EXECUTIVE SUMMARY
Recommendation to obtain approval to enter into a License Agreement with
Kmart Corporation on behalf of the Health Department for the use of vacant space
for the H1 N1 vaccination campaign and to approve a Budget Amendment at an
estimated cost of $50,000.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) to enter
into a License Agreement with Kmart Corporation, on behalf of the Health Department, for use
of vacant space for the H1 N1 vaccination campaign and to approve a Budget Amendment.
CONSIDERATIONS: At the September 29, 2009 Board of County Commission meeting, Dr.
Joan Colfer, Director of the Collier County Health Department, briefed the Board on the
upcoming flu season and the threat of the H1 N1 strain also known as swine flu.
Dr. Colfer advised the Board that there would be several off-campus locations, including
schools, which will serve students and faculty, hospitals, the North Collier Regional Park and a
commercial space which will have to be leased on a temporary basis.
County staff has assisted the Health Department in locating available space for the vaccination
campaign. The Health Department would like to utilize the vacated Kmart that is located on the
corner of Collier Boulevard (C.R. 951) and East Tamiami Trail (U.S. 41), within the Freedom
Square plaza.
,.".- Staff is negotiating a License Agreement with the Kmart Corporation that shall commence on
November 1 and run through December 31, 2009. The monthly rent for the 116,790 square
feet, which includes all utilities, shall be Twenty-five Thousand Dollars per month. The Health
Department shall also have use of the parking area adjacent to the building.
The State requires that services be rendered prior to remitting payment to a vendor. However,
the landlord of the subject property is requiring the first month's rent paid prior to occupancy.
With this development, Alan Portis, Finance and Accounting Director for the Health Department,
submitted an interoffice memorandum to County Manager Leo Ochs asking for the County to
enter into an Agreement for the commercial space and provide the required rent. The State will
then reimburse the County, in full, by January 31, 2010. The memorandum from Mr. Portis is
attached for reference.
At this time, staff is continuing to negotiate the License Agreement with Kmart Corporation and
an Agreement was not available to accompany this Executive Summary. Staff is requesting that
the Board approve the concept of the Agreement and execute the Agreement at a later date
pending final approval by the Office of the County Attorney.
FISCAL IMPACT: The State of Florida Health Department will fully reimburse Collier County
upon receipt of an invoice for the costs associated with the rental facility. The budget
amendment is needed to appropriate the rent expenditure of $50,000 for the two month period
of the rental agreement and allow recognition of the reimbursement revenue from the State.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan.

LEGAL CONSIDERATION: The License Agreement will be reviewed for legal sufficiency prior
to the Board Chair's execution. - JBW

RECOMMENDATION: That the Board approves a License Agreement with Kmart Corporation,
pending final approval by the Office of the County Attorney, and authorizes the Chairman to
execute the Agreement at a later date, and approve the Budget Amendment for same.

SUBJECT: REQUEST FOR COUNTY ASSISTANCE - SOUTH POD SITE
1. Request your assistance in securing the former K-Mart facility (at corner of 951 and 41) for
Naples South point of distribution (POD) operations for November and December 2009. A
critical component in support of the Collier County Health Department's mass H1 N1
vaccination campaign is securing a South point of distribution (POD) site to assist in the
vaccination of an estimated 350,000 county residents and visitors. The targeted County
population is as follows: pregnant women, persons who live with or provide care for infants
aged <6 months, healthcare and EMS personnel, persons aged 6 months-24 years, and
persons aged 24-64 years who have medical conditions that put them at higher risk for
influenza-related complications.
2. The optimal POD location needs to be strategically located to the population targeted for
that area, provides multiple and safe access for heavy traffic, and includes adequate parking
for over 200+ vehicles. The interior of the facility should be able to accommodate several
hundred (possibly thousands) of people at any given time who will be receiving their
vaccinations or waiting the required 15 minutes post-vaccination. The facility must provide
multiple restrooms (10+), lighting, and air conditioning to be sufficient for the worst case
scenario, i.e. several thousand people at one time. A North Naples POD location has been
secured at the North Collier Regional Park and will start operations on October 1 st albeit the
H 1 N 1 vaccine is not expected to arrive until mid-October.
3. A thorough month-long search by the Health Department and Collier County Real Property
Management (Michael Dowling and Skip Camp) produced several possible locations that
lacked one or more of the POD site requirements above. Several County-owned buildings
were considered to include most recently the former Elks Lodge (renovations to start Oct 15th)
and Golden Gate Library (inadequate space and restrooms). Several commercial buildings
were visited but lacked one or more of the POD site requirements. The only known facility
that met all South POD site requirements is the K-Mart facility that will be available on
November 1 st. Michael Dowling, on the Health Department's behalf, has been coordinating
negotiations for the past three weeks. A lease has been received for securing the entire
facility of 116,000 sq ft. at $25,000 a month ($50,000 total) for two months
(November/December). Unfortunately, the State procurement process is not conducive to
leases th8t require timely action 8nd advance p8yments

4. It is imperative that this site be secured as soon as possible for planning purposes.
Request the County sign this lease at the next Board Action or as soon as possible. The
Health Department will reimburse the County for all costs associated with this lease upon
receipt of a County invoice. Please let me know if you require additional information. Your
