater samples were submitted to ESC Laboratory for analysis.
The samples collected from TMW-l and TMW-2 were analyzed for petroleum
constituents by EPA Methods 8021 Band 8310. Groundwater sampling logs are
included in Appendix A and the location of TMW-l and TMW-2 are presented in
Figure 2.
4.3 Groundwater Laboratory Analytical Results
Copies of the complete laboratory analytical data report and sample chain-of-custody
documentation are included in Appendix B. Please refer to Table 2 for a summary
of groundwater lab results.
Analyses of groundwater samples collected from temporary monitoring \vell TMW-l
yielded detectable concentrations of I -Methylnaphthalene (39.0 micrograms per
Liter. /-!g/L), 2-Methylnaphthalene (43.0 /-!g/L) and Naphthalene (36.0 ~tg/L) that
slightly exceed their applicable State of Florida Groundwater Cleanup Target Levels
(GCTLs), per Table Y of FAC Chapter 62-777 (effective April 17, 2005). Analyses
of samples collected from TMW-2 yielded detectable concentrations of Benzene
(5 1.0 /-!g/L), Ethylbenzene (120.0 ~lg/L), Total Xylenes (680.0 /-!g/L) and Methyl tert-
butyl ether (29.0 ~lg/L) that exceed their applicable State of Florida GCTLs, per Table
Y of F AC Chapter 62-777 (effective April 17,2005).

5.0 CONCLUSIONS AND RECOMMENDA TlONS
In-the-field OVA results indicated elevated detections of petroleum related volatile
organics in the soil samples collected from our subsurface assessment. Laboratory
analyses of soil sample SB-5 @ 7ft yielded detectable concentrations of Benzene (0.52
milligrams per kilogram (mg/kg)), Toluene (2.6 mg/kg), Total Xylenes (3.6 mg/kg), and
Methyl Tert-butyl ether (0.94 mg/kg), \vhich all exceed their applicable FOEP
commercial Soil Cleanup Target Levels (SCTLs), as per Table V of Chapter 62-777
FAC (effective April 17,2005).
Laboratory analyses of groundwater samples collected from temporary monitoring \vell

pg/L), Ethylbenzene (120.0 ,ug/L), Total Xylenes (680.0 ~lg/L) and Methyl tert-butyl
ether (29.0 flg/L) that exceed their applicable State of Florida GCTLs, per Table V of
FAC Chapter 62-777 (effective :\pril 17,2005).
The data collected from the completion of this Phase II ESA conducted at this facility
meets the definition for the discovery of a discharge of petroleum products at
concentrations that exceed the State of Florida allowed cleanup target levels, as outlined
in F AC rule 62-770.200 (16). Based on this information, ERMI recommends that the
facility owner or operator follow the Contamination Reporting procedures as required in
the environmental regulation referenced in Chapter 62-770.250, FAC. In summary, this
regulation states that the 0\\11Cr or operator is required to submit a discharge reporting
form (ORF) to the State of Florida upon the discovery of excessive petroleum product
contamination at their facility. Additionally, it states that the owner must initiate a Site
Assessment Report (SAR) within 30 days of the discovery of excessive contamination.
The SAR is required to horizontally and vertically delineate the extent of the recently
discovered excessive petroleum impacts. Additionally, this regulation states that the
SAR is required to be submitted to the FOEP within 270 days (9 months) from the date
of the discovery of excessive contamination.
