EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners approves, and authorizes staff to
develop and advertise, an ordinance establishing policies, procedures and standard forms to be
used by the Board of County Commissioners when selling and conveying real property
acquired under the Neighborhood Stabilization Program or another State or Federal grant
program.
OBJECTIVE: That the Board of County Commissioners approves. and authorizes staff to develop
and advertise, an ordinance establishing policies, procedures and standard forms to be used by the
Board of County Commissioners when selling and conveying real property acquired under the
Neighborhood Stabilization Program or another State or Federal grant program.
CONSIDERATIONS: On March 24,2009, agenda item IOE, the Board of County Commissioners
(Board) approved an agreement with the U.S. Department of Housing and Urban Development
(HUD) to accept entitlement funding for the Neighborhood Stabilization Program (NSP) in the
amount of $7,306,755. Additionally, under agenda item 10F, the Board approved the NSP
Administrative Plan. The Administrative Plan is a guide for operating the Collier County NSP in
conformance with the rules and regulations as authorized by Title III of Division B of the Housing
and Economic Recovery Act 2008.

Since inception, Collier County has used NSP funds to acquire twenty (20) residential properties.
These properties will be redeveloped and rehabilitated prior to being sold to persons or households
earning not greater than 120 percent of the area median income, adjusted for household size. All
homes acquired must remain affordable for fifteen (15) years.
Section 125.35(1)(a), Florida Statutes, requires that notice by publication and competitive bid be
utilized to dispose of property belonging to Collier County. Because of the unique nature of the
NSP, notice by publication and competitive bid is not a suitable means to provide notice to qualified
buyers of the eligible properties. For example, all properties assisted with NSP grant funds must be
sold for less than the county paid. As such, competitive bidding would most likely violate the
conditions of the grant program.
As an alternative, Section 125.35(3), Florida Statutes, allows a county to adopt an ordinance to
prescribe disposition standards and procedures when the requirements listed above are not feasible.
The standards and procedures must provide for, at a minimum, the following six (6) conditions:
1. Establishment of competition and qualification standards upon which disposition will be
determined; and
2. Reasonable public notice of the intent to consider disposition of county property and the
availability of copies of the standards. Reasonableness of the notice is to be determined by the
efficacy and efficiency of the means of communication used; and

3. Identification of the form and manner by which an interested person may acquire county
property; and

4. Types of negotiation procedures applicable to the selection of a person to whom county
properties may be disposed; and
5. The manner in which interested persons will be notified of the board's intent to consider
final action at a regular meeting of the board on the disposition of a property and the time and
manner for making objections; and
6. Adherence in the disposition of real property to the governing comprehensive plan and
zoning ordinances.
All funding allocated to Collier County for operation of the NSP must be obligated within eighteen
(18) months from the date HUD executed the grant agreement. As such, Collier County has worked
diligently to expend program funds in a timely, transparent and responsible manner. The result of
these efforts is that Collier County is well ahead of other counties that have received NSP funding.
In fact, of the seventeen (17) counties contacted during preparation of this agenda item, only two (2)
have adopted ordinances to contemplate the disposition of NSP assisted properties. Copies -of the
two (2) ordinances are attached to this item.
Approval of this item will permit staff to use the aforementioned ordinances as models for
development of the Collier County NSP ordinance relating to the selling and conveying of property
acquired under the NSP or another State or Federal grant program. The County Attorney's Office
will ensure that the resulting ordinance shall contain the standards and procedures necessary and
meet the above mentioned statutory requirements. The proposed ordinance will be advertised and
presented for Board consideration and approval at a regularly scheduled public meeting in the near
future.
Additionally, approval of this item will allow staff to prepare standard forms to be used by the
Board of County Commissioners when selling and conveying real property acquired under the NSP
or another State of Federal grant program. A standard Purchase and Sale Agreement will be
prepared in order to ensure consistency with all applicable requirements of the NSP. The proposed
standard forms will be presented for Board consideration and approval at a regularly scheduled
public meeting in the near future.
FISCAL IMPACT: The cost of advertising the ordinance is estimated at $500 and is an eligible
grant expense. No general funds will be used.
GROWTH MANAGEMENT IMPACT: The Neighborhood Stabilization Program will further
the goals, objectives and policies of the Growth Management Plan's Housing Element.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office. This item is legally sufficient for Board approval. - JBW

