EXECUTIVE SUlVIMARY
RECOMMENDATION THAT THE BOARD OF COUNTY COMMISSIONERS APPROVE THE
DONATION OF AN ENCLOSED TRAILER TO SAMUEL A. CADREAU, INDIVIDUAL, MEMBER
OF THE FREEDOM MEMORL\L TASK FORCE. (COMMISSIONER COYLE)
OBJECTIVE: That the Board of County Commissioners approve the transfer of one surplus enclosed trailer
in the Alternative Transportation Modes inventory to Samuel A. Cadre8u, individual, member of the Freedom
Memorial Task Force.
CONSIDERATIONS: The Freedom Memorial Task Force members are responsible for the fundraising
campaign for the Freedom Memorial; a total of $1.6 million dollars. The Task Force members frequently
attend farn1ers markets, community sales, and organizational meetings to promote the Freedom Memorial and
increase revenue through sales and solicitations. The Members are responsible for transpOliing t-shirts,
infonnational and educational materials, the Freedom Memorial model, banners, and a 600 pound piece of
steel from the original Twin Towers, The Task Force Members request the trailer be transfened to Samuel A.
Cadreau, individual, for the ease of transpOliing all items together; safely and securely. The Fleet
Management Department has advised that a ] 990 6x 1O-foot enclosed trailer (Asset #910076) is available.
The unit is no longer needed by County departments and has no commercial value.
In accordance with the authOlity, it is recommended that the Board fOl1nally approve the transfer of this trailer
to Samuel A. Cadreau, individual, member of the Freedom MemOlial Task Force.
FISCAL IMPACT: There is no fiscal impact related to this item.
GROWTH MANAGEMENT IMPACT: There is no fo'TOwth management impact related to this item.
LEGAL CONSIDERATIONS: Florida Statutes Section 274.06 provides that property which has no
commercial value "may be donated, destroyed, or abandoned. The detennination of property to be disposed of
by a governmental unit pursuant to this section instead of pursuant to other provisions of law shall be at the
election of such governmental unit in the reasonable exercise of its discretion." This statutory provision has
been carried into the County's Purchasing Policy as follows:
XXIII. SURPLUS COMMODITIES AND TANGIBLE PERSONAL PROPERTY
D, Disposition of Assets: The Director shall have the authority to determine whether previously-acquired
items (including assets) that are no longer useful to the agency have commercial value and ifnot, to dispose
of such items in an appropriate manner \"ith or without offeIing such items for sale, trade or donation to other
entities. The Fixed Assets Section of the Clerk of Courts' Finance Division will submit a quarterly report that
identifies any assets that are disposed orunder the provisions of this subsection.
Staff has determined that in their best judgment this trailer bas no commercial value.
To limit the County's exposure, the transfer should be accomplished as an "As Is" transaction, subject to
review by this Office. This item ]s otherwise legally sufficient for Board action.
