Agenda 11/10/2009 Item #16D 2 Agenda Item No. 16D2 November 10, 2009 Page 1 of 8 EXECUTIVE SUMMARY Recommendation to adopt a Resolution establishing the Collier County Domestic Animal Services Fee Policy as of December 1, 2009 and superseding resolutions 95-107, 95-106, 93-404, 2008-251 and all other resolutions establishing animal services-related fees. Obiective: To establish user fees which will partially offset the cost of providing domestic animal services to the taxpayers of Collier County. Considerations: Staff has prepared changes to the comprehensive fee policy, incorporating fees established in 2008. A summary of proposed increases/changes is as follows: ,- · Section II Limitations, Safekeeping: Change the language stipulating the required reclaim time frame from "before the end of the next business day" to "within the standard holding period." This change allows the Department to be of more assistance to members of the public in times of emergency. · Section III Fees, Impoundment: Waive impoundment and boarding fees for cats and dogs that at the time of impoundment have a CU1Tent County license and that are reclaimed by their owner before the end of the second business day. This change to the fee policy is an incentive for animal owners to purchase a Collier County license yearly for their pets. · Section III Fees, Licenses: Increase licensing fees for unaltered dogs and cats over a year old from $30 to $60. The indiscriminate reproduction of unaltered animals is the root cause of pet overpopulation, which results in the impoundment of thousands of animals at Domestic Animal Services each year. This fee increase is reflective of the cost of providing services necessitated by pet overpopulation. · Section III Fees, Licenses: Provide for a $50 refund of the unaltered license fee of $60 to that of the spayed or neutered fee rate of $10 when the owner presents proof that the animal has been spayed or neutered within 30 days of the purchase. This change is an incentive to animal owners to spay or neuter their pet, thereby decreasing pet overpopulation in Collier County. These changes were reviewed and recommended for approval by the Domestic Animal Services Advisory Board at their regularly scheduled meeting September 15,2009. Fiscal Impact: The number of unaltered animals whose owners purchase licenses annually is relatively small. This fact, combined with the $50 refund offer, means that the fiscal impact of the change in the unaltered license fee will be minimal. This action is taken to incentivize spay/neuter and reflect the cost to the taxpayers of unchecked reproduction rather than to mcrease revenue. The number of animals reclaimed by their owners who hold a current County license is also relatively small. The purpose of this action is to incentivize licensure. The expected increase in ,- revenue from license sales should offset the loss of revenue in impounds and board fees. WHEREAS, the Director of Animal Services has recommended to the Board of County Commissioners that a complete Domestic Animal Services Fee Policy be established as follows; and WHEREAS, the Board of County Commissioners hereby accepts the recommendations of the Director of Animal Services. NOW, THEREFORE BE IT RESOL VED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY THAT: 1. The Collier County Domestic Animal Services Fee Policy is hereby established as follows. This Policy supersedes policies as established in Resolutions 95-107, 95-106, 93-404, 2008-251 and all other Resolutions establishing animal services-related fees: I. PURPOSE The purpose of this policy is to establish user fees which will partially offset the cost of providing domestic animal services to the taxpayers of Collier County. II. LIMITA TIONS No Waiving of Fees. The Board of County Commissioners shall set all fees and charges. No fees may be waived, except as stated herein. Non-Fec-Related Policies. The Director of Animal Services, or designee, may waive enforcement or application of any department policies or restrictions provided such waiver does not conflict with applicable local, state, or federal laws and does not interfere with public safety. Promotional Sales and Advertisements. Fees may be reduced from time to time for special promotional sales and advertisements if approved by the Director of Animal Services and such a reduction is applied in a consistent and time-limited man,i1er. Examples may include but are not limited to: Two- I Agenda Item I\Jo 1602 t'-!ovember 10, 2009 Page 4 of 8 for-one cat adoptions in June to recognize National Adopt-A-Cat ~,10nth, or reduced adoption fees in February for senior citizens. Service Animals. All fees associated with serVIces provided to servIce animals, as defined in F.S. 413.08, are waived. Safekeeping. If an animal is impow1ded at the request of a first-responding agency due to the death, medical emergency, or disaster-related circumstance of its OVvTIer or caretaker, and that animal is claimed by the owner, next of kin, or otherwise authorized party before the end of the next business duy after impoundment within the standard holding period, impound fees may be waived. This exception does not apply to animals of OVvTIers or caretakers who have been arrested or incarcerated. Refunds. The following fees are nonrefundable: Impoundment Fees, Owner Surrender Fees, License Fees (except as provided for herein), and Permitting Fees. The following fees are refundable only if service is not rendered: J'vfandatory Spay/Neuter Fees and ~ficro-chipping Fees. Euthanasia and Cremation Service Fees may be refunded at the discretion of the Direetor of Animal Services, or designee. upon vvritten request received within 30 days of payment or receipt of service, whichever comes first. Adoption fees \vill be refunded within seven days of placement if 1) the animal is retwned to Domestic Animal Services or, 2) the adopter can demonstrate non-routine veterinary medical expenses in excess of the amount of the adoption fee. Adoptions are considered "as is," and no expenses beyond the adoption fee will be reimbursed. Adopted animals may be returned between the eighth and the 30th day after placement without incurring an owner surrender fee, but the adoption fee \vill not be refunded. On the 31 st day and all those thereafter, an owner surrender fee will be incurred for adoption retums. Days are counted as calendar days, irrespective of Domestic Animal Services open-to-the public hours. HI.