ORDINANCE NO. 09-25
AN ORDINANCE RELATING TO THE ACQUISITION AND
DISPOSITION OF REAL PROPERTY UNDER THE
NEIGHBORHOOD STABILIZATION PROGRAM (NSP), AS
AUTHORIZED BY THE HOUSING AND ECONOMIC
RECOVERY ACT OF 2008; AND OTHER AFFORDABLE
HOUSING ACQUISITION, REHABILITATION, RESALE
(ARR) PROGRAMS ADMINISTERED BY THE LEE COUNTY
DEPARTMENT OF HUMAN SERVICES; PROVIDING FOR
AN ALTERNATIVE TO SUBSECTIONS (1) AND (2) OF
SECTION 125.35, FLORIDA STATUTES; PRESCRIBING
DISPOSITION STANDARDS TO BE USED BYTHE COUNTY
IN SELLING AND CONVEYING REAL PROPERTY
PURSUANT TO THE NSP AND ARR; PROVIDING FOR
IMPLEMENTING RESOLUTIONS; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS. Section 125.35, Florida Statutes, provides for the general provisions
with regard to how the County acquires and disposes of real property; and
WHEREAS, the County has been notified by the United States Department of
Housing and Urban Development (HUD) that the County is entitled to receive grant funds
under the Neighborhood Stabilization Program (NSP) authorized by the Housing and
Economic Recovery Act of 2008 (the Act); and
WHEREAS, the County also performs acquisition/rehabilitation/resale (ARR) of
houses to provide income eligible households access to affordable housing using other
Federal funds; and
WHEREAS, the funds are made available to the County under a grant agreement(s)
which must be implemented pursuant to federal law and rules and regulations; and
WHEREAS, the NSP funds must be spent or committed within eighteen (18) months
of the execution of the NSP grant agreement, which was executed by the County on March
4, 2009; and
WHEREAS, the Act, the grant agreement(s) and the federal rules and regulations
provide the standards and conditions for the acquisition, improvement and disposition of
properties acquired pursuant to the NSP and ARR; and
WHEREAS, the state law provisions pursuant to Section 125.35, Florida Statutes,
and the federal guidelines are not directly compatible; and

WHEREAS, Section 125.35(3), Florida Statutes, provides thatthe County may enact
an ordinance for the acquisition and disposition of real property; and
WHEREAS, in orderto comply with federal standards relating to acquiring properties
and conveying said properties to individuals who meet income eligibility requirements set
forth in the Act, the grant agreement(s), NSP and ARR guidelines, and the federal rules
and regulations, this Ordinance is adopted as an alternative to the provisions of the cited
state law requirements.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF LEE
COUNTY:
Section 1. Premises Incorporated Herein
The foregoing premises shall be incorporated herein as find ings of facts supporting
this Ordinance.
Section 2. Acquisition of Affordable Housing Properties
A. This Board hereby authorizes the County Manager, or their designee, to
execute sales contracts in accordance with established purchasing
procedures and all documentation necessary to complete purchase of
residential properties within Lee County.
B. The purchase price of foreclosed properties under the NSP shall generally
be at a discount from current appraised market value. County staff is
required to adhere to the NSP requirements of minimum discounts for single
property purchases and for bulk purchases. County staff is authorized to
acquire property for NSP and ARR programs based on the following
conditions:
1. Staff shall utilize a form of agreement acceptable to County Lands,
Lee County Human Services, Lee County Administration and the
County Attorney's Office for each property acquired.
2. Staff will coordinate all aspects of the acquisition process, including
conducting due diligence on each property, negotiation of the ultimate
acquisition price, and closing of the real estate transaction.
3. Staff will evaluate each property acquired and determine the scope of
repairs for each home and coordinate the bidding process and
contract award for renovation work on each unit requiring repairs.

