Petition SNR- 2009 -AR- 14206, Marbella Lakes Associates, LLC, is requesting a Street Name Change
from Green Boulevard to Marbella Lakes Drive, located north of Marbella Lakes Subdivision, Tract A-
2 and A -3A, Section 19, Township 49 South, Range 26 East.
OBJECTIVE:
Recommendation to have the Collier County Board of County Commissioners approve the resolution
renaming a portion of Green Boulevard to Marbella Lakes Drive, from the intersection of
Whippoorwill Lane to the intersection of Livingston Road. (See attached location map).
CONSIDERATIONS:
The Petitioner has met the requirements for requesting a street name change and the proposed name
does not duplicate an existing name in Collier County. There are two property owners abutting the
street in question and both have granted their approval of the change.
Collier County Ordinance No. 2007 -62 states that anyone wishing to rename a County street must
submit a petition establishing that at least 66 percent of the property owners abutting the street are in
favor of the change. A duly advertised public hearing, and a super - majority vote of at least four
affirmatives votes, shall be required to effectuate the renaming of the street or roadway.
The County's Transportation Department anticipates renaming the street, potentially back to Green
Boulevard, once the planned extension of Green Boulevard is completed. This project is currently not
in the 5 -year project plan so at this time it is not possible to determine when that may happen. As
such, the Transportation Department has recommended that the potential future name change be it a
reversion back to Green Boulevard or otherwise, should occur at the developer's or future owner's
expense and not the County's expense.
FISCAL IMPACT:
Fiscal impact will be incurred in the form of staff time spent noting changes on plats by the
Engineering and Environmental Sci ices Department and address records by the Addressing Staff.
Fiscal impact to fire, police (Sheriffs Office), Post Office, EMS, and 911 Emergency Services will be
incurred in the form of costs to update records and maps. The Petitioner will bear the cost of replacing
the sign(s). If approved as stipulated the Developer will bear the cost of the notice and public hearing
required to approve a future name change.
GROWTH MANAGEAJENT IMPACT:
The renaming of the street will have no impact on the Growth Management Plan.
ZONING DEPARTMENT STAFF RECOMMENDATION:
Staff recommends that the Board of County Commissioners approve Petition SNR- 2009 -AR- 14206,
changing the name of Green Boulevard to Marbella Lakes Drive with the following condition:
1. If and when Green Boulevard is extended westward from Santa Barbara Boulevard to Marbella
Lakes Drive or Whippoorwill Road is extended south to Marbella Lakes Drive, the County may
rename Marbella Lakes pursuant to the applicable provisions of the County Codes of Laws and

STREET NAME CHANGE PROCEDURES
Collier County Ordinance No. 2007 -62 states that anyone wishing to rename a
County street must submit a petition of sixty -six percent of the property owners
abutting the street to be renamed. The proposed name may not duplicate an
existing name. Applicants must verify with the Addressing Section of the Collier
County Planning Department (234- 252 -2482) that the proposed name is not a
duplication prior to submitting the application. An addressing checklist should be
completed and provided with the application. The application should be forwarded
with a cover letter describing the proposed change to:

1 . A petition signed by sixty -six percent of the property owners abutting the street

of miles; the location and number of street signs, and the zoning of abutting
properties.

WHEREAS, the legislature of the State of Florida by enacting § 336.05, Florida Statutes,
has conferred on all counties in Florida the power to name or rename streets and roads, except for
certain state roads; and
WHEREAS, Collier County pursuant thereto has adopted Collier County Ordinance No.
07 -62, as codified in Chapter 22, Article X, of the Collier County Code of Laws and Ordinances,
which establishes criteria and procedures to rename streets or roads; and

segment is located between Livingston Road and Whippoorwill Lane in Tracts A -2 and A -3A of
the Marbella Lakes Subdivision, according to the plat thereof, recorded in Plat Book 46, Pages
77 through 83, of the Official Records of Collier County, Florida, which is in Section 19,
Township 49 South, Range 26 East, Collier County, Florida; and
WHEREAS, the Board has determined that all criteria set forth in Ordinance No. 07 -62
have been met and specifically finds that there is no other street in incorporated or
unincorporated Collier County with this name or any similar sounding name as is being
requested; and

Effective this date, the name of the street segment described in the above recitals is
hereby changed from Green Boulevard to Marbella Lakes Drive, and is confirmed as such.
BE IT FURTHER RESOLVED that if and when Green Boulevard is extended westward
from Santa Barbara Boulevard to Marbella Lakes Drive or Whippoorwill Road is extended south
to Marbella Lakes Drive, the County may rename Marbella Lakes Drive pursuant to the
