EXECUTIVE SUMMARY
Recommendation to adopt a resolution authorizing the condemnation of land and easements
necessary for the construction of roadway, drainage and utility improvements required for
the extension of Vale wood Drive from Immokalee Road to Autumn Oaks Lane. (Northbrooke
DriveNalewood Drive Extension Phase 1, Project No. 60106.) Estimated fiscal impact:
$875,000.00.
OBJECTIVE: To adopt a resolution authorizing the condemnation of land and easements
necessary for the construction of roadway, drainage and utility improvements required for the
extension of Valewood Drive from Immokalee Road to Autumn Oaks Lane. (Northbrooke
DriveNalewood Drive Extension Phase 1, Project No. 60106.) (Hereinafter referred to as the
"Project".)
CONSIDERATIONS: The Board of County Commissioners has been advised through various
communications of the need for construction of improvements to Northbrooke Drive and the
extension of Valewood Drive. The Project (Phase 1) comprises the extension of Valewood Drive
only. One of the eight right-of-way parcels required has already been acquired. Construction of the
Project is scheduled to commence in Fiscal Year 2010 and the proposed resolution relates to the
remaining seven parcels. Project scheduling requires that authority be granted for the condemnation
of these remaining parcels, so as to ensure that construction is not delayed if these parcels are not
acquired in a timely manner by negotiation.
The Board is herewith being advised of the various factors conSIdered by its professional
engineering staff and consultants, which include the environmental impacts, costs, public health,
safety and welfare considerations, and the long-range planning needs and impacts. In this regard
the Board is referred to the attached Technical Memorandum prepared by the firm ofPB America.
By its review, concurrence and approval of this executive summary, the back-up documentation,
and the proposed resolution, the Board will have determined that the legal descriptions, and the land
or easements specified on each legal description, which are a part of the attached resolution,
represent the most feasible location, and are necessary for the construction of the proposed
extension of Vale wood Drive.
The Board of County Commissioners is further advised that it is necessary and in the public's best
interest to acquire, by condemnation if necessary, the land or easements specified on each legal
description attached to the resolution.
FISCAL IMPACT: For the parcel of right-of-way already acquired for this Project, $139,l42.79
in road impact fee credits were given to the property owner in accordance with the provisions of
CU-AR-13890, approved by the Board of County Commissioners in October 2008. Excluding this
parcel, should condemnation of all of the seven remaining parcels described in the Condemnation
Resolution become necessary, the total cost is estimated to be $875,000.00. This amount includes
not just the direct cost of all land and easements required for construction. It also includes an
estimate of severance damages to remaining properties caused as a result of the part taken to
construct the Project, as well as all expenses for title work, real estate appraisals, and those
expenses, such as property owner attorney fees and expert witness fees, which the County is

required to pay according to Sections 73.09l and 73.092, F.S. All such payments will come from
the Transportation Supported Gas Tax fund and/or the Road Impact Fee funds. Source of funds are
gas taxes and/or road impact fees.
GROWTH MANAGEMENT IMPACT: The extension of Vale wood Drive is an integral part of
Collier County's Growth Management Plan.
LEGAL CONSIDERATIONS: This Executive Summary is legally sufficient for Board action.
This item is not quasi judicial, and as such, ex parte disclosure is not required. This item requires a
majority vote only.--HF AC.
RECOMMENDATION: That the Board of County Commissioners of Collier County:
1. Adopt the attaclll~d Resolution;
2. Authorize its Chairman to execute same on behalf of the Board; and -
3. Authorize any budget amendments that may be necessary to implement the collective will ofthe
Board as evidenced by the adoption of the attached Resolution and the approval of this
Executive Summary.

