Agenda Item No. 16B5 October 27, 2009 Page 1 of 22 EXECUTIVE SUMMARY Recommendation to approve the payment of attorney fees and expert witness fees incurred by Dr. Gerald and Mrs. Rosemary Brown in defense of the taking of a portion of their property for the Collier Boulevard six - laning project (from Green Boulevard to Golden Gate Boulevard). Project No. 68058, Parcel Nos. 170FEE and 170TCE (Fiscal Impact: $22,879.25) OBJECTIVE: To approve the payment of attorney fees and expert witness fees incurred by Dr. Gerald Brown and Mrs. Rosemary Brown in defense of the taking of a portion of their property for the Collier Boulevard six -laning project (from Green Boulevard to Golden Gate Boulevard). CONSIDERATIONS: The original design of the stormwater detention and treatment system for the Collier Boulevard expansion between Green Boulevard and Golden Gate Boulevard necessitated the acquisition of the eastern 35 feet of the Brown property (as well as another 5 foot temporary construction easement) in order to construct a linear stormwater detention and treatment swale along the west side of Collier Boulevard. The Brown's property is located at the extreme northern end of the project at the Northwest corner of Collier Boulevard and First Avenue Southwest. (See the attached map and aerial photograph.) An estimate of the full compensation owing to Dr. and Mrs. Brown (an eminent domain real estate appraisal) was made and they were offered $155,900 by the County for the loss of the land, the loss of the improvements and landscaping in the take area, as a cure for the loss of their buffer, and for the temporary construction easement. In order to evaluate the reasonableness of the County's offer of compensation, the Browns' attorney, Ms. Bella Patel, hired an eminent domain real estate appraisal firm (Calhoun, Collister and Parham), a fixtures appraiser (Cawthra Consulting and Appraisals), a surveyor (Van Horn and Associates), a landscape consultant (Mr. Green Thumb Horticulturist), and a civil engineer (Tom Harrison). These consultants together arrived at an estimate of full compensation for the Browns in the amount of $417,000. After receiving the counter -offer from attorney Patel, County Right -of -Way Acquisition staff and the design engineers redesigned the project to delete the need for Parcels 170FEE and 170TCE. It is estimated that a significant savings to the County will result by deleting the parcels from the project. Because a bona -fide purchase offer was tendered to the Browns, along with a notice of statutory rights, they are entitled to recover fees and costs. As for the attorney fees and expert costs for which payment is being recommended, the real estate appraiser's fee was negotiated down from $4,354 to $3,915.50; the fixtures appraiser's fee was negotiated down from $1,875 to $1,500; the horticulturist's fee was negotiated down from $4,725 to $3,780; the engineer's fee was negotiated down from $4,575 to $3,660; the surveyor's fee was negotiated down from $3,177.50 to $2,667.50; and the attorney fee was negotiated down from $14,712.50 to $7,356.25. FISCAL IMPACT: The expenditure of $22,879.25 will be paid from Road Impact Fees or gas taxes. LEGAL CONSIDERATIONS: This item is legally sufficient for Board action — RNZ GROWTH MANAGEMENT IMPACT: "There is no growth management impact associated with this Executive Summary.