4. Properties shall be acquired in the name of Lee County, a political
subdivision of the State of Florida, unless a different ownership is
specifically authorized by the Board of County Commissioners.
Section 3. Conveyance of NSP and ARR Properties
The Board authorizes the County Manager, or their designee to execute sales
contracts in accordance with established purchasing procedures and all documentation,
with exception of County Deeds, necessary to complete sale of NSP properties. The
Board authorizes the Chairman to execute County Deeds. The NSP and ARR provides
for the eligibility and qualification standards addressing the disposition of acquired
properties. In conveying NSP and ARR properties to consumers, the federal regulations
provide eligibility criteria dictated thatthe properties acquired by the County pursuant to the
NSP and ARR may only be sold to individuals that qualify undeLth!3 following standards:
A. All properties made available under the NSP shall only be conveyed to
individuals or families whose income does not exceed one hundred twenty
percent (120%) of the area median income established for Lee County by
HUD. Properties conveyed under ARR shall only be conveyed to individuals
or families whose income does not exceed eighty percent (80%) of the area
median income established for Lee County. Income qualification
determinations will be made by the Lee County Department of Human
Services staff or not for profit organization(s) selected as the Housing
Facilitation Agency.
B. To the extent practicable, residential properties sold by the County under the
NSP and ARR shall be financed through conventional or other private-sector
mortgage financing. To that end, residential properties acquired by the
County under the NSP and ARR shall only be sold to individuals meeting the
income and qualification criteria required by the NSP or ARR, and preference
shall be given to purchasers who also meet credit criteria of private lenders
providing home mortgages to NSP or ARR home purchasers. Nothing in this
Ordinance, however, is intended to preclude the granting of down-payment
assistance or other assistance available through the County or any other
public agency for an eligible buyer under any such assistance program.
C. Notice of the availability for sale of NSP or ARR properties shall be through
County staff and may include the use of private~sector realtors and such
realty-based services as the multiple listing service. In addition, Lee County
staff shall make information on the NSP and ARR known to the citizens of
Lee County through educational outreach programs established by the
Department of Human Services, County Lands or not for profit organizations.
Interested applicants will be encouraged to contact a Housing Facilitation

Agency, the Department of Human Services or other source deemed
appropriate by County staff who has access to the list of homes for sale and
home loan eligibility criteria so that prospective home purchasers can qualify
based on NSP or ARR income criteria and credit worthiness for private
mortgage financing.
D. Criteria applicable to the selection of a person to whom County properties
shall be conveyed shall be as set forth herein utilizing the income
requirements set forth in the NSP or ARR, private lender financing program
requirements, and eligibility and qualifications of persons for other public
sector financial assistance.
E. Qualifying purchasers will be notified by Department of Human Services staff
---or staff of the not for profit organization(s) selected as the Housing
Facilitation Agency. Potential purchasers would be "assigned" to a particular
property on a first come, first considered basis. Upon submittal of
reasonable qualification paperwork, said property shall be identified and
removed from "available" list which will be retained by the Department of
Human Services. Other persons expressing interest in a particular property
will be advised by the Department of Human Services of other properties
available and will be informed of the application and qualification
process(es).
Section 4. Minimum Criteria to be followed bv Staff with regard to Conveyance
of NSP and ARR Properties
To meet the policy and time frame obligations of the NSP and the NSP Grant
Agreement, the following procedures will be followed with regard to the disposition and
conveyance of NSP residential properties. The steps to be followed shall be:
A. County staff may market homes to potential home buyers through a variety
of public and private resources, including the local Multiple Listing Service
(MLS), the Housing Facilitation Agencies, the Lee County website and other
public and private community facilities frequented by the public. County
staff, not for profit organizations and private realtors shall also make program
guidelines, eligibility considerations, target areas, and buyer qualification
criteria made known to public and private organizations who may present
buyers of particular properties to County staff.
B. The sale price of all NSP properties shall be at or below an amount equal to
the cost to acquire the residential property plus the cost to rehabilitate that
particular home orthe current appraised value, whichever is less, as required
by NSP rules or regulations or the NSP grant agreement. The sale price of

all ARR properties shall be at or below the current appraised value of the
residential property.
C. All NSP residential properties sold shall be sold to individuals or families
whose income does not exceed one hundred twenty percent (120%) of the
area median income. All ARR residential properties shall be sold to
individuals or families whose income does not exceed eighty percent (80%)
of area median income.
D. The Board reserves the right under this ordinance to convey properties to
qualified non-profit organizations for reduced or no monetary consideration
if the Board declares said non-profit organization can serve the rental or
home ownership needs of persons qualified under the income or other
standards of the NSP or ARR.
Section 5. Implementing Resolutions Authorized
The Board of County Commissioners hereby reserves unto itself the power, right
and authority pursuant to this Ordinance to direct staff through future implementing
resolutions or procedures with regard to the acquisition of properties under the NSP and
ARR program and the sale, disposition and conveyance of NSP and ARR properties.
Section 6. Effective Date
This Ordinance shall be effective in accordance with State law. This Ordinance is
intended to implement provisions of acquisition/rehabilitation/resale programs to promote
affordable housing and the Neighborhood Stabilization Program pursuant to the Housing
and Economic Recovery Act of 2008.

