RESOLUTION '2002-72
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
PROVIDING FOR WAIVER OF ADMINISTRATIVE FEES IMPOSED
FOR VIOLATION OF ORDINANCE 99-51, AS AMENDED, AND
SUPERSEDING RESOLUTION 2001.426 FOR ASSESSMENT OF LIEN.
WHEREAS, the Board of County Commissioners adopted Resolution 2001-426
on November 13, 2001, which provides for the assessment of lien for the cost of the
abatement of a public nuisance in accordance with Ordinance 99-51, as amended, against
property owned by Joseph F. Morgan and Elizabeth A. Morgan; and
WHEREAS, the violated property is described as Lots 1 and 2, Block E, Sable
Shores Subdivision and identified by Folio # 71781960003; and
WHEREAS, the property owners, Joseph F. and Elizabeth A. Morgan, requested
a hearing to show cause why the expenses should not constitute a lien against their
property within ten days of the date of the Legal Notice of Assessment of Lien, as
provided for in Ordinance 99-51, as amended; and
WHEREAS, part of the assessment, i.e" the actual cost of the lot mowing, has
been paid to the County in the amount of $55,00, leaving only administrative fees in the
amount of $200,00 as unpaid; and
WHEREAS, the property owners maintain that they attempted to abate the
violation in accordance with the notice of violation but the violation remained due to a
mistake in identification of the property to be mowed; and
WHEREAS, the Board of County Commissioners hereby finds that the
assessment of the administrative fees in this instance is unwarranted and should not
constitute a lien on the subject property.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the assessment of
administrative fees in the amount of $200.00 imposed by virtue of Resolution 2001-426
is hereby waived as to the property described in Resolution 2001-426.
Adoption of this Resolution shall supersede and replace Resolution 200 1-426 and
shall render Resolution 2001-426 of no further force and effect.
This Resolution is hereby duly adopted on this /..?~day of February, 2002, after
motion, second and majority vote favoring its adoption.