RESOLUTION NO. 2009- -
A RESOLUTION AUTHORIZING CONDEMNATION OF LAND AND
EASEMENTS NECESSARY FOR THE CONSTRUCTION OF ROADWAY,
DRAINAGE AND UTILITY IMPROVEMENTS REQUIRED FOR THE
EXTENSION OF V ALEWOOD DRIVE FROM IMMOKALEE ROAD TO
AUTUMN OAKS LANE. (NORTHBROOKE DRIVEN ALEWOOD DRIVE
EXTENSION PHASE 1, PROJECT NO. 60106.)
WHEREAS, the acquisition of right-of-way for the extension of Vale wood Drive from
Immokalee Road to Autumn Oaks Lane (Northbrooke DriveNalewood Drive Extension Phase 1,
Project No. 60106) (hereinafter referred to as "the Project"), is included in Collier County's Five
Year Transportation Work Program; and
WHEREAS, plans and specifications have been prepared for construction of the Project;
and
WHEREAS, the location for the construction of the proposed improvements has been
fixed by survey and is collectively represented by the legal descriptions comprising Exhibit "A",
attached hereto and incorporated herein; and
WHEREAS, after consideration of the availability of alternate routes and locations, the
comparative costs ofthe Project alternatives, various impacts upon the environment, long range
planning options, and public safety considerations, the Board desires to exercise its right to
condemn property for public purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the
Board that the extension of Vale wood Drive from Immokalee Road to Autumn Oaks Lane
(Northbrooke DriveNalewood Drive Extension Phase 1, Project No. 60106) is necessary and in
the public's best interest in order to protect the health, safety and welfare of the citizens of Collier
County.
AND IT IS FURTHER RESOLVED that the acquisition of land and easements for
construction of the Project is an integral part ofthe County's long range planning effort, and is
included in the Capital Improvement Element of the Collier County Growth Management Plan,
as approved by the Florida Department of Community Affairs.
AND IT IS FURTHER RESOLVED that the County Staff has reviewed alternative
alignments for construction of the Project, and the costs associated with the design, property
rights acquisition, and construction of the Project, as well as public safety and welfare

considerations associated with the design and construction of the Project, and various impacts to
the environment, and the Board finds that after consideration of these issues, the most favorable
alignment for construction of the proposed improvements is collectively represented by the legal
descriptions comprising Exhibit "A", attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that in order to construct the Project as designed, it
is necessary for the Board to acquire the land and easements described in Exhibit "An.
AND IT IS FURTHER RESOLVED that all property shall be put to public purposes.
AND IT IS FURTHER RESOLVED that the County staff and Office of the County
Attorney are hereby authorized and directed to immediately acquire by gift, purchase or
condemnation in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, the

land and easements more particularly described in Exhibit "A," attached hereto and incorporated
herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the property
sought to be acquired and therefore it will not be necessary to remove any mobile homes from
the property to be acquired.

EXECUTIVE SUMMARY
1. INTRODUCTION
Collier County Transportation Engineering has investigated and is pursuing roadway and intersection
improvements in conjunction with the extension of Valewood Drive at Immokalee Road, in Collier
County, Florida.
More specifically the Valewood Drive Extension project consists of providing new traffic signals at
the intersection of Valewood Drive and Immokalee Road, and extending Valewood Drive south from
Immokalee Road to connect with Autumn Oaks Lane. Some of the other more major ancillary
Improvements include providing a westbound left turn lane on Immokalee Road, widening Autumn
Oaks Lane to provide an eastbound left turn lane, providing an eastbound right turn lane on
Immokalee Road, providing a northbound right turn lane on Oakes Boulevard, providing ADA
compliant pedestrian features, and providing a new stormwater treatment pond adjacent to the
new Valewood Drive extension, These improvements will allow the local roadway network to
operate more efficiently, provides for improved access to Immokalee Road, helps relieve congestion,
and further helps facilitate the improved operation of the 1-75 interchange to the west, To provide
these transportation improvements the acquisition of right-of-way is needed for the new Valewood
Drive roadway and the associated stormwater treatment pond.
2. PURPOSE
The project will result in a more optimum spacing of traffic signals on Immokalee Road. The specific
purpose of the project is to improve mobility and enhance traffic circulation for the local system in
this area with the following factors having contributed to the need for these improvements:
. Widening of Immokalee Road to 6 Lanes.
. Removing of signal at the intersection of Oakes Boulevard at Immokalee Road,
. Improving the 1-75 Interchange at Immokalee Road.
. Installation of directional median at the Oakes Boulevard intersection with Immokalee
Road.
3. EXISTING CONDITIONS
IMMOKALEE ROAD
In the vicinity of the Valewood Drive Extension project, Immokalee Road has been improved to
provide an urban arterial roadway that consists of six 12 foot travel lanes, a raised median that
varies in width, sidewalks, and various pedestrian features. Within the Valewood Drive Extension

