EXECUTIVE SUMMARY
Recommend that the Board of County Commissioners approval and authorize the
County Manager or his designee to execute Change OrderlWork Order Addition
#1 to Work Order 45-108308 with Coastal Planning & Engineering for the Physical
Monitoring of the South County Beaches under County/Naples Physical
Monitoring Project (No. 90536.1) in the amount of $65,511.36 on a time & material
not-to-exceed basis. The net contractual value of services will total a not to
exceed amount of $227,635.
OBJECTIVE: For the Board to allow staff to exceed threshold of $200,000 per Work
Order in order to proceed with the physical monitoring of the South County Beaches.
CONSIDERATIONS: On March 24, 2009 the Board of County Commissioners
approved three firms to provide fixed term physical monitoring services under contract
08-5124. Subsequent to this action, Coastal Planning and Engineering pursuant to the
"Best Value Offer" (BVO) process, was awarded a work order to proceed with specific
and defined physical monitoring services for a not to exceed amount of $231,021.64.
The current amount has been lowered to $227,635.00 after aligning the hourly rates
offered in the offer with the rates set forth in the contract. Funding for physical
monitoring is currently budgeted within Fund (195) under Project No. 90536.
On July 9, 2009, staff executed a work order with Coastal Planning & Engineering under
Contract No. 08-5124 for the professional engineering services for the physical
monitoring of the North County Beaches and North County Passes. The monitoring of
the South County Beaches was not included in the original work order due to the fact
that the South County Beaches were not slated to be monitored until sometime in
December 2009. A Notice to Proceed was issued for a time and material not to exceed
amount of $162,123.64 leaving a balance of $65,511.36 for the physical monitoring of
the South County Beaches under Contract 08-5124-1. This Change Order/Work Order
Addition increases this Work Order to $227,635.00 requiring board approval.
On July 28, 2009, Agenda Item 10J, the Board approved a Budget Amendment to
consolidate current monitoring projects into one funding source (90536) to fund this
project.
FISCAL IMPACT: A Budget Amendment was approved by the Board on July 28, 2009
to consolidate available funding for this project under Category "A" Tourist Development
Tax Fund Project No. 90536.
This work is required by FDEP permit. Failure to approve this Change Order/Work
Order Addition #1 to fund Physical Monitoring for the South County Beaches will result
in a permit compliance violation.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan related to this action.

LEGAL CONSIDERATIONS: This item has been reviewed and approved by the
County Attorney's Office. This item is not quasi-judicial, and as such ex parte disclosure
is not required. This item requires majority vote only. This item is legally sufficient for