COUNTY:
Section 1.

A. This Board hereby authorizes the Mayor, or his designee, to acquire foreclosed
residential properties in specific target areas within Orange County approved by the Board. These
target areas have been identified in the Orange County's NSP as areas of high concentration of
foreclosed properties. These target areas have been submitted to HUD and are approved target areas
in Orange County's NSP, which target areas may be amended in the NSP based upon application by
County to HUD.
B. The purchase price of foreclosed properties under the NSP shall generally be at a
discount from current appraised market value. The NSP recommends certain discounts for single
purchases and for bulk purchases. County staff is required to adhere to the NSP requirements of
minimum discounts for single property purchases and for bulk purchases. County staff is authorized
to acquire property meeting the NSP market value criteria in the target areas under the following
conditions:
(1) Staff shall utilize a form of agreement acceptable to the Housing and
Community Development Division, County Administration and the County Attorney's Office for
each property acquired.
(2) Staff will coordinate all aspects of the acquisition process, including

conducting due diligence on each property, negotiation of the ultimate acquisition price, and closing
of the real estate transaction.
(3) Staff will evaluate each property acquired under the NSP and determine the

income and qualification criteria required by the NSP, and preference shall be given to purchasers
who also meet credit criteria of private lenders providing home mortgages to NSP home purchasers.
Nothing in this Ordinance, however, is intended to preclude the granting of down-payment assistance

E. County staff shall be required to assure that, prior to the sale and conveyance of any
real property under the NSP, the property complies with the land use requirements of the Orange
County policy plan and the Orange County zoning ordinances implementing said comprehensive
plan.

Section 4.

NSP Properties. To meet the policy and time frame obligations of the NSP and the NSP Grant

A. County staff and private sector realtors will market homes to potential home buyers
through a variety of public and private resources, including the Orlando Regional Realtor
Association utilizing the multiple listing service and private realtor marketing efforts, the Orange
County website and other public and private community facilities frequented by the public. County
staff and private realtors shall also make program guidelines, eligibility considerations, target areas,
and buyer qualification criteria made known to public and private organizations who may present
buyers of particular properties to County staff.
B. The sale of all NSP properties shall be at or below an amount equal to the cost to
acquire the residential property and the cost to rehabilitate that particular home as may be required
by NSP rules or regulations or the NSP grant agreement.
C. All NSP residential properties shall be sold or rented to individuals or families whose
income does not exceed one hundred twenty percent (120%) of the area medium income.
D. Staff shall adhere to the requirement that not less than twenty five percent (25%) of
the NSP funds allocated shall be used to house individuals or families whose income is at or below
fifty percent (50%) of the area median income.
E. The Board reserves the right under this ordinance to convey properties to qualified
non-profit organizations for reduced or no monetary consideration if the Board declares said non-
profit organization can serve the rental or home ownership needs of persons qualified under the

income or other standards of the NSP.
Section 5.
Implementing Resolutions Authorized. The Board of County Commissioners
hereby reserves unto itself the power, right and authority pursuant to this Ordinance to direct staff
through future implementing resolutions or procedures with regard to the acquisition of properties
under the NSP and the sale, disposition and conveyance of NSP properties.
Section 6.
Effective Date; Sunset Provision. This Ordinance shall be effective in
accordance with State law. This Ordinance is intended to implement provisions of the Neighborhood
Stabilization Program pursuant to the Housing and Economic Recovery Act of 2008. The NSP
award to Orange County is good for eighteen (18) months and the monies thereunder may be reused
for NSP Program purposes. The NSP and Grant Agreement are presently set to expire on March 31,
2013. Therefore, this Ordinance shall automatically sunset and be repealed on December 31,2013,
unless extended by a future action of the Board of County Commissioners.