project limits the Immokalee Road six lane improvements were recently constructed through a
County design-build project. A closed drainage system of inlets and storm pipe is provided for
roadway stormwater drainage.
V ALEWOOD DRIVE
Currently there is no roadway connection south of the existing Immokalee Road and Valewood Drive
T-intersection. Currently this intersection operates as a full median opening consisting of the
Valewood Drive north leg connection to the new six-lane Immokalee Road. At the intersection
Valewood Drive is a two-lane, divided, urban, residential collector roadway with 2 two lanes in the
northbound direction, and left and right turn lanes in the southbound direction.
AUTUMN OAKS LANE

Existing Autumn Oaks Lane from Oakes Boulevard to east ofthe newly proposed Valewood Drive
connection consists of a two lane rural roadway two 10.5-11 foot lanes, Unpaved shoulders are
provided within these limits. This roadway is also classified as residential local street. Roadway
stormwater runoff is conveyed via roadside ditches.
OAKES BOULEVARD
Oakes Boulevard is also a two lane rural roadway. The typical section consists of two 11 foot lanes.
This roadway is classified as a collector and provides a connection to Immokalee Road. Unpaved
shoulders are also provided. Roadway stormwater runoff is conveyed via roadside ditches,
INTERSECTIONS
Within the project limits there are two existing intersections: Immokalee Road and Valewood Drive,
which is considered a major intersection, and the minor intersection of Autumn Oakes Lane and
Oakes Boulevard. These intersections have the following configuration:
1. Immokalee Road and Valewood Drive (Signalized T-Intersection)
. Immokalee Road eastbound approach:

One eastbound to northbound left turn lane

4. ANALYSIS OF PROJECT FACTORS
A. NEED FOR IMPROVEMENT
In recent years Collier County has seen significant growth and development, particularly along
the 1-75 corridor and its major arterial roadways. The transportation improvements proposed
with this project are necessary components of the regional transportation network and will
accommodate existing and future residential growth in the area while meeting future traffic
demands, These improvements will allow Immokalee Road, which is a vital east-west arterial
highway, to operate at a higher capacity level.
Extending Valewood Drive from Immokalee Road to Autumn Oaks Lane and creating a new fully
signalized "4-way" intersection, while removing the signal and constructing a directional median
opening at Oakes Boulevard, produces a safer and more optimum signal spacing on Immokalee
Road. Increasing the spacing of the signals along Immokalee Road between Northbrooke Drive
to the west and at Oakes Boulevard will reduce delay and the stacking of vehicles, as well as
reduce congestion at the 1-75 interchange just west of Northbrooke Drive. These improvements
also allow for enhanced traffic circulation for the residential developments north and south of
Immokalee Road.
B. LONG RANGE TRANSPORT A TION
The Valewood Drive Extension and intersection improvements are included in the Collier
Metropolitan Planning Organization (MPO) 2030 Long Range Transportation Plan (LRTP) as part

of the Immokalee Road and 1-75 Improvements. This project is being developed as an important
element for improving traffic flow along Immokalee Road and the local network transportation
network.
C. At TERNA TIVE CONCEPTS
While consideration was given to developing alternative concepts along Northbrooke Road and
Valewood Drive, the right-of-way constraints eliminated many of the different alignments that
were considered. Due to the permanent fixed location of the canal along the north side of
Immokalee Road, the primary road alignment was very much constrained and therefore did not
allow any deviations. Keeping Valewood Drive within the existing right-of-way north of
Immokalee Road was an important factor in determining the alignment of Valewood Drive south
of Immokalee Road.

