Agenda 07/28/2009 Item #16A16Agenda Item No. 16A16 July 28, 2009 Page 1 of 16 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners (Board) receive and approve the Progress Report for the Year 2008, Collier County Floodplain Management Plan, Section 7 of the Collier County Hazard Mitigation Plan. OBJECTIVE: To provide the Board of County Commissioners with the fourth annual progress report on the Collier County Floodplain Management Plan that was developed as a requirement of the County's participation in the Community Rating System of the National Flood Insurance Program. CONSIDERATIONS: Collier County is a voluntary participant in the Community Rating System (CRS) of the National Flood Insurance Program. Because the County has a Class 7 rating in the CRS program and there are more than ten (10) properties in the County that have filed multiple flood insurance claims within any ten -year period, thus establishing them as Repetitive Loss Properties, the County is required to develop and maintain a Floodplain Management Plan. The purpose of a Floodplain Management Plan is to promote awareness of floodplain and flooding issues, identify known flood hazards, discuss past flooding events, assess the current floodplain/flooding problems, and set goals along with a strategy to make the community more resistant to flooding. One key component is to address ways to mitigate the Repetitive Loss Properties so they no longer are susceptible to flooding from the 1- percent --- annual chance storm event. Collier County is currently rated as a Class 7 community in the CRS program, which provides up to a 15 percent discount on the premium rates charged to flood insurance policy holders. The County is required to annually provide a progress report on the accomplishments of goals in the Floodplain Management Plan. At least every five (5) years, the Floodplain Management Plan must be updated. For Collier County, the Floodplain Management plan was developed as a portion of the adopted Hazard Mitigation Plan. The attached "Progress Report for the Year 2008, Collier County Floodplain Management Plan, Section 7 of the Collier County Hazard Mitigation Plan" (hereafter referenced as REPORT) includes a reporting of progress made toward fulfilling the Action Plan items which were derived from the goals, objectives and policies of the Floodplain Management Plan. The REPORT also includes the recommended Floodplain Management Plan Action Plan Items for 2009, with a prioritization given to those items that are mandatory (identified as category A), those items selected as the "Top Five" for completion by the Floodplain Management Planning Committee (identified as category B), and all of the other Action Items included in the 2008 Action Plan that were not one -time issues that have already been completed. These action items were developed as a part of the updated Floodplain Management Plan that was approved by the Board on 12- 11 -07. Staff is providing this annual report to keep the Board of County Commissioners informed on progress in floodplain management and. seeking recommendations for additional direction and Agenda Item No. 16A16 July 28, 2009 Page 2 of 16 efforts the Commissioners would desire to achieve to make Collier County more resistant to flood damage. It is proposed to present the 2009 Progress Report to the Board in March 2010. LEGAL CONSIDERATIONS: This item is not quasi - judicial, and no ex parte disclosures are required. Approval requires a simple majority vote. This item has been reviewed for legal sufficiency and is legally sufficient for Board action. —JW FISCAL IMPACT: None, to receive and approve the REPORT. Should future fiscal impact be proposed based upon any new program changes, regulations, resolutions or other methods, that fiscal impact information will be provided at the time the Board receives the follow -up documentation. A copy of the adopting resolution (No. 04- 390) is included as Attachment A to this report. Included within the Hazard Mitigation Plan was the County's Floodplain Management Plan (FMP) which was developed to comply with requirements of the Community Rating System (CRS) of the National Flood Insurance Program. The Floodplain Management Plan is Section 7 of the Hazard Mitigation Plan. A copy of the adopting resolution (No. 2007 -351) is included as Attachment B to this report. A Floodplain Management Planning Committee (FMPC) was established by the Board in 2006. This Committee was formed to further promote the development and implementation of sound floodplain management practices within the County. The Committee consists of ten (10) volunteer members of the public, ten (10) County staff members representing ten (10) key departments involved in activities impacting the floodplain, and one (l) representative from each of the three (3) municipalities. During 2008, the FMPC met thirteen (13) times in regular meetings to discuss floodplain management plan implementation issues and progress. The FMPC also held five (5) special information gathering evening meetings in different locations around the County along with two (2) special information gathering meetings for special interest groups and agencies. Michael DeRuntz, a principal planner in the Comprehensive Planning Department, led the work effort. The Community Rating System (CRS) requires the County to annually develop and present a status report on the progress made to the goals, objectives, and action plan of the Floodplain Management Plan. This status report is then submitted as a part of the subsequent year's CRS annual recertification documentation. County staff has prepared this annual progress report for Page 1 of 13 Agenda Item No. 16A16 July 28, 2009 Page 5 of 16 . presentation and review with the FMPC and the Board. The purpose of the annual progress report is to help ensure that there is a continuing and responsive floodplain management planning and implementation process. Notifications on the availability of this progress report are made through the standard public advertising process for all items on the Board's agenda, of which this Progress Report was included for discussion on July 28, 2009. When an item is placed on the Board's agenda, it is available for review and inspection in the Board's office, the Office of the County Manager, and on the County's web site (www.colliergov.net). There is also a public notification process for each meeting of the FMPC, of which this Progress Report was included for discussion on the June 1, 2009 meeting. The Collier County Floodplain Management Plan (FMP) is located on the Floodplain Management Plan page of the County web site (http: / /www.colliergov .net /Index.aspx ?pae= 1671). Section 7.8 of the FMP contains a series of goals, objectives and policies. From these, an Action Plan is developed in Section 7.10 of the FMP to identify those items deemed important for accomplishment in the following year to meet the intentions of the goals, objectives and policies. WHEREAS, Collier County entered into an Agreement with the State of Florida Department of Community Affairs on July 29, 2003 to develop a county -wide Mitigation Plan: and WHEREAS, the Collier County Comprehensive Plan's Conservation and Coastal Management Element Policy 12.2.1 provides for a review and update of the County's Hazard Mitigation Plan procedures every four years; and WHEREAS, the Collier County Comprehensive Plan's Conservation and Coastal Management Element Policy 12.2.3 provides for the participation in the National Flood Insurance Program (.NFIP); and WHEREAS, Collier County has participated in the NFIP since 1979 to avail flood insurance for properties within Collier County: and WHEREAS, Collier County participates in the Community Rating System (CRS) of the NFIP to facilitate a reduction of flood insurance premiums for properties within Collier County; and WHEREAS, communities that are identified as a "Class C" community and have a Class 7 classification within the CRS are required to provide an annual review of their Floodplain Management Plan; and WHEREAS, directed by Resolution 2006 -200. the Floodplain Management Planning Committee has reviewed the current Floodplain Management Plan and the various floodplain management programs and activities that exist within Collier County.