Three alternatives for the new Valewood Drive Extension were considered. Alternative 1
consisted of an "aligned" new Valewood Drive Extension with the north leg of Valewood Drive.
Alternative 2 consisted of shifting the new Valewood Drive Extension to the east of the "aligned"
alternative 1. Alternative 3 consisted of shifting the new Valewood Drive Extension to the west

intersection. The "offset" intersection condition would have created a significant deflection of
the roadway through the intersection which far exceeds safety and design standard tolerances,
Significant right-of-way impacts and construction costs would have resulted including the need
to reconstruct the existing bridge structure within the north leg of Valewood Drive. Alternative 3
was also considered to be cost prohibitive and determined to not be viable. The same "offset"
condition would be created with the new Valewood Drive Extension and the north leg of
Valewood Drive, This would have resulted in significant deflection of the roadway through the
intersection which far exceeds safety and design standard tolerances. Significant right-of-way
effects would have resulted including impacting the newly developed church property to the
west. Higher construction costs would have resulted including the need to reconstruct the
existing bridge structure within the north leg of Valewood Drive. Alternative 1 was studied and
selected because it was determined to be viable. The newly constructed and "aligned"
Valewood Drive Extension would line up with the north leg of Valewood Drive. Right-of-way
impacts and construction costs were found to be minimal compared to alternative 2 and 3. The
"aligned" alternative 1 could also be designed to provide a safe roadway facility consistent with
accepted roadway design standards,
D. SAFETY
Safety improvements were implemented throughout the project to make sure that the
necessary criteria (FDOT, Collier County and AASHTO) were met for general and canal clear
zones, border width, stopping sight distances, adequate signal spacing, pedestrian safety
improvements such as sidewalks and ADA ramps and to provide safe circulation of motorists
and pedestrians. A few exceptions were made using the 11' minimums for both travel and turn

lanes, and reducing the border widths to S'due to right-of-way constraints, Even though FOOT
requires a 5' width for sidewalks, Collier County's minimum sidewalk width is 6' which was
implemented in the design, Construction of the new Valewood Drive will increase safety to the
Immokalee corridor by improving traffic flow through the intersections with the addition of the
protected turning movements (turn lanes) from Immokalee Road onto Valewood Drive.
E. ENVIRONMENTAL
After conducting extensive site reviews, it was determined that the areas within our project
limits are not under any significant wetland impacts and there are no jurisdictional wetlands
present that will affect the proposed pond locations. In addition, there was no evidence to
support that the proposed project limits have any particular species of animals, whether
endangered or not and therefore no risk is present.

F. PUBLIC INPUT
The public has been made aware of the improvements to this corridor via public forums such as
the local newspaper advertisement/notices and public information meetings hosted by the
County and Design Consultant, The public was given an opportunity to view the displays, asks
questions about the project improvement, state issues and general concerns for the projects
and submit comments. The public's input is important because the County and the Design
Consultant review their comments and wherever necessary any recommendations to help bring
awareness to us of other issues we may not be aware of are addressed.
G. COSTS
The costs for these critical improvements for this project have been carefully considered in the
analysis and design throughout this project to meet the goals of the County. Throughout the
progression of the design and permitting process ofthis project, the costs have been more
defined up to this phase. A current estimate of $1.7M is for the 90% Engineers Estimate of
Probable Cost for the Valewood segment improvement. This does not include the cost for
acquiring right-of-way.
